My counter remedy that is not finalized with a final settlement option and number.
First of all I am declaring being on your side. You have been accountable and responsible by making me an offer to settle this. The Jordans and Guth have not.
In my understanding of the law and my attorneys while you have the first responsibility in this encroachment, the Jordans also had a responsibility to buy a title insurance
policy for themselves not just paying for their original lenders. Same with Dania Guth as far as a possible legal responsibility to inform the Jordans that they should buy
a title insurance policy for themselves not just paying for their original lenders. Her RE/MAX E&O policy may help in adding to an acceptable total settlement amount.
My point is the Jordans and Dania Guth should also contribute to what you are offering to settle this. We will be adding Nova Home Loans as defendants very soon as
they too may have an obligation to help settle this regardless if the Jordans bought a title insurance policy for themselves this time when they did a ? refi in Feb 2013 and
especially if the Jordans did not disclose to Nova the encroachment which could be a possible misdemeanor or felony due to federal banking laws that apply to
consumers to not mislead a lender when applying for a loan and/or at closing regarding any legal issues
