CITY MANAGER’S MESSAGE
Just five years ago, the economy was strong and growing. During this time, the City
made sure to share the prosperity with residents by increasing services, lowering
the overall millage rate, and providing homesteaded property owners with a cash
dividend – not once, but for two consecutive years. While the economy continued
to prosper, overall, we decreased the tax millage rate to the lowest rate in two
decades providing greater savings to homesteaded properties.
Unfortunately, the economy took a dramatic downturn and state
legislated restrictions on revenue caps have not made things easier.
However, the cost of doing business has continued to rise. Over
the last two budget cycles, we have identified efficiencies that
resulted in about $50 million in reductions and a loss of 245
positions over the last three years.
For the upcoming fiscal year, we already anticipate significant
shortfalls due to the drop in property values; increase in pension
costs; and other increases in operating costs. Fifty percent of the
homesteaded properties in 2009 tax roll were 30+ percent below
market value. Right now, we’re looking at about a $35 million Jorge M. Gonzalez

Show-off The Future of the Miami Beach

Look out San Diego and San Antonio. The Miami Beach Convention
Center (MBCC) is planning on a makeover and is poised to make
history again. Experts say the planned renovations will give it
its rightful place back on the list of the top five convention
business locations around the country, as it was when it first
opened in 1958.

The Miami Beach Convention Center is an undeniable part

of the fabric of South Florida. Owned by the City of Miami
Beach, the convention center was originally built for almost the
same reasons it is being revamped today. In the '50s, Miami
Beach's auditorium held exhibits and displays, but it could not
compete with other cities across the country that had built major
convention centers.

“It was with the input of Miami Beach's hospitality industry that the decision was
finally made to build and open a convention hall,” said Seth H. Bramson, FIU and Barry
University history professor and author of two books on Miami Beach.

“This valuable asset needs a new, dynamic look as well as additional space for exhibition,
meeting, parking and ballroom, in order to ensure the future and viability of conventions coming
to our city,” said Stuart Blumberg, retired president/CEO of the Greater Miami and the Beaches
Hotel Association and co-chair of the Convention Center Steering Committee.

When the 108,000 square foot facility opened in what many call its “glory days,” the building

To further guide the master planning process and ensure
that it involved all interested parties, City Manager Jorge
Gonzalez convened a Convention Center Master Plan
Steering Committee. It includes stakeholders representing
the City of Miami Beach, Miami-Dade County, the Greater
Miami Convention and Visitors Bureau, the Miami Beach
Visitor Convention Authority, the Greater Miami and
the Beaches Hotel Association, facility users, Global
Spectrum and industry experts. The committee and its
subcommittees have met a half dozen times to provide
input and ideas to Arquitectonica, which has put pen to
paper to develop the ideas into recommendations.
“The new building will become a state-of-the-art
convention center in the heart of most exciting city in
America,” said Bernardo Fort-Brescia of Architectonica,
about the master plan.
The current preliminary master plan might change as the
process moves along. For now, pleliminary plans call for
a future MBCC that would have a new façade with its
main entrance redirected to face south towards Lincoln
Road, lined with a re-opened 18 street running east-
west between Washington Avenue and Meridian. As
proposed, an expansion into the existing surface parking
lot and closing off Convention Center Drive would expand
the current facility by providing an additional 200,000
square feet of exhibit space (for a total of 700,000
square feet) and an additional 97,000 square feet of
meeting space.

junior ballroom will address concerns by meeting planners

De importancia innegable en el
tejido de South Florida, el Centro
de Convenciones, que es propiedad
de la Ciudad de Miami Beach, se
creó en un comienzo casi por las
mismas razones por las que hoy
se transforma. En la década de
los cincuenta, la ciudad contaba
únicamente con el Auditorio de
Miami Beach para realizar muestras
y exposiciones, y no podía competir
con otras ciudades del país que se
habían dotado de grandes centros
de convenciones.
"Fue gracias al impulso de la industria
hotelera de Miami Beach que se tomó
por fin la decisión de construir y abrir
al público una sala de congresos",
explica Seth H. Bramson, historiador
y profesor de historia en Barry
University y en FIU, y autor de dos
libros sobre Miami Beach.

