Nations approve Landmark Climate Accord in
Paris

Dear Student,

Welcome to the December Edition of the Law Bulletin.

Floods have created havoc in Chennai. People,
animals, buildings, vehicles and roads were all
affected by the tragedy. However, this also caused
people to keep their communal differences aside and
rise to the occasion to help each other.
A deal to attempt to limit the rise in global
temperatures to less than 2C has been agreed at
the climate change summit in Paris after two
weeks of intense negotiations. The pact is the first
to commit all countries to cut carbon emissions.
The agreement is partly legally binding and partly
voluntary. Earlier, key blocs, including the G77
group of developing countries, and nations such as
China and India said they supported the proposals.
President of the UN climate conference of parties
(COP) and French Foreign Minister Laurent Fabius
said: "I now invite the COP to adopt the decision
entitled Paris Agreement outlined in the
document. Looking out to the room I see that the
reaction is positive, I see no objections. The Paris
agreement is adopted."
Key points
The measures in the agreement include:
To peak greenhouse gas emissions as soon as
possible and achieve a balance between sources
and sinks of greenhouse gases in the second half
of this century
To keep global temperature increase "well
below" 2C (3.6F) and to pursue efforts to limit it to
1.5C
To review progress every five years
$100 billion a year in climate finance for
developing countries by 2020, with a commitment
to further finance in the future.

between India and Pakistan has been resumed.

India and Pakistan resume dialogue

Floods wreck havoc in Tamil Nadu

The Adyar river in Chennai is a rivulet that ekes its way

to the estuary at the Bay of Bengal. Following weeks of
steady rain in November and a deluge on 1 December,
the Adyar flooded its banks and inundated its
floodplain, bringing misery upon the entire city. The
problem was compounded by the release of water from
the Chembarambakkam (earlier called Puliyur) dam,
about 40km upstream. The reservoir was dangerously
close to full capacity. The official estimate was that
30,000 cusecs were released from the dam into the
Adyar during that fateful night.
The Chennai airport and its runwayswest of the city
are built right beside the Adyar and on its floodplain.
The second runway was extended five years ago by
building a bridge over the riverthe bridge simply
ladled the water straight into the airport. The entire
airport complex was flooded and remained so for
several days. Most areas of Chennai were flooded to
first-floor levels.
The armed forcesthe army and navy in particular
and 50 teams of the National Disaster Response Force
(NDRF) did a good job of mitigating the impact by
rescuing stranded citizens and distributing essentials.
The navy pressed its amphibious warship INS Airavat
into service with supplies and used drones to locate the
worst-hit areas. Chennais denizens supported each
other through the crisis and the city is now slowly
returning to normal.
The Tamil Nadu government released a statement that
347 people were killed in the rains and floods since
October 1, and 17.64 lakh people were rescued and
housed in relief centres. The government also said in a
statement that a total of 6,605 relief centres were
opened in the state. The rains and floods also killed
3,889 cattle.

India and Pakistan have agreed to resume

structured dialogue between them through new
10-point Comprehensive Bilateral Dialogue (CBD).
In this regard, both countries have issued a joint
statement after a meeting between External
Affairs Minister Sushma Swaraj and Pakistan
Prime Ministers Advisor on Foreign Affairs Sartaj
Aziz in Islamabad. The 10-point Comprehensive
Bilateral Dialogue (CBD) includes Peace and
security with confidence building measures
(CBMs), Jammu and Kashmir, Siachen, Sir Creek
Boundary Dispute, Wullar Barrage/Tulbul
Navigation Project, Economic and Commercial
cooperation, Counter-terrorism & Narcotics
control,
People-to-people
exchanges,
Humanitarian issues and Religious tourism. Joint
statement issued also includes National Security
Advisors (NSAs) of both countries to take forward
talks on terrorism. Pakistan committed to
expedite 26/11 Mumbai attacks trial.
National Security Advisor (NSA) level talks
between India and Pakistan were held in Bangkok,
Thailand. It was attended by Indias NSA Ajit Doval
and his Pakistani counterpart Naseer Khan Janjua.
Foreign secretaries S. Jaishankar (India) and Aziz
Ahmad Chaudhary (Pakistan) were also present
during the high level meet.
SC takes a hard stance on pollution in Delhi
The Supreme Court doubled the environment
compensation charge (ECC) for loaded commercial
vehicles entering Delhi and imposed a blanket ban
on registration of diesel vehicles of 2,000 cc and
above in the National Capital Region (NCR). A
bench of Chief Justice TS Thakur, Justice AK Sikri
and Justice R Banumathi said no commercial
vehicle registered prior to 2005 would enter Delhi
and all taxis would have to switch over to CNG by
1 March, 2016.
The court said that all those engaged in
construction activity would observe the Central
Pollution Control Board norms by putting curtains
and other devices at construction sites.

