Description
GENERAL
The Preliminary items included hereunder apply to the whole of
the works contained in this document and the Contractor must
allow for complying with same and for any cost incurred in
connection therewith. The rates inserted by the Contractor for
preliminary items shall be deemed to apply to the whole of the
works carried out including all variations to this contract.
DESCRIPTION OF WORKS
The extent of works included in this Contract shall be as
described in the Contract Documents or reasonably inferred
therefrom.
The Contractor shall carefully study the Contract Documents,
and satisfy himself as to the full extent, character and nature of
the Works to be performed under this Contract. The Employer
shall not entertain any claim arising from the Contractor's failure
to study these Documents.
PRELIMINARIES
The Contractor is invited to insert rates and prices against the
items to cover the risk, work, etc., involved. Any item not priced
will be deemed to be included in the rates generally.

Notes
(1) The works in this section shall be priced on a "lump sum"
basis and shall be inclusive of all ancillary and other
works and expenditure, whether separately or specifically
mentioned or described in the drawings and documents
or not, but which are either indispensably necessary to
carry out and to bring to completion the works described
or which may contingently become necessary to
overcome difficulties before completion and shall also
comply regulations and bye-laws. No claim resulting from
failure to do so will be entertained.

The following items are not fully descriptive in themselves


and are not meant to limit the scope of works. The
Contractor shall fully determine for himself the full scope
of each item and price the same accordingly. No claim
will be entertained from the Contractor concerning the
lack of knowledge on his part in pricing of these items.

The items are to be read in conjunction with the


Specification of Materials and Workmanship, Drawings
and General Conditions and Preliminaries and shall be
construed as being complementary to one another.

(4)

Should any discrepancy of divergence occur in or


between any of the Contract Documents as to the precise
extent or nature if the works to be carried out by the
Contractor, the Contractor shall immediately give notice in
writing of the same to the SO so that clarification can be
sorted out prior to the award of the Contract. Otherwise,
the Contract Sum shall be deemed to complete to the
extent of nature as interpreted by the SO and no claim for
extra payment will be entertained.

1.

CONDITIONS OF CONTRACT
The conditions of contract to be used for the Works shall be the Public Sector
Standard Conditions of Contract (PSSCOC for Design & Build), available from BCA.
A Supplementary Specification or List of Editorial Amendments may also be issued
which will contain additional clauses applicable to the particular contract, which shall
supersede clauses contained in this Specification where applicable. Both these
Specifications are to be read in conjunction with each other, Contract Drawings and
the Conditions of Contract.

2.

DEFINITIONS
In this Specification the following words and expressions shall have the meanings
herein assigned to them except where the context otherwise requires:-

"Employer and
Contractor"

are as defined in the Articles of Agreement.

"FAS"

means the Football Association of Singapore.

"Superintending Officer"
person or "S.O."

means the General Secretary, FAS or such other


or persons as may be appointed by FAS from time
to time to be in charge of the works.

"as shown"

means as shown on the drawings.

"as required"

means as required in this Specification or as required


to carry out the works in accordance with the Drawings
and Specification.

"approved"

means approved by the Superintending Officer

"as directed"

means as directed by the Superintending Officer

"Specification"

means this

"Works"

means all or any portion of the works, material and


articles which are to be used in the execution of this
Contract whether or not the same are being
manufactured or prepared on the site.

DRAWINGS AND SPECIFICATION


The work shall be carried out in strict accordance with the Specification and
Drawings and such further detail drawings instructions and directions as may from
time to time be issued by the Superintending Officer.

OWNERSHIP OF DRAWINGS
All drawings and specifications are to be considered by all parties concerned as the
sole property of FAS and are to be returned to the Superintending Officer upon
completion of the Contract.

CONTRACTOR TO PROVIDE AND DO EVERYTHING


The Contractor shall provide and do everything for the proper execution of the Works
according to the true intent and meaning of the drawings and specification taken
together whether certain items may or may not have been particularly shown or
described provided that these items may reasonably be inferred therefrom.

SUFFICIENCY OF TENDER
The Contractor shall ascertain for himself the nature and extent of the works
comprised in this contract. He shall be deemed to have satisfied himself before
submitting his tender as to the correctness and sufficiency of his Tender for the
Works. His tender price shall cover all his obligations under the contract and all
matters and things necessary for the proper execution completion and maintenance
of the works. No claims arising from the Contractor's default in ascertaining for
himself all information in regard to his obligations under the contract will be
entertained.