Cuando abrió sus puertas en 1958
-lo que muchos conocen como
sus "años gloriosos"- el Centro de
Convenciones, con sus 108,000
pies cuadrados, atrajo a la ciudad
muchos de los principales congresos
y convenciones del país. Desde
entonces, ha acogido a destacados
políticos, empresarios, atletas
artistas, y ha sido escenario de
algunos de los más importantes
eventos de la historia mundial.
Algunos eventos históricos llegaron a
situar a la sala de congresos entre las
cuatro más destacadas. Entre éstos
se encuentran: la contienda en la que
Muhammad Ali derrotó a Sonny Liston
en su primer campeonato de pesos
pesados en 1964, la Convención
Nacional Republicana de 1968,

El Centro de Convenciones es operado
por Global Spectrum, administrador
de más de 80 establecimientos en
Estados Unidos, Canadá y otros
países.
Es el tercer motor económico más
importante del área, después del
aeropuerto y el puerto marítimo, y
acoge numerosos eventos públicos
de estreno nacional y de primer
orden en la industria de congresos.
En el último ejercicio fiscal (octubre
de 2008 a septiembre de 2009), el
Centro de Convenciones de Miami
Beach trajo más de $170 millones
a la economía local, acogió 184
eventos, tuvo un porcentaje de
ocupación de eventos del 61%

y atrajo a la ciudad a 698,840
participantes de eventos. Cada
participante gastó $244.72 diarios
en hotel, comidas y entretenimiento.
Desde 1969, el Centro ha
sido anfitrión de la Exposición

a cabo en el Centro de Convenciones
de Miami Beach son el Encuentro de la

Feria Internacional de Automóviles de
South Florida y la Exposición Art Basel
Miami Beach, mayor exhibición de
arte contemporáneo en Norteamérica
(y, para algunos, en el mundo).
 Actualmente, el Centro de Convenciones se extiende sobre cuadro cuadras
y tiene un total de 1.2 millones de pies cuadrados de espacio, que incluyen
500,000 pies cuadrados de área de exposiciones. Fue con su última
ampliación, en 1989, que el complejo alcanzó su tamaño actual.

En los últimos seis años, el Centro ha disfrutado también de una inversión de

más de $35 millones en mejoras continuas, incluida la remodelación completa
de todos los aseos, el reemplazo total de alfombrados y la instalación de una
infraestructura de red y telecomunicaciones de punta.

En 2004, la Ciudad y el Condado de Miami-Dade acordaron modificar por

segunda vez el Convenio Interlocal de 1996, lo que cambiaba la financiación
designada para el Centro de Convenciones de Miami Beach mediante el
Impuesto conocido como Convention Development Tax, y la reemplazaba
por una financiación con fondos de bonos de responsabilidad general del
Condado de Miami-Dade.

El 2 de noviembre de 2004, los electores del Condado de Miami-

Dade aprobaron el Programa Building Better Communities de
bonos de responsabilidad general, que incluía la ampliación y
mejora del Centro de Convenciones.

How Does Our Garden Grow?
“The greatest gift of the garden is the restoration
of the five senses.” –Hanna Rion
In the center of it all, steps from the Miami Beach
Convention Center, Holocaust Memorial and City
Hall sits a tranquil spot to take a break from the
hustle and bustle of City Center. The Miami Beach
Botanical Garden (MBBG) is a serene and green
place to appreciate our lush environment; a place
many have called our tropical urban oasis.
Established in 1962 as a clubhouse and garden
center for local garden clubs, it has maintained a
reputation as our little gem in need of polishing.
Over the years, this 4.5 acre tropical oasis held
on amidst adversity. But in 1997, a group of
dedicated nature lovers formed the Miami Beach
Garden Conservancy, and slowly but surely,
this little garden has grown into the vibrant and
tropical pulse of our city.
Today, the Garden is a favorite spot for gatherings
and cultural events year-round. It not only hosts
frequent events, but also plays an integral role in
Art Basel Miami Beach, Sleepless Night and the
Miami International Boat Show.
Soon, thanks in large part to the public/private
partnership between the City and the Garden
Conservancy, the Miami Beach Botanical Garden
will undergo a much-needed renovation to meet
its potential. The City Commission has approved
a master plan that enhances the existing treasures
and brings new amenities that will make each visit
something special.
The Master Plan includes new hardscape and water
features, a new perimeter wall made of oolite, and
upgrades to the existing buildings that will make
them more accommodating and functional for a

