MILITANT labor group Kilusang Mayo Uno (KMU) in Southern Mindanao on

Friday hit the policy on voluntary arbitration (VA) and called on the National
Conciliation and Mediation Board (NCMB) in Davao Region to scrap the same
policy.
The labor group made the appeal following the decision of the arbitrator on the
voluntary arbitration Case No. AC-213-RCMB-VI-LVA-08-01-12-2015, involving
RMN Davao Employees Union (RDEU-NAFLU-KMU) and DXDC-RMN Davao.
The issue was whether the employees are entitled to government-mandated
wage increase pursuant to Regional Tripartite Wage and Productivity Board
(RTWPB) wage order, in addition to wage increase provided in the collective
bargaining agreement.
But Romualdo Basilio, KMU secretary general, said the VA dismissed the
complaint and ruled in favor of DXDC, considering that being above minimum
wage earners, they are no longer entitled to the mandated increase.
He said VA policy and the Philippine Association of the Voluntary Arbitrators
(Pava) should be delisted as it only shows a privatized form of labor dispute
resolution that can be sold to the highest bidder.

Basilio said the voluntary arbitration today involves private practitioners, mostly
from the corporate world, composed of former human resource managers,
corporate lawyers, and management people.
"These practitioners obviously only have strained view of labor, and that in itself
makes the odds of decisions in favor workers less likely," Basilio said.

Instead of being relegated to private practitioners, Basilio said, the labor group
recommends the voluntary arbitration be made a part of the government's
judicial structure.