DISCREPANCIES
If the Contractor finds any discrepancy in drawings or between the drawings and the
Specification, Schedule or Rates or any other documents pertaining to this contract,
he shall immediately refer the same to the Superintending Officer who shall decide
which shall be followed and whose decision shall be final and binding.

FIGURED AND SPECIFIED DIMENSIONS


In cases of discrepancy between figured dimensions and scaled dimensions the
Contractor shall request the Superintending Officer for his decision which will be
binding.

PROVISIONAL AND PRIME COST SUMS


Where "Prime Cost" (P.C.) or provisional sums of money are provided for any goods
or work in the Contract, the same are exclusive of any trade discounts, rebates or
allowances, discounts for cash, Contractor's profit, carriage and fixing.
All goods or work for which P.C. or provisional sums of money are provided may be
selected or ordered from any sources at the discretion of the Superintending Officer
and FAS reserves the right of paying for any such goods or work and of deducting
the said prices or sums from the amount of the Contract. Should any goods or work
for which P.C. or provisional sums are provided or portion of the same not be
required, such sums together with the profits allowed thereon and such additional
amounts as the contractor may have allowed for carriage and fixing will be deducted
in full from the amount of the Contract. Whether the goods be ordered by the
Contractor or otherwise, the Contractor shall fix the same if called upon to do so and
the Contractor shall also receive and sign for such goods and be responsible for their
safe custody on and from the date of their delivery upon the Works.

SETTING OUT OF WORKS


Refer to Clause 8 of the Conditions of Contract.
The Contractor shall employ a registered surveyor to set out the Works. Provide,
maintain, protect and reinstate reference pegs and marks as required by the SO for
the duration of the Contract.
At completion of the Contract, execute a confirmatory survey of the setting out of the
Works and provide one (1) CD in AutoCAD and PDF format and three (3) A1 paper
prints plans to FAS.

SUB-LETTING
Refer to Clause 30 of the Conditions of Contract.
The Contractor shall not assign this Contract or any part thereof or without the written
approval of the Superintending Officer sub-contract any portion of this Contract; if he
does so, he and the unauthorised assignee or sub-contractor, will be liable to be
debarred from tendering for future FAS works.

INSURANCES & PERFORMANCE BONDS


All insurance policies as required by the Conditions of Contract must be taken up
with an approved insurance company in joint names with the Employer. All
guarantees shall be stamped and the Contractor shall bear all fees and duties
payable in regard thereto.
All insurance policies covered under Clause 25, 26, 27, 28 and 29 of the Conditions
of Contract shall be in the form of Contractors ll Risk Policy and Workmens
Compensation Policy.
Performance guarantee shall be in the form of Bankers guarantee or Insurance
Performance Bond (subject to the Employers approval) as per specimen and no
amendment will be permitted.

GOVERNING LAW OF CONTRACT


Refer to Clause 36 of the Conditions of Contract.

NOTICES AND FEES TO AUTHORITIES


The Contractor shall give notice in accordance with the regulations of the Authorities
and obtain all necessary permits in connection with this contract at his own expense.
The Employer shall only be responsible for the payment of all fees in connection with
the permanent works and such fees will be paid on receipt of official bills issued by
the Authorities (i.e. BCA etc). Fees for connection of temporary works shall be borne
by the Contractor.

FACILITIES TO OTHER PARTIES


The Contractor shall afford facilities to any other parties, sub-contractor, Public
Utilities Board Departments, etc., employed upon the project so that their works may
proceed during the progress of the project and unless otherwise specified is to
provide for such parties sufficient and if necessary special scaffolding.

BYE-LAWS, REGULATIONS, NOTICES AND FEES


The Contractor is to comply with any Act, Bye-Law or Regulation of Local Authorities
and public service companies or authority, relating to the Works and is to give all
notices and pay all fees and charges demandable by law thereunder, and indemnify
the Employer against same. He should also allow for payment of supervisory or other
charges levied by the Public Utilities Board or other authorities in connection with this
Contract.

PROTECTION OF ADJOINING STRUCTURES


The Contractor shall carefully carry out the works and provide and maintain all
necessary and sufficient temporary measures against staining or damage to
adjoining buildings. The Contractor shall design, provide and erect all necessary
temporary shores and props etc., to existing buildings including such works which the
Superintending Officer may consider necessary for the safe and continuous
operation of building works on the site and the safety of any adjoining property in
accordance with good building practice. On completion, the Contractor shall take
down all shores and props and remove from site.
The Contractor shall indemnify the Employer/FAS against any claim or injunction
arising from interference to the adjoining structures.
The Contractor shall be solely responsible for the sufficiency of all temporary works
and shall give the Superintending Officer seven clear days' written notice before
executing any work to or affecting adjoining properties.

