RIVER RUNS

Jury awards
$10M to

TOMS RIVER An Ocean County jury has rendered a $10.1 million verdict against a drunken driver
who killed Ocean Gate Police Officer Jason Marles in
a fiery crash on Thanksgiving Day 2010.|
The jury on Friday held Erick P. Uzcategui, 36, of
Manchester solely responsible for the death of Marles, 32, of Point Pleasant Beach, a nine-year veteran of
the Ocean Gate police force. It awarded the $10.1 million to Marles estate, according to Scott Kenneally
and William V. Kelly, attorneys for the estate.
The money will be held in trust for Marles two children, who were ages 4 and 5 when their father was
killed, Kelly said. The children are now 9 and 11.
The jury found no responsibility on behalf of Bamboo Bar, a Seaside Heights tavern also named in the
civil suit filed on behalf of the Marles estate by Kenneally and Kelly of the Toms River law firm Starkey,
Kelly, Kenneally, Cunningham and Turnbach.
At the civil trial, Kelly and Kenneally failed to convince the jury that Uzcategui was served alcohol at
Bamboo while already visibly intoxicated before he
got into the crash that killed Marles.
The verdict was announced Friday after an eightday trial before Superior Court Judge Arnold B. Goldman.
We are gratified that the jury recognized the devastating loss suffered by the Marles family, although,

Bruce Springsteen and the E Street Bands The

River Tour 2016 came to Newark Sunday night not
as a trickle or a lazy roll.
It came, like good rock n roll should, crashing in
like a loud and raucous wave.
The band tore into songs from the 1980 album
The River with passion and abandon. The album is
being performed in its entirety on the tour.
The Rivers intent was to transform Springsteen and his crew from a marginalized community
of street people from Asbury Park to adults exploring the things that bond people to their lives,
Springsteen said from the stage of the sold-out show.
They did this with rock and the opening of the
show at the Prudential Center burst with energy to
an electric crowd. The Ties That Bind percolated,
Sherry Darling, was an instant party and Jackson
Cage had a sharp and ominous buzz.
Hungry Heart saw the Boss sing while walking
on a floor platform that circled the audience pit. He

Waves swelling 40 feet high. Winds

gusting at 50 miles per hour. An ocean
temperature of 32 degrees.
These were the conditions Long
Branch native William Ed Kiely
faced as he maneuvered a 26-foot
wooden lifeboat to rescue four men
from the sinking tanker SS Fort Mercer off the coast of Cape Cod in February of 1952.
If the story sounds familiar, thats because Disney just released a movie about another rescue in
the same storm. The Finest Hours, which hit big
screens across the country this past weekend, focuses on the saving of 32 sailors from the capsizing SS
Pendleton.
The twin rescues, which took place a few miles
apart, are considered to be the greatest in Coast
Guard history. They produced five recipients of the
hallowed Gold Lifesaving Medal, an honor bestowed
for just 101 rescues since 1877.
Four of those honorees are featured in The Finest Hours. The fifth, Kiely, is not depicted in the
film at all.