myriad of arts and educational programming.
The Master Plan also focuses on the surroundings.
The addition of buffering walls on the southern
and eastern (sides) will provide a separation from
the traffic and buses on the street. The inclusion
of the Collins Canal to the north incorporates an
already existing natural element into the garden
experience. Looking to the future, the master plan
also sets the stage for a new visitors center, more
shade structures and an overarching plan to make
the operations sustainable and green.
“Working with the City and with award-winning
landscape designer Raymond Jungles on this
project has resulted in a dream come true for those
who love and appreciate our Botanical Garden,”
said MBBG Director Laura Jamieson. “This design
takes into account the unique setting, accentuating
the beautiful positives and minimizing some of the
minor challenges to a visit.”
The overall design was split into four phases, mainly
due to funding constraints. The City Commission
has given the go-ahead for the first two phases. The
third phase primarily incorporates the design for
Collins Canal and lighting upgrades. This portion is
not currently funded, but remains part of the master
plan. The plan includes a fourth phase as well, and
this is for additional items that will be funded through
donations and Garden Conservancy fundraising
efforts. Construction on the first two phases will cost
$1.3 million and begins this summer.
“We are certainly looking forward to the rebirth of our
wonderful garden,” said Sandy Shapiro, a Garden
Conservancy Board member. “The vision for this
space will make the experience better. I can’t wait!”

Every visitor who comes to Miami Beach loves
to send back a photo demonstrating how
great the weather, no matter what time of
year they are here. Since the 1950s the date
and temperature monument at 10th Street and
Ocean Drive has been the perfect place to snap
a photo for gloating to friends and relatives in
colder climes.
When the successful restoration of the Beach
Patrol Headquarters and the 10 Street
Auditorium, came in under budget, the City
decided to use some of those funds to restore
the historic tower and update the technology
that delivers the temperature and date. The
stone tesserae covering on the façade will
be reproduced and installed, along with new
landscaping and lighting. Work is expected to
begin this summer.
The savings were also used to upgrade the
serpentine walkway that winds from 5 Street,
along the coral rock wall between Beach
Patrol and auditorium, and up to 14th Lane.
The work on this walkway began in November
and will be completed this spring. The Capital
Improvement Projects Office worked through
several major events that effected and were
affected by this construction. Through careful
coordination with the Office of Tourism and
Cultural Development, work was completed
with minimal interference to the Pro Bowl and
Super Bowl festivities, the Miami International
Boat Show and the South Beach Food and
Wine Festival.

reduciendo al mínimo algunos de los detalles

El diseño general se repartió en cuatro fases, en
particular debido a limitaciones de financiación.
La Comisión de la Ciudad ha dado luz verde a
las dos primeras fases. La tercera fase incluye
principalmente el diseño del Canal Collins y

HOW WELL DO YOU KNOW YOUR CODE?

Whether you just moved to Miami Beach last week or have lived here for
decades, you may not be aware of all the terms of the City’s code; nevertheless,
it is important to familiarize yourself with the specifications for which you are
held accountable.

FLYERS: Cannot be placed on public property, sidewalks, cars, etc.

NOISE: Encompasses music, sounds of exhausts, shouting, animals, 1

construction, and any sound that is unreasonably loud or excessive. A noise
ordinance violation can be issued anytime if the noise is unreasonably loud or
excessive. Between the hours of 11:00 p.m. and 7:00 a.m., the noise need
only be plainly audible from a distance of 100 feet to constitute a violation.

PROPERTY MAINTENANCE: Is the responsibility of the owners to maintain

their properties, which must be painted with appropriate colors, kept free
of debris and overgrown grass, have no broken or missing windows, and
remain free of graffiti.

PETS: Dogs must be kept on a leash at all times when out in public. Pet owners
must also remove and dispose of pet waste deposited on private or public
property. Violation of the “Pooper Scooper” law can result in fines from