CUSTODY OF MATERIALS
The Contractor will be held responsible for the safe custody of materials delivered to
site by specialists or nominated suppliers or sub-contractors.

PLANTS AND EQUIPMENT


The Contractor shall provide all necessary hoists, ladders, scaffolding, staging,
tackle, tarpaulins, tools and other plant (mechanical or otherwise) for the work and
allow for all labour and materials in installing, operating, moving, adapting and
maintaining same as necessary. Provide all necessary transport to and from the site
for labour, materials, plants, etc., for the proper execution and completion of the
work. The Contractor shall not bring on to the site any materials or plant not required
under the Contract. All plant are to be removed on completion on the Contract.

TREASURE TROVE
Any treasure trove, coins or objects of antiquity which may be found on the site shall

be handed over to FAS. Any sand or gravel etc. which may be found on the site shall
be property of the Employer.

TEMPORARY HOARDING, ETC


The Contractor is to provide and maintain all necessary temporary fencing, hoarding,
gates, fans, planked footways, guard rails, gantries, safety netting, warning lights and
notices for the proper execution of the Works, the security of the Site, the protection
of the public and occupants of any adjoining buildings and for meeting the
requirements of any Government or Public Authority. Alter, shift and adapt from time
to time as necessary and clear away on completion.
Note that the existing Site is enclosed by chain-link fence which is going to be
replaced by the Infrastructure Contractor. In the event that the Infrastructure
Contractor decides to remove the existing chain-link fence before the completion of
your Works, your site will be vulnerable to trespasses and pose a danger to the
general public. In that case you will need to provide a temporary hoarding to enclose
your Works. The associated costs should be placed under Options.

BCA PROJECT BOARD


Provide and erect a BCA-standard project board completed with title of the project,
the names of Employer and Contractor, etc to the approval of the Superintending
Officer. The project board shall be removed on completion of the Contractor or when
directed by the Superintending Officer.

MATERIALS
All materials and workmanship to be provided by the Contractor shall be the best of
their respective kinds. The Contractor will be held responsible for the proper carrying
out of the whole of the work. The work shall be done in the best and most workmanlike manner and the Contractor shall furnish the Superintending Officer or his
representative with vouchers to prove that materials are such as specified.
Samples of all materials must be submitted to the Superintending Officer or his
representative for approval before any order is placed with suppliers.

TRADE NAMES
Where trade names or makers' catalogue numbers are mentioned in the
Specifications or Drawings the reference is intended only as a guide to the type of
article quoted or material required. The Contractor may use any article or material
similar and equal to those described by reference to trade names or catalogue
numbers subject to the approval of the Superintending Officer. If the alternative
material offered by the Contractor is accepted by the Superintending Officer, it will be
treated as a variation to the Contract if the cost of the alternative material offered is
cheaper than the Specified Brand.

LOCAL PRODUCTS
Wherever any materials, required for these Works is manufactured in the Republic of

Singapore, preference will be given to the use of that material in lieu of an equivalent
imported material provided that in the opinion of the Superintending Officer's the
material is considered satisfactory with regard to quality, etc. In any case of doubt,
during the preparation of the tender, the Contractor should refer to the
Superintending Officer to enquire whether such locally manufactured materials are
acceptable and would be permitted for use in the works.

PSB QUALITY CERTIFICATION


Where two or more similar type of materials/articles are available in the market, the
FAS will only permit the use of those materials/articles that carry PSB's / existing
governing bodys quality certification.

TESTING OF MATERIALS
Refer to Clause 10 of the Conditions of Contract.
The Contractor shall carry out all tests required by the Contract Documents and shall
pay all charges in connection with tests ordered by the Superintending Officer to be
carried out by others.

SAMPLES
Samples of materials and workmanship shall be submitted for approval by the
Superintending Officer and those samples may be kept by the Superintending Officer
who shall have power to reject all such materials and condemn such workmanship as
do not correspond with the approved samples.

APPROVAL OF SAMPLES
The Contractor is to take note that all work must be certified out in accordance with
the true intent of the Drawings and Specifications pertaining to this Contract. He must
understand that when a sample is approved by the Superintending Officer it does not
necessarily mean that there is not variation to the Contract if he carried out
subsequent work in accordance with the sample approved. The approved sample
may in fact be different from the Drawings and Specifications and this difference will
be taken care of by way of variation either in addition or in deduction as the case may
be.
It is the Contractor's sole responsibility to notify the Superintending Officer of any
item in an approved sample unit which does not fully comply with the Drawings and
Specifications. In the event of any discovery that the work as approved is in fact not
in accordance with the Drawings and Specification and that the Contractor has every
intention to hide such difference from the Superintending Officer, the Clause
regarding "Irregularities Committed" will apply and the Contractor will be charged the
relevant penalty accordingly.

