18° exact address of Sh, Biplav Kumar but he knew that he slays in Palam ( Delhi); that they (he & Biplav Kumar) have cleared (three bhipments of Micro SD Cards and RAM in the name of M/s Rajdham Crafts; that complete address of M/s Rajdhani Crafts was not known to him and to his knowledge the importer was based in Chandigarh 3. Further statement of Shri. Prashun Jain (RUD-5} was again recorded on 19.11.2010 under Section 108 of the CA,1962, wherein he interalia, voluntarily stated that he knew very well the Customs Rules & procedures regarding importation of goods in cargo; that whenever a ustomer/importer comes for taking service of CHA, he first checks the genuineness of the importer by checking his IEC (Import export code) code; then he verifies whether the import documents are in order or not and then he files these papers in Customs for duty assessment; that after assessment of duty, he pays the duty provided by the importer in the bank and then goods are examined in the import shed in his presence; that the consignments of AWB/HAWB No, 58993215485 / 190954 of B/E No, 168385 dt. 16.11.10 were declared as “Machine spares’, that this consignment was filed by Sh. Biplav Kumar; that he knew Sh Biplav Kumar who works for M/s Rajinder P Kapur for the last 4-5 months; that he met him at cargo office; that Sh Biplay Kumar introduced him in this business of importing the goods in such a way; that the goods were declared as machine spares in custom papers/documents whereas the same were Micro SD Cards of 2 GB and RAMS; that these goods were imported fram Hong Kong China in the name of M/s Rajdhani Crafts; On being asked about the importer of the said goods, he stated that these goods were imported by Sh. Prashant Gupta, having office at 210 Gedore House, Nehru Place, New Delhi, who was dealing in computer parts at Nehru Place; that he did not know the exact address of Sh. Prashant Gupta, but he remembered that he lives in Sector-I1, Rohini, New Delhi; that he knew Sb. Prashant Gupta for the last 3-4 months; that he knew Sh. Prashant Gupta who was introduced by Sh, Parikshit Sharma and Manoj Srivastava; that Sh. Prashant Gupta was to pay him a handsome amount after clearance; that he was to ger Rs. 85,000/- for this consignment; that Sh. Prashant Gupta used to pay the amount to him near his residence which is somewhere near Garg, Sweets in sector-11, Rohini; that his mobile no is 9811364889, 9582747406; that Sh. Prashant Gupta used to contact him on these Mobile nos for clearance of such consignment; that earlier also they cleared two to three consignments of Sh. Prashant Gupta; where such types of Rams , Cards were imported; that he used to pay extra commission/ amount to get it cleared by declaring it as some other product; that he very well knew that his act had led to loss of Go revenue; that he is very sorry for this act and promised not to repeat such type of act; that delivery order was collected and further processed_ - 4 av ~ 18. On 19.11.10, Sh. Prashun Jain S/o Shri Subhash Jain R/o B- 5/109, Mayur Apartments, Sector 9, Rohini, New Delhi 110085 was ~ arrested under Section 104 of the Customs Act, 1962. He was produced before the Court of Additional Chief Metropolitan Magistrate (ACMM), Patiala House Court, New Delhi after his medical examination conducted ~ by the Medical Officer at Dr. Ram Manohar Lohia Hospital New Dethi. He : was remanded to the Judicial Custody for fourteen days up to 34 Dec 2010. Sh. Prashun Jain was granted bail by the Court of ACMM, New ~ Delhi on 1.12.10. ~ 19. Whereas, vide letter dated Nil, Sub-Inspector of Rajasthan Police, ~ Jaipur, informed that M/s Rajdhani Cra 1955 to 1965, 6 KM Mile . Stone, Choumu, Vill. Jaitpura, Jaipur, have filed a complaint that ~ someone has imported goods in the name of M/s Rajdhani Crafts, Unit 2 1301-1302, Millenium Tower, Jasola Dist. and whereas they don’t have > any office / unit at the above mentioned address and further requested this office to supply the details/documents of goods seized in respect of * Centre, New Delhi, 20. Whereas, Summons dt. 24.11.10, 29.11.10, 3.12.10, 20.12.10, > were issued to Sh. Prashant Gupta for appearance before the Customs Depti., but he never turned up. Therefore, a complaint against Sh Prashant Gupta was filed in the Court of ACMM, New Delhi for non = compliance of summons. He was further issued summons dated a 26.08.11, 21.07.11, 8.08.11, 8.09.11 & 5.10.11, but he never turned up > and never joined the investigation. The Hon'ble Court of ACMM also ~ issued him summons dated: 07.10.11 for appearance in the court on " 02.11.11, but he failed to appear in the court.
