This cause came on to be heard on the transcript of record from the United
States District Court for the Southern District of New York and was argued.
Commander's application for sanctions under Rule 38, Fed. R.App. P., is
denied on the merits and on the ground that the application was not separately
filed as required by the Rule.
We therefore affirm.