OVERPAYMENT
If at any time during the period of this Contract, the Contractor is found to have over
claimed for the work executed, the FAS reserves the right to claim from the

Contractor a sum equal to five times such overpayments.

OVERTIME AND PUBLIC HOLIDAYS


No work shall be executed outside normal working hours without the prior consent of
the Superintending Officer. The Superintending Officer reserves the right to order the
opening up, taking down or demolition of any part or the whole of the work which has
been executed outside normal working hour without his prior consent and the
Contractor is responsible for complying with such order and all making good/reerection at his own expenses. Should the working of overtime be necessary in order
to complete the Contract by the date given, no extra will be allowed for same.
Should the Contractor deem it necessary to work beyond normal working hours to
complete the Contract within the given time, he must allow in his lump sum contract
for such overtimes.

LABOUR LAWS
The Contractor must pay his labourers and keep their working hours and observe
their holidays according to laws and regulations. He shall keep records and produce
them for the Superintending Officer's inspection.

EMPLOYMENT OF ILLEGAL IMMIGRANTS


The Contractor shall ensure that no illegal immigrants are employed by him or any
sub-contractor in the execution of any part of the works. If any illegal immigrant is
found to be so employed the Employer shall, notwithstanding the provision of this
Contract be entitled to withhold any payment due to the Contractor for a period of two
months and the Employer shall not be liable or any loss of damage suffered by the
Contractor as a result of any payment being so withheld.
For the purpose of this Clause, "illegal immigrant" means any person who has
entered into the Republic of Singapore in contravention for the provisions of Section
6 of the Immigration Act Chapter 81 or any statutory modification of re-enactment
thereof.

FOREMAN
The Contractor shall keep at the works during all working hours a competent general
foreman who shall be employed to receive and act upon instructions given by the
Superintendent Officer and any such instructions given to the foreman shall be
deemed to have been given to the Contractor.

35

KEEPING RECORDS OF WORKMEN


The Contractor shall comply with the Employment of Foreign Manpower Act (Cap
91A) regarding the engagement of workmen who are non citizens. This class of
workmen must obtain works permits from the Ministry of Manpower. The Contractor
is solely responsible for any action against the FAS or the Employer for the
employment of foreign workmen without works permits.

In addition, the Contractor shall keep proper records of all workmen engaged for this
Contract. These records must include information regarding the following:(a)

Name according to legal identification document;


Nationality;
Passport number;
Sex and age;
Work Permit No., if any;
Expiry date of work permit and/or permit and/or pass; and
Job designation.

This information must be recorded before any workmen are allowed to commence
duty. Severe action will be taken by the FAS if the Contractor fails to comply with this
instruction and fails to record the name of any worker found at the site.

MISCONDUCT OF WORKMEN
The Contractor shall on the request of the Superintendent Officer immediately
dismiss from the works any workmen, overseer, or foreman employed thereon by him
who may in the opinion of the Superintendent Officer be incompetent or mis-conducts
himself and such person shall not be employed again on the works without
permission from the Superintending Officer.

NUISANCE
The Contractor shall be responsible for restricting his workmen only to the site where
the works are to be executed and shall prevent trespass into adjoining property and
existing building (if any) on site in which work is not in progress and shall take all
necessary precautions to prevent and shall indemnify the Employer against any
damage arising from nuisance of any kind.

WORKPLACE SAFETY AND SAFETY MEASURES


The Contractor shall provide the necessary safety measures during the course of the
Works and shall comply with all safety requirements relating to construction works as
may be imposed upon him by any statutes now or hereafter in force and any orders,
rules, bye-laws, regulations, requirements and notices thereunder and in particular,
the Workplace Safety And Health Act (Cap 354A), the Factories Act (Cap 104) and
the Factories (Building Operations and Works of Engineering Construction)
Regulations (Cap 104, Reg. 8).
No contractor shall suffer or permit an employee to work under conditions which are
not in compliance with the relevant Acts or Regulations.
Requirements of the relevant Acts and Regulations are to be strictly observed
especially those such as the provision of suitable overhead protection, protective
apparel, helmets, safety belts, life lines etc.
During the Contract Period, the Contractor shall provide and maintain all safety
precautions and first-aid equipment for site personnel and such visitors who may be
on site from time to time, all in accordance with statutory regulations.