nuestra ciudad muestre siempre su mejor perfil tanto a
los residentes como a los negocios y visitantes.
Si bien los oficiales de cumplimiento del código portan
uniformes similares a los de nuestros oficiales de
policía y vigilantes de estacionamiento, sus misiones
y responsabilidades son muy diferentes. Entre otros
muchos deberes, los oficiales de cumplimiento del
código responden a las llamadas que recibe la ciudad
con respecto a posibles infracciones del Código, y
constatan las infracciones.
Estos oficiales son supervisados por administradores
del código, que generalmente han trabajado por más
tiempo en el terreno y tienen más experiencia. "Los
administradores son como tutores que orientan a los
oficiales con menos antigüedad sobre la manera de
manejar las disputas y las diferentes llamadas" explica
Jose Alberto, Administrador en Jefe que supervisa al
equipo de administradores del código.
Durante el día, hay entre cinco y seis oficiales del
código trabajando en las tres áreas de Miami Beach
(North, Middle y South Beach).
Cada una de estas áreas es supervisada por un
administrador y dividida por zonas.
South Beach, corazón del animado distrito de
entretenimiento de la Ciudad pero también de zonas
residenciales multifamiliares, tiene una buena parte de
oficiales del código puesto que es el área con más
movimiento en términos de quejas por ruido, volantes
y carteles, así como con más problemas por perros sin
correa y amos que no recogen los excrementos de sus
mascotas.
Durante los turnos de la noche y el fin de semana, hay
de cuatro a siete oficiales del código asignados en
toda la ciudad.

preparado para lidiar con una extensa variedad de

¿QUÉ TAN BIEN CONOCE USTED EL CÓDIGO?
Bien sea que acabe de mudarse a Miami Beach hace una
semana o que haya vivido aquí durante décadas, puede que
no esté al tanto de todas las disposiciones del Código de
la Ciudad. Sin embargo, es importante que se familiarice

basta con que el sonido alcance a ser apenas audible a
una distancia de 100 pies para que haya infracción. Las
multas van desde $250 hasta $5,000 dependiendo del número
de infracciones.
Mantenimiento de propiedad: Es responsabilidad de los
propietarios mantener en buen estado sus propiedades.
Las propiedades se deben pintar con colores apropiados,
se deben mantener libres de desechos y de grafitis, deben
tener el césped bien cortado y no deben tener ventanas
faltantes.
Mascotas: Los perros se deben mantener sujetados con correa
siempre que estén fuera en público. Además, los dueños de
las mascotas deben recoger y desechar debidamente los
excrementos que éstas depositen en propiedades públicas
o privadas. Las infracciones a la norma sobre recogida de
excrementos pueden dar lugar a multas de $50 a $200.

"Con la situación de la economía, la gente deja de pagar su vivienda, se
muda y abandona la propiedad", explica. Se ha convertido en un deber
de cumplimiento del código llevar servicios a estas propiedades y darles
mantenimiento.
Cuando los agentes de cumplimiento del código identificaron el problema,
la Ciudad creó un mecanismo para trabajar con los bancos a fin de llevar
servicios a los sitios de construcción abandonados y las propiedades que
habían sido objeto de una ejecución de hipoteca, así como para contratar
proveedores y recuperar los fondos de los prestamistas.
Si bien los oficiales de cumplimiento del código están ocupados durante
el día con las cuestiones de mantenimiento de propiedad, saneamiento y
zonificación, su trabajo no termina cuando se pone el sol.
Según Kenneth Varela, administrador en las horas de la tarde, el turno de la
noche maneja situaciones que surgen al final del día, en particular quejas
por ruido en clubes, fiestas a domicilio y eventos especiales. Los ladridos de
los perros también generan un buen número de llamadas durante la noche.
Cuando un inspector del código observa una infracción menor, se deja una
notificación de cortesía a fin de exponer el problema y fijar un plazo para
que se tomen las medidas correctivas. Si el problema no se corrige dentro
del período asignado, se expide una notificación de infracción en la que se
otorga una extensión del plazo para que la propiedad cumpla antes de que
se haga obligatorio el pago de multas.
Laura Jimenez, residente de North Beach, ha estado en los dos lados de la
barrera en lo que se refiere al cumplimiento del código. "Para mí, son un
problema algunas aceras en las calles concurridas. Una vez, los arbustos de
un edificio de apartamentos estaban invadiendo la acera y bloqueando el
paso, de manera que puse una queja y el problema fue resuelto rápidamente",
cuenta.
En algunas ocasiones, Jimenez también ha cometido infracciones por la
pintura de su vivienda y por tener arbustos muy altos. "Si uno no puede
hacer los arreglos antes del fin de semana, la División de Cumplimiento del
Código está dispuesta a ayudar y a dar un plazo suplementario. Es un gusto
colaborar con ellos", añade.
Las situaciones pueden ser de hostilidad cuando un infractor indignado busca
la confrontación, pero los oficiales deben manejar cada incidente de manera
profesional. "Es un trabajo ingrato, pero nos sentimos orgullosos de lo que
hacemos", dice George Castell, administrador de South Beach.