Justice T S Thakur sworn in as the 43rd CJI

Justice Tirath Singh Thakur was sworn in as the 43rd
Chief Justice of India. Thakur, who succeeds Chief
Justice H.L. Dattu, has a tenure of 13 months,
holding the post till January 3, 2017.
With an image of being soft-spoken and patient but
firm judge, Chief Justice Thakur presided over the
bench that delivered judgments in a number of
important cases including ordering a Central Bureau
of Investigation probe into Saradha chit fund scam,
and striking down the amendment in the Board of
Control for Cricket in India rules that permitted
conflict of interest situation in the wake of betting
and spot fixing allegation in the Indian Premier
League's 2013 edition. Besides this, the bench
headed by him is seized of the Sahara matter
wherein Sahara chief Subrata Roy was sent to judicial
custody on March 4, 2014, for not complying with
the apex court order to return investors' money that
his two real estate companies had collected through
optionally fully convertible debentures.
Born on January 4, 1952, Chief Justice Thakur was
enrolled as a lawyer in October 1972 and practised
in the Jammu and Kashmir High Court, whose
additional judge he was appointed on February 16,
1994. He was transferred to Karnataka High Court in
March 1994 and became a permanent judge in
September 1995. He was transferred to Delhi High
Court in July 2004. He became acting Chief Justice of
Delhi High Court on April 9, 2008 and the Chief
Justice of Punjab and Haryana High Court on August
11, 2008 and continued to serve there till he was
elevated as judge of the apex court and assumed
charge on November 17, 2009.
Salman Khan acquitted in hit-and-run case
The Bombay High Court acquitted the Bollywood star
Salman Khan from all criminal charges in over 13
year old alleged hit-and-run case as prosecution
failed to establish the charges (against Khan) on all
counts. Earlier in May, a lower court convicted him
of culpable homicide and sentenced him to five years
in jail for driving over and killing a man sleeping on a
pavement.

G-20 Summit held in Antalya, Turkey

G-20 leaders have decided to tackle global uneven
economic growth and reaffirmed their commitment to
fight terrorism unitedly. The 2015 G-20 Antalya Summit
accommodates several concerns of India which were
raised in various multilateral forums. Being the largest
recipient of remittances, Prime Minister Narendra Modi
had insisted to lower the charges and it has been
included in G-20 agenda which is considered a positive
development. The passage of collective movement
under the Base Erosion and Profit Shifting project on
tax evasion is also considered a positive development in
Indias fight to tackle menace of Black Money. The
summit also took note of Indias viewpoints on various
issues including trade, labour, infrastructure and
corruption.
India, France launch International Solar Alliance
India and France have launched International Solar
Alliance (ISA) at the Conference of Parties (CoP21)
Climate Conference in Paris, France. It was jointly
launched by Prime Minister Narendra Modi and French
President Francois Hollande in presence UN General
Secretary Ban Ki-moon. The idea of alliance was
mooted by Indian PM Narendra Modi to harness solar
power as a major step to mitigate carbon gas emissions.
German Chancellor Angela Merkel named 2015 Time
Person of the Year

Time magazine has named German Chancellor Angela

Merkel as Person of the Year 2015. She was named for
her role in Europes crises over migration and Greek
debt as she had provided steadfast moral leadership in
a world where it is in short supply. With this, Merkel
became only the 4th woman since 1927 to be named
winner and the first woman to feature in 29 years. The
other three women to win are Wallis Simpson (1936),
Queen Elizabeth II (1952) and Corazon Aquino (1986).
Other finalists included Abu Bakr al-Baghdadi, the
leader of the Isis terror cell; Iranian president Hassan
Rouhani
and
Republican
presidential
frontrunner Donald Trump.