WARNING SIGNS, LIGHTS AND BARRICADES


The Contractor shall display warning signs, 900 x 600 mm at strategic points around
the periphery of the site where trespassing is likely to occur. Signs shall have the
words "DANGER -KEEP OUT" in the four official languages painted in red or a white
background in gloss finishing paint.
Warning lights shall be placed at similar positions at night to serve as a warning.
Where the work is carried out near public roads, all signage shall comply with the
recommendations of the Temporary Road Signage Manual issued by LTA.
The Contractor shall put up appropriate and adequate guards, fences or barriers
around excavations or other similar potential places of danger to prevent accidents.
The above provisions must be made to the satisfaction of the Superintending Officer.

STORES, SHEDS, ETC


The Contractor shall provide temporary lock-up stores, sheds and workshops in
which to keep steel, cement and any other materials in respect of this Contract so
that they may be properly protected from the weather.
The cement shed shall have enclosed sides, raised floor and suitable covering for
roof. For any other temporary sheds necessarily the Contractor must have the
approval of the Superintending Officer or his representative and he must allow for all
permit fees, land rents, etc. No materials other than those required for this Contract
shall be brought to the site and stored in the stores.

WATER FOR THE WORKS


The Contractor shall provide and be responsible for arranging the supply of all
necessary water for the Works and shall do all temporary plumbing and storage;
alterations, adaptations and maintenance as necessary and pay all charges in
connection therewith.
Only Public Utilities Board water and no other water shall be used for the execution
of the Works.

TEMPORARY LIGHTING AND POWER FOR THE WORKS


The Contractor shall provide all necessary temporary lighting and electrical power
including temporary wiring and meters required for the Works. The Contractor shall
alter, adapt and maintain as necessary and pay all charges and clear away all on
completion.
The Contractor is required to employ a licensed Electrical Contractor to install and
maintain such temporary lighting and electrical power on the Site, and to ensure that
they are in accordance with Singapore Standard CP - "Code of Practice of Wiring of
Electrical Equipment of Buildings" and Singapore Standard CP 88 Part 1 Code of
Practice of Temporary Electrical installations for Construction and Building Sites.
All power supply of 60A and less shall incorporate a Residue Circuit Breaker (R.C.B)

with direct tripping sensitivity of 30mA and tripping time within 0.1 second.

TEMPORARY LIGHNING PROTECTION SYSTEM


Provide an efficient temporary lightning protection system for the structure during
construction and for all the hoists and cranes. The lightning protection system is to
be of the type which conveys any lightning discharge safely to the ground without
danger to the building, machinery or occupants and to the requirements of the
Superintending officer.

TEMPORARY ROAD AND TEMPORARY WORKS


Provide, maintain and alter as necessary all temporary roads, tracks, paths, hardstandings, pavement crossings, culverts and other temporary works and the like
including those required by sub-contractors and suppliers. Reinstate all works
disturbed.
The Contractor shall comply with all relevant Authorities requirements and
regulations pertaining to temporary works.
Pay all fees and charges levied in connection with all temporary works, temporary
buildings and facilities.

DAMAGE TO EXISTING ROADS, FOOTPATHS AND CULVERTS, ETC


The Contractor shall arrange for the conveyance of materials, plant, etc, so as to
cause no damage to existing roads, footpaths, drains and culverts. The Contractor
shall take responsibility for any damage caused by vehicles or workmen to any
existing road, culverts, etc., from whatsoever caused arising and maintain, repair and
reinstate same to their original condition to the satisfaction of the Superintending
Officer or alternatively bear the cost of such maintenance and repair as a deduction
from the money due or to become due to the Contractor under this Contract.

DAMAGE TO EXISTING TREES


All trees or shrubs on the site, except as otherwise instructed shall be carefully
preserved and protected during the execution of the works. The Contractor shall
replace any tree, shrub, etc. injured, damaged or cut-down during the execution of
the Works and shall also be liable for any fines, etc. that the relevant Authority may
impose. If the Contractor fails to replace such trees, shrubs etc., within the period
instructed by the Superintending Officer, the FAS will engage others to replace the
said trees, shrubs etc and the cost plus administrative charges will be charged to the
Contractor's account and will be deducted from the payments due to the Contractor.

VISIT TO SITE OF BUILDING AND WORKS


The Contractor shall be deemed to have visited the site and acquainted and satisfied
himself of the nature of the site and ground and materials to be excavated, local
facilities of access and all matters affecting the execution of the Works. He should
provide for everything necessary including any subsidiary excavation of filling that is
required to bring up formation of levels, paths, building, etc. to conform to levels

shown on the drawings. No extra charges consequent upon misunderstanding will be
allowed.