Miami Beach takes pride in celebrating and embracing its diversity. The city's gay,
lesbian, bi-sexual and transgender (GLBT) community is not only still here, but is
also very much a part of the fabric of Miami Beach. And the City’s commitment to
preserving diversity is evident in our reputation as one of the most progressive cities
in the country in terms of our human rights legislation.
“The gay community is still very strong and that’s obvious by the policies implemented
over the past year,” said Thomas Baker, Miami Beach GLBT Committee vice chair.
For the last two decades, Miami Beach has enacted laws to protect the rights of all
who live, work and play in this playground. To date, it has passed over 30 pieces
of legislation addressing human rights. In 2001, Miami Beach set precedent as the
first municipality in the State of Florida and the nation to pass a domestic partnership
ordinance, granting certain rights and benefits such as health benefits, to domestic
partners of city government employees. The ordinance was expanded in 2004 to
grant the same benefits to all domestic partners residing or visiting Miami Beach.
The amended ordinance also added rights including hospital visitations, decision-
making rights on behalf of a partner as well as the education and welfare of a
partner’s dependent. It also added protection against discrimination in the city.
Most recently, the city updated its 1992 human rights ordinance, the first of its kind
in the state and the country, to include gender identity as a protected class when it
comes to housing and employment discrimination.
On April 17, the strength, beauty and contributions of South Florida’s and our city’s
GLBT community was celebrated once again at the second annual Miami Beach
Gary Pride Parade/Expo. Last year’s inaugural event, a product of the Mayor’s GLBT
Committee, brought out over 24,000 people to Ocean Drive.
Another big accomplishment: the new home of the Miami-Dade Gay and Lesbian
Chamber of Commerce. Just days before Miami Beach Pride, the chamber moved its
offices to the first floor of Historic City Hall on Washington Avenue.
They will be opening a GLBT visitor center there, too. “We now
have a place the GLBT community could call their own when
they’re visiting the area,” said Chamber President Steve
Adkins.
Another City focus is ensuring that hate crimes
involving sexual orientation are being properly
investigated. The City continues to work closely
with the GLBT community to help bring about
and continue a bond of understanding.

La comunidad gay, lesbiana, bisexual y transgénero (GLBT) no sólo
sigue estando presente en la ciudad, sino que es parte del tejido de
la misma. Y el compromiso de la ciudad para preservar su diversidad
se hace evidente en la reputación de Miami Beach como una de
las municipalidades más progresivas en el país en términos de su
legislación de derechos humanos.
Hasta la fecha, Miami Beach ha aprobado más de 30 leyes relativas
a los derechos humanos. En 2001, la ciudad sentó un precedente
como primer municipio del Estado de Florida y del país en aprobar
una ordenanza relativa a las parejas de hecho, otorgando ciertos
derechos y beneficios, por ejemplo de salud, a los compañeros de
vida de empleados del gobierno de la ciudad.

A Walk on the WILD Side They have promised to protect and preserve the plants, animals and history of Miami Beach
parks and to keep the air, water and land clean. This is the Miami Beach Junior Park
Ranger pledge.

On a warm and sunny January day, two groups of children from the Scott Rakow Youth
Center afterschool program and the North Shore Park Youth Center Nature Club participated
in an interactive nature program at North Shore Open Space Park. The Miami Beach Parks
and Recreation’s Greenspace Division naturally hosted this adventurous walk in the park.

“Not only are we re-connecting kids to the great outdoors, but we’re encouraging them to get
out and play,” said Director Kevin Smith, Miami Beach Parks and Recreation Department.
“It’s another way we are addressing the on-going problem with childhood obesity.”

The goal was to make learning fun while discovering native plants, animal habitats, insects,
and tracking techniques. Along the way, the children had to complete an interactive workbook
while taking their guided exploration of the park to qualify for their Junior Ranger status.

North Shore Open Space Park was selected because it is the only area of any size in Miami
Beach that is in a relatively natural condition. “It’s the only place where one can experience
a natural beachfront ecosystem composed of ocean, beach, dunes and coastal scrub forest,
along with plants and animals associated with each of these communities,” said Miami
Beach’s Urban Forester Dr. Christopher Latt, one of the tour guides.

After a brief lesson on first aid and safety and a review of their workbooks, the tour
began on one of the trails. They walked and discovered the woods, dunes and beach only
covering about a quarter of the northern section of 34.5 acre park by the end of the trip.

