RECOMMENDATION:
THAT Council approves Development Variance Permit Application No. DVP2016-02 and
give notice of their intention to consider the issuance of Development Variance Permit
No. DVP2016-02 for Lots 1-10 and Pcl A, Blk 26 (Full Block bound by First Street, Second
Street, Wright Street and Benson Street) to vary the following sections of Zoning Bylaw
No.1264:
Section 8.6.6 is varied to allow for an increase in the maximum height of buildings
from 10.5m or 2.5 storeys to 26.0m or 5.5 storeys; and
Section 8.4.2 (1) is varied to allow for reduction in the side yard setback adjacent
to First Street from 6.0m to 3.0m.

Background:
The subject development site consists of eleven vacant parcels encompassing a full block
bound by First Street, Second Street, Wright Street and Benson Street (see Figure 1). The
property has an OCP designation of T4O Neighbourhood Mixed Use (see Figure 2) and is
zoned Victoria Road Commercial District (C6)(see Figure 3). Fred Beruschi on behalf of
Revelstoke Land Development Ltd. has applied for a Development Variance Permit to allow for
the construction of a 5.5 storey hotel (see Figures 4-8).
The owner has applied to vary the following regulations of Zoning Bylaw No. 1264:
Section 8.6.6 The height of buildings shall not exceed 10.5m (34.5ft) or two and
one-half (2 1/2) storeys.
Section 8.4.2 (1) Motels, Motor Hotels and Hotels the front yard, side yard and
rear yard shall be not less than 6 meters (19.7 ft).

If the requested variances are approved by Council the applicant has indicated they will move
forward with completing the development drawing package. Once the development drawings
are complete the Development Permit Application would then be presented to Council for review
and consideration.
Options / discussion:
The applicant has proposed a multi-storey hotel development with parking below the building.
The siting would see the building construction on the portion of the property adjacent to First
Street with the remainder of the site being utilized for surface parking.
The proposed building height would have a limited impact on residential development on
Second Street as the proposed siting would see the building located in the north-east portion of
the site. The adjacent commercial properties to the north-west and the School site to the south
are not anticipated to be adversely impacted by the proposed development. The adjacent
commercial development on First Street would see additional afternoon shading on the northern
portion of the building.
The proposed reduced side yard setback adjacent to First Street is anticipated to have a limited
impact on the adjacent roadway. The area between the building and the existing curb would
include a portion of landscaping as well as a sidewalk.
As a condition of the Building Permit the applicant would be required to upgrade the adjacent
road frontages with the following:
First Street Sidewalk along frontage connecting to Wright Street, existing curb and gutter.
Benson Street Curb and gutter, local road with sidewalk identified for south side of the
roadway.
Second Street Curb, gutter and sidewalk.
Wright Street Let downs for access points.
Servicing will be as per the developers Civil Engineer for the project in relation to the project.
Services are available within adjacent roadways.
The subject properties include eleven parcels which would be required to be consolidated as
part of the Building Permit process. The certificates of title for the eleven parcels have been
attached for reference (see Figure 9).
Local Government Act, Section 499 requires that Council give notice that they will consider a
resolution to approve a Development Variance Permit (see Figure 10). If the application is
approved to proceed and notice is given that the variance will be considered, Staff will send
notification letters to owners and occupiers within 100m of the subject property. Staff will also
have documentation of the application available for inspection at City Hall.

If the subject Development Variance Permit Application is denied, the property owner would be
notified. They may wish to redesign their development in order to remain at the maximum two
and one-half storey (2.5) height.
Financial / Risk Implications:
No financial or risk implications are anticipated from the proposed recommendation.
Others Consulted:
The following City of Revelstoke Departments received referrals for the subject application:
Engineering, Operations, Building, Parks, Recreation & Culture, RCMP and Fire Rescue
Services. BC Hydro, Fortis, RCTV, Telus and Ministry of Transportation and Infrastructure also
received a referral. No comments or concerns on the subject application have been received.