PUMPING AND DRAINAGE


The Contractor shall engage a Qualified Erosion Control Professional (QECP) to
design and provide at Contractors own expenses, sufficient drainage and/or
pumping systems to the S.O.'s approval to remove all storm and percolating water
that may accumulate on the site or in trenches and excavations from time to time
during the progress of the Work.
The Contractor shall ensure that no nuisance is caused by the outfall of pumped
water and obtain the permission of the relevant authority before connecting
temporary drainage to existing drains or sewers.
Wash Bay
The Contractor shall also construct a temporary wash bay for his construction
vehicles and provide labour to operate the wash bay accordingly. He shall also be
responsible to demolish it, backfill and do the necessary Works on the surface as per
approved design.

VENTOR CONTROL
The Contractor is required engage a certified Environmental Control Officer to plan
and implement a comprehensive and effective vector control for the Site which shall
include all necessary measures to prevent the Site from becoming favourable to the
breeding or harbouring of mosquitoes or other vectors.
Vector control works shall comprise:
(a) Checking for mosquito breeding at least once a week.
(b) Larviciding all stagnant water using insecticides or anti-mosquito oil at least once
a week.
(c) Thermal fogging at least once a fortnight.
Thermal fogging to sit offices and workmens accommodation shall be carried out
fortnightly and if the Site is located within a malaria-sensitive area, residual spraying
of the walls at monthly intervals shall also be required.

ENVIRONMENTAL POLLUTION CONTROL ACT (CAP 94A)


The Contractor shall allow adequately in his tender to comply with all regulations, and
requirements in accordance with the Environmental Pollution Control Act (cap 94A)
or any statutory modifications or re-enactment thereof and any rules, regulations and
orders made thereunder. The Contractor shall be solely responsible for any penalties
which may be imposed by the relevant authorities should he fail to comply with the
Act.
All mechanical plant and equipment, which in the opinion of the Superintending
Officer, emit too much smoke shall be remedied or be asked to remove off site.
The Contractor shall ensure that noise generated at the Site will not exceed the

levels stipulated under the Environmental Pollution Control Act (cap 94A).

MAINTAIN OR DIVERT EXISTING SERVICES


The Contractor shall notify the Superintending Officer of any mains, pipes or conduits
met with during excavation and where any excavation is carried out adjacent to or
under any existing cable, pipe, structure or any other such work that may be affected
by subsidence, the Contractor shall prevent damage by subsidence as the
Superintending Officer may direct, whether such works is shown on the Drawings or
not. If it becomes essential in the opinion of the Superintending Officer to
permanently support the work, the Contractor shall build in supports of Class 'D'
concrete to take such steps as the Superintending Officer may direct but he shall be
paid for this additional work unless in the opinion of the Superintending Officer such
additional works has been necessitated by the Contractor's negligence, lack of
foresight or faulty workmanship.
In the event that damages have been done to the public services due to the
Contractor's work or otherwise, all expenditure as a result of accident or otherwise for
such necessary repairs etc. incurred by the relevant public authorities shall be borne
by the Contractor either by deducting from the Contract Sum or direct payment by the
Contractor to the Authorities.
If in the opinion of the Superintending Officer it is necessary to permanently divert
any cable, pipe, or other service, the diversion will be paid for by the Employer.

SCAFFOLDING
The Contractor shall erect and maintain all necessary scaffolding, shoring etc.
required for the proper execution of the Works. The scaffolding, shoring, etc. shall be
erected in accordance with relevant Acts and Bye-Laws and to the satisfaction of the
Inspector of Factories.
Maintenance of scaffolding, shoring etc. shall be held to include checking the stability
of scaffolding, shoring etc. weekly or at the direction of the Inspector of Factories.

SITE MEETING
The Contractor shall attend periodic site meetings arranged by the Superintending
Officer and shall ensure attendance by the sub-contractor as required. The
Contractor shall make available for attendance at meeting at responsible
representative conversant with the Works and with authority to accept and make
decisions.
The Contractor shall submit to the Superintending Officer before each meeting an
agenda listing site problems, variations instructed by the Superintending Officer;
progress of works and any other matters for discussion during the meeting.
A technical meeting shall be held at least once a week to highlight outstanding
issues. These meetings shall be duly attended by the Project Manager and if
required, supported by his Technical Team.
Such meetings shall also be used as coordination meeting between the Turf
Contractor and the Infrastructure Contractor to resolve any issues arising from the

works from either party. In the meeting, each Contractor is to prepare a 2-weeks
look-ahead programme so that both Contractors can coordinate their work more
effectively.