During the hike, the children put their new animal tracking skills together to complete a
scavenger hunt. By finding clues left behind by animals, like animal footprints, scratches
in the barks of trees, dens and “scat” or droppings, they were to determine what animals
were present.

“I saw seagulls and used my magnifying glass to view the animal footprints,” said Bianca

plants; berries growing out of the trees.”

The City’s tree experts also gave a lesson in dendrochronology, the scientific study of tree ring
dating. The groups learned how each tree ring signifies one year of life. The stems, branches
and the trunk get wider each year adding a new ring as a layer. By analyzing the patterns
in the rings, one can determine past climate conditions such as drought and past events such
as fires or insect infestations.

Various types of trees were pointed out and the children learned how to tell one from another.
Latt continued, “We also showed them the unique characteristics and growth pattern of the
native trees after the hurricanes knocked some over; the seagrapes in particular.”

The new junior park rangers gave the program a big “green” thumbs up. Mahitte Kaisaal
summed it up, “The trip was fun and educational at the same time."

early in morning at one of the city’s public pools to
begin his routine. Early cardiovascular exercise gives
you the energy you need to sustain you throughout
the day.
Dr. Valdesuso has been a swimmer for 40 years and
a member of Miami Beach’s advanced swimmers
program for the past four years. “As a certified M.D.
pulmonologist, I believe swimming is the most beneficial
sport for the body and cardiovascular system with the
least cost of injury.”
Regular swimming not only keeps your body in great
shape, but also keeps it healthy. Swimming works your
entire body while improving your cardiovascular system,
strengthening your muscles, improving your posture and
flexibility, all at the same time. Your cardiovascular
system benefits because swimming improves your body’s
use of oxygen without overworking your heart, eventually
making your heart and lungs more efficient. On average,
a swimmer can burn as many calories in an hour as a
runner who runs six miles in one hour.
Now that summer is almost here, take advantage of the
City’s services by indulging in one of our neighborhood
pools. Three aquatic centers are conveniently located
throughout Miami Beach: North Beach (Normandy Isles
Park), Middle Beach (Scott Rakow Youth Center) and South
and two of them also have interactive water playgrounds.
All swim programs are staffed with highly skilled
American Red Cross trained and certified lifeguards.
The Flamingo Park and Normandy Isle Pool staff are also
members of the United States Water Fitness Association,
Inc. and is also a National Training Center for Water
Fitness Instructors.
Monthly programs for advanced swimmers and adult
fitness classes are offered at the Scott Rakow Youth
Center Pool. There are also adult lap swim open
sessions at all of the city’s public pool centers. At
Flamingo, free water aerobics classes are available
for Miami Beach residents.
Competitive swimming helps build endurance and speed.
Scott Rakow Pool also offers swim team and water polo
programs for all ages. Various skill levels are available
depending on participant’s swimming abilities and are
determined by the coach.
Not knowing how to swim is not a problem. Learn to
swim classes are offered to people of all ages and skills.
“You don’t have to be the next Michael Phelps to take
advantage of the water for a fitness routine and leisure,”
said Assistant Parks and Recreation Director Julio
Magrisso. “Exercise should be fun and some say that
swimming doesn’t feel like ‘real’ exercising.”
All three city pools offer ADA handicap accessible pool lifts
for the mobility impaired. The aquatic facilities also offer
locker rooms with showers, lounge chairs and sunbrellas.

unchanged for millions years; however, they
face an uncertain future. Illegal harvesting,
habitat encroachment, marine debris, and
light pollution are some of the problems
threatening sea turtles.
Sea turtle hatchlings are born with the instinct
to head toward the brightest light on the beach
after hatching, which is usually the light of the
moon reflected off the ocean surf. In coastal
areas with artificial lighting, hatchlings may
become disoriented and travel in the wrong
direction away from the ocean, potentially
never making it to the water.

