LEGL 101 Introduction to Business Law

Group Assessment 2
Due date: Wednesday 25 May 2016 (Week 12)
Submission: via Turnitin. Make sure that the names and student numbers of all
group members are clearly listed on a title page.
INSTRUCTIONS PLEASE READ CAREFULLY
Form a group of 2, 3 or 4 persons. Groups can comprise of students from any of
the Strathfield tutorials. Groups should be self-managed and the work should be
equally apportioned. You will be awarded a group mark (there are no individual
components to this task).
If you have a problem with student participation, please advise me earlier

TASK ANSWER ONE OF THE FOLLOWING 2 QUESTIONS

Question 1
Mary received a $500 Venus Devine Beauty Salon gift voucher as an
engagement present. She decides to use this voucher to pay for the
wedding makeup session for herself and her 4 bridesmaids. She books
a beautician, Lisette from Venus Devine Beauty Salon using her
voucher and she receives a message that it has been redeemed.
Lisette is to come to her home at 6am on the day of the wedding as
the wedding starts at 11 am. However, by 6:30 am on the wedding
day, Lisette has not turned up and Mary can't contact her or the
Venus Devine Beauty Salon. In desperation she contacts an online
beauty service who are willing to come at short notice but will charge
$1500 as they say 2 beauticians will be needed due to the short

notice. As a result of the no-show, Mary suffers terrible stress on her


nerves and feels that her wedding was duly affected. After the
wedding, Mary demands a replacement $500 gift voucher plus $1000
in cash from the Venus Devine Beauty Salon to recompense her
outlay. Venus Devine Beauty Salon claims that a mistake was made
with the date of booking, and that they can no longer honour their
voucher with Mary (they point out that their website says that
vouchers are strictly non-refundable).
Question: What legal cause/s of action might Mary bring against the
Venus Devine Beauty Salon? In your response consider the remedies
that may be available to Mary.

Question 2
Jackson stopped his car at the barrier entrance to the Metrolife Car
Parks and an automatic ticket machine pushed out a ticket. There was
a large notice attached to the barrier which read:
HALT ! Parking at Owners Risk. Take Ticket from Machine. Pay when
Leaving.
Jackson put the ticket in his pocket without looking at it and the
barrier went up automatically. Jackson drove into the car park and
parked his car. When he returned to his car to go home, he found his
car had been damaged beneath a large steel pipe which had fallen
from a crane owned by the parking station proprietors.

The parking ticket had the following notice printed on it:


CONDITIONS OF PARKING:
It is a condition of the issue of this ticket that vehicles are parked on
these premises at the owners risk and responsibility. The proprietors
of this car park accept no responsibility for loss or damage to vehicles
in the parking area whether caused by negligence or in any manner
whatsoever.
Question: Can Jackson sue Metrolife Car Parks for the damage
inflicted to his car? In your response focus on:
What legal causes of action might Jackson be able to bring
against Metrolife Car Parks?
What are the implications of the terms of their agreement?