WEEKLY / MONTHLY REPORTS


The Contractor shall prepare and submit to the Superintending Officer weekly report
(in soft copy) including the following write-up:

The Contractor shall prepare and submit to the Superintending Officer monthly report
(1 set in hard copy) including the following write-up:

Outstanding issues to highlight.

In all cases where a representative of the Employer is employed upon the works, the
daily report shall be submitted for checking and signing by the Employers
representative.

PROGRESS PHOTOGRAPHS
The Contractor is to provide colour photographs to show the stages of Works to the
Superintending Officer. Photographs shall be taken at four-week intervals throughout
the construction period. Each photograph is to be dated and marked with the
description of the photograph and location from which it was taken and printed on A4
paper.

CONSTRUCTION PROGRAMME
Refer to Clause 9 of the Conditions of Contract.
The Contractor is required to submit as part of his tender a linked bar chart of his
proposed construction programme showing the intended method, sequence, stages
and order of proceeding with the Works together with the period of time he has
estimated for each and every such stage of progress.
Within two weeks from the award of this contract, the Contractor shall revise the
linked bar chart and prepare from it a critical path network to incorporate all relevant

information.

GUARANTEE AND MAINTENANCE


The Contractor shall assign to the Employer any guarantees and/or quotations for
future maintenance offered by plumbing, mechanical, electrical or other subcontractors and suppliers if and when such guarantees and/or quotations extend
beyond the Maintenance Period of the Contract.

OPERATION AND MAINTENANCE INSTRUCTIONS/MANUAL


The Contractor to submit to the Superintending Officer three (3) hard copies of the
complete set of Operation and Maintenance Manual (OMM) for items incorporated in
the Works, plus one set in CDROM format before the end of the 12-months
maintenance period (Defects Liability Period).
If the Superintending Officer decides to exercise the option of Additional 24-months
Maintenance programme, then further three hard copies of the updated OMM shall
be binded and one CDROM shall be submitted at the end of the 24-months.

AS-BUILT DRAWINGS
The Contractor shall keep accurate records of the actual construction during
construction. This information shall be supplied to the Superintending Officer
progressively in two paper prints and shall form the basis of an as-built record of the
finally constructed Works.
As-built drawings shall contain all necessary information from reviewed shop
drawings, construction drawings, co-ordination drawings and as-built records. Such
drawings shall be prepared and presented in a format approved by the
Superintending Officer, duly signed off by the respective Contractor, Qualified Person
& RTO.
Prior to completion of the project, the Contractor shall hand over to the
Superintending Officer two (2) set of prints for review. After the Superintending
Officers review the Contractor shall, if necessary, correct the as-built drawings. The
Contractor shall then submit two (2) set of A0 prints of all final as-built drawings
including those prepare by the nominated sub-contractor, plus one set in CDROM
format.

EXCEPTIONALLY ADVERSE WEATHER


For the purposes of assessing any extension of time due to exceptionally adverse
weather, the number of wet days in any one calendar month which exceeds the
10-year Monthly Average of Wet Days for that calendar month based on the rainfall
records for the meteorological station nearest to the Site which is one of the five main
stations used in the calculation of the national monthly average wet days, shall be
used.
A wet day shall be defined as one where the rainfall for that particular day equals or
exceeds 10.16mm.

Tengah Station shall be used. The 10-Year Monthly Average of Wet Days for the
period 2002 to 2011 for this station obtained from the Meteorological Services

Exceptionally Adverse Weather shall be assessed on a calendar month to month


basis and extension of time shall be granted only where the number of wet days
exceeds the monthly average wet days given above and provided always that in the
opinion of the Superintending Office, progress of Works has been affected and
continuance of any work becomes impracticable, causing delay in the completion of
the Works.

WORKING WITH OTHERS AT SITE


The Contractor shall note that there will be other contractors, tradesmen, craftsmen
and the like who are directly engaged by the Employer to work within the vicinity of
the Site together with him during the course of the works. The Contractor shall
execute the works in such a manner that work by others will not be affected. In no
circumstances will the presence of other contractors, tradesmen, craftsmen and the
like at site be considered as a ground for claim for extension of time. Any provision
for accommodating such others at site shall be allowed in the tender, as no claim to
the contrary will be entertained.