Sharing the Road
The first automobile crash in the United States
occurred in New York City in 1896, when a
motor vehicle collided with a bicycle rider. About
53,000 cyclists have died in traffic crashes in the
United States since 1932 – the first year in which
estimates of cyclists fatalities were recorded.
Today, there are many more motor vehicles on our
urban roads. And as cycling becomes popular,
not only to help reduce motor vehicle emissions but
to increase existing road and parking capacity, it
is more important than ever for everyone to learn
how to safely share the road.
In 2008, Florida led the country in cyclist fatalities
where 4.2 percent of all traffic fatalities involved
a cyclist death. Between 1996 and 2003, South
Beach led Miami-Dade County in bicycle-related
crashes with 446 accidents, which included two
fatalities and incapacitated 55.
“There are many aggressive drivers in our streets
right now that have no regard for bicyclists or
pedestrians,” said Frank Sake, chairperson of
Miami Beach’s Ad Hoc Bike Committee. “And as
we encourage the use of alternative transportation
such as biking, we are concerned for everyone’s
safety and need to educate the public.”
Miami Beach’s new bike share program will soon
add 900 new bicycles to our streets citywide. In
addition, the City’s Public Works Department is
actively adding bike lanes and markings to many
street improvement projects as a way to enhance
the city’s transportation system.
In Florida, a bicycle is classified as a vehicle;
therefore, a cyclist must follow both traffic rules

specially for cyclists. Both motorists and cyclists
need to follow traffic signs, signals and lane
markings. When cycling in the street, cyclists must
ride in the same direction as traffic.
Drivers of motor vehicles need to be courteous and
are required to allow at least three feet clearance
when passing a bicyclist on the road. They should
also look for cyclists before opening a car door
or pulling out from a parking space, and yield to
cyclists at intersections and as directed by signs
and signals. Be especially watchful for cyclists
when making turns.
Local cyclists were outraged late last year when
two bicycle accidents involving motorists hitting
cyclists occurred in the same week: one at 14
Street and West Avenue and the other at Purdy
Avenue and Venetian Causeway.
“Until drivers treat bicycles as fair vehicles on the

Beach is non-stop, it is also important that cyclists
wear fluorescent or brightly colored clothing during
the day, dawn, and dusk. To be noticed when
riding at night, use a front light and a red reflector
or flashing rear light, and use retro-reflective tape
or markings on equipment or clothing.
Whether you drive a vehicle or ride a bike, there
is no doubt that being responsible and having a
respect for the safety laws will make Miami Beach
a safer place.

Shared Lane Pilot Study

The study will evaluate the effectiveness of shared lane markings as a way to improve bicycle safety by directing bicyclists to ride
in the appropriate direction along the road and outside of the car door zone.  These new pavement markings also aim to make
motorists aware of the fact that they must share the road with bicyclists. Based on results, it will be determined if shared lane
markings are a solution that can be applied in other city locations.

Florida law requires motorists to yield to all traffic on the sidewalk.
However, turning motorists tend to look only where they expect to see
cars. If you are walking or riding against traffic on the sidewalk, a
motorist turning out of or into a driveway may not look in your direction.
Watch for right turning motorists coming from driveways and side streets.
Also, look out for left turning motorists coming from behind you. Before
walking or riding in front of a car, make eye contact with the driver and
be sure the driver is going to yield to you.

Working in a restaurant has
made me wonder why there
is no commercial recycling
program. Restaurants more
than likely create more trash and
waste than all the residents combined,
so why are they not recycling?
Miami-Dade County Code requires that every commercial
establishment provide a recycling program that includes a minimum
of three materials of its choice selected from the following list: High
grade office paper; mixed paper; corrugated cardboard; glass
(flint, emerald, amber); aluminum (cans, scrap); steel (cans, scrap);
other metals/scrap production materials; plastics (PETE, HDPE-
natural, HDPE-colored); textiles; and wood.
However, while the County Code requires commercial establishments
to provide recycling it does not specifically make it illegal to not
recycle. The current system requires that commercial establishments
have recycling available, but it does not require establishments to use
this service. The City encourages all commercial establishments to
contact their waste haulers to create a recycling program that reduces
waste while also suiting their businesses needs. For more information,

What is the status of Bay Walk?
The City's master plan for a continuous public
baywalk from 5 Street to Lincoln Road is being
actively pursued. Currently, public access is afforded
from South Pointe to 5th street, and on the baywalks
behind the Bentley Bay, Floridian, Waverly and
Capri properties, as well as the western terminus
of 14 Street. Pursuant to a settlement agreement
with the owners of the Flamingo property, full public
access to the baywalk at Flamingo is being planned
on that property for late 2011.
The City also has plans for constructing a new
western terminus at 10 Street, which will include a
public baywalk. The Mondrian has proposed and
is pursuing approvals for a publicly accessible
baywalk behind the entire Mirador and Mondrian
properties, which would also connect directly to
the 10 Street baywalk. The City is continuing to
explore options for other properties along the bay
north from 5 Street to Lincoln Road that do not
have public access to their baywalks.
