Hicks: Article IL, Section 13 of the Missouri Constitution clearly and unequivocally states: “If any senator or representative remove his residence from the district or county for which he was elected, his office shall thereby be vacated.” By your own admission in a July 8, 2016, story by the St. Louis Post-Dispatch, you no longer reside in the 107" District, as the constitution requites. As @ result, you have forfeited your right to continue to hold the office of state representative, If you are an honorable man, as we believe you to be, who takes seriously the solemn oath he swore to follow the ‘Missouri Constitution, you will resign your seat without delay, ‘As you noted to the Post-Dispatch, the only way to force you from office is for the House of Representatives to vote for your expulsion. Since you told the reporter that you received approval from “the people in power,” presumably House Republicans leaders, to remain in office despite your acknowledged violation and the penalty it carries, you apparently expect to avoid the constitutional consequences of your actions. ‘It may well be true that your fellow Republicans would protect you in expulsion proceedings, which House Democrats will be forced to pursue if you fail to step down first. However, allowing you to remain in office despite your open admission of ineligibility would require House Republicans to declare to all of Missouri that rules — and. Consequences for breaking them ~ are for other people, not lawmakers. Under the Missouri Constitution, you are no longer eligible to represent your district, and every day that you continue to cling to office further undermines the legitimacy of the General Assembly.