LIAISON WITH OTHER CONTRACTORS


The Contractor must arrange his programme of works to work very closely with the
Contractors from Authorities such as Power Grid / Public Utilities Board, Telecoms,
Land Transport Authority, National Environment Agency, National Parks Board, etc.
during the course of the Contract. He shall include in his tender for all costs and
expenses incurred in connection with the said liaison and making good of all works
disturbed and damaged by the Authorities' Contractor.

PRECAUTION AGAINST MATERIALS BEING TAKEN OUT OF SITES


The Contractor is responsible for all materials delivered to the site and must ensure
adequate protection to prevent the materials from being taken out of the site. The
FAS will not accept any excuse for material taken out of the site without the written
permission of the Superintending Officer by the Contractor, his foreman or other
individual even without the knowledge of the Contractor who is deemed to have
provided for proper control against such malpractice.

CARE OF WORKS, ETC


The Contractor will be held responsible for the care of the Works generally until their
completion including all work executed and materials deposited on the site by himself

or sub-contractors and suppliers, together with all risks arising from weather,
carelessness of operatives, damage or loss, and he shall allow for all necessary
watching and protective lighting.

PROTECTION OF WORKS AND MATERIALS


All materials on the site and work executed shall be protected from damage by
weather, fire, carelessness or workmen or other causes and any damage that may
occur either to materials or work supplied by the FAS under this Contract shall be
made good at the Contractor's own expenses.

OPENING OF WORKS FOR INSPECTION


The Contractor shall at the request of the Superintending Officer at such times as
specified by him, open for inspection any work covered up and should the Contractor
refuse or neglect to comply with such request the Superintending Officer may employ
other workmen to open the same. If the work has been covered up on contravention
of the Superintending Officer's instructions or if on being opened up it be found to be
not in accordance with the Contract or instructions, the cost of opening up and
covering it again including the cost (if any) of restoration of the work according to the
Contract shall be recovered from the Contractor.

IRREGULARITIES COMMITTED
The stipulations of this Specification will be strictly enforced and any work
condemned must be removed from the site within 24 hours and defective works
made good. Should the Contractor fail to comply with this requirement the
Superintending Officer may cause the work to be done by others and charge the cost
of same against the Contract amount.

REMOVAL OF DEFECTIVE WORK


The stipulations of this Specification will be strictly enforced and any work
condemned must be removed from the site within 24 hours and defective work made
good. Should the Contractor fail to comply with this regulation the Superintending
Officer may cause the work to be done and charge the cost of same against the
Contract amount.

ADULTERATION OF PAINTS
Should paints used in this Contract be found to be adulterated or unsatisfactory, the
FAS will recover from the Contractor a sum not exceeding $10,000.00 as fees paid
for the expense of laboratory analysis incurred.

PROGRESS
If the rate of progress of work is unsatisfactory over a given period of time, then on
the recommendation of the Superintending Officer the Employer may invoke Clause
31 of the Conditions of Contract and remove the Contractor and his employees from
the site of works and complete the work under a new contract or in any other manner

and no compensation shall be due to the Contractor for such stoppages.

DAMAGES FOR NON-COMPLETION


The Contractor must note that time is the essence of the Contract. If any work is not
completed on/or before the date of completion as stated, the respective conditions of
contract on Liquidated Damages shall take place.

REMOVAL OF RUBBISH
The Contractor shall arrange and pay all fees for disposing of all rubbish, unwanted
building debris, earth, rubble, chemicals, noxious or polluting matter, etc. from the
Site both at regular intervals and on completion.
The Contractor shall provide at his own cost and expense proper bulk bins of
adequate sizes at Site for storage of construction waste and debris and to make
necessary arrangements for the disposal of such waste and debris to approved
disposal grounds.
Burning of rubbish on the Site will not be permitted.

73

CLEARING UP AND CLEANING


Upon completion of the Works and before the Superintending Officer issues the
Completion Certificate the Contractor shall dismantle and remove from the Site all
plant, temporary buildings and temporary works, surplus materials and rubbish and
make good all work disturbed.
Clean the whole of the Works inside and out, removing stains temporary protective
films and coverings, touching up paintwork and polished work and leave the whole of
the Works clean and to the satisfactory of the Superintending Officer.

BRIBERY
During the progress of this Contract the Contractor and his representatives at the site
are forbidden to offer any bribes, commission or gift to the Superintending Officer or
any member of the FAS staff. Should it be discovered that bribes, commissions or
gifts have been given to the Superintending Officer or any of the FAS staff, this
Contract may be terminated immediately upon such discovery and the Contractor
shall be liable to forfeiture of any balance of money retained by the Employer. In
addition the Contractor is to pay any loss to the Employer resulting from such
termination.
