MANIFESTATION

REQUESTING THE CITY GOVERNMENT OF URDANETA TO CREATE AN

ADMINISTRATIVE BOARD TO HEAR COMPLAINTS REGARDING DRUG
RELATED PUBLIC NUISANCES.
Section 5, Article II of the Philippine Constitution mandates that: The
maintenance of peace and order, the protection of life, liberty and property, and the
promotion of general welfare are essential for the enjoyment by all the people of the
blessings of democracy.
Republic Act No. 9165 otherwise known as the Comprehensive Dangerous
Drug Act of 2002, states that: It is the policy of the State to safeguard the integrity of
its territory and the well being of its citizenry particularly the youth, from the harmful
effects of dangerous drugs on their physical and mental well being, and to defend
the same against acts or omissions detrimental to their development and
preservation.
The war on illegal drugs in Urdaneta City is far from over. Illegal drug
trafficking and abuse remain and continue to pose a major threat to this Citys
security. Drug syndicates, pushers and their cohorts have found other methods in
doing their operations and in a sense, make anti-illegal drugs operations more
complex. Findings at the Mass Surrendering of 1, 177 Drug Personalities last July
15, 2016 at Urdaneta City Cultural and Sports Complex reveal that they are all only
users. Intelligence Report indicates that Urdaneta City is one who has the highest
abuse rate of methamphetamine hydrochloride or shabu.
Tactical Interrogation conducted to these voluntary surrendered drug
dependents revealed that most of their sources of shabu comes from the Muslim
Community in Doa Trining Subdivision Brgy. Camantiles and Doa Loleng
Subdivision Brgy. Nancayasan Urdaneta City. We find these particular two places to
be Drug Related Public Nuisances that need to be abate. The Urdaneta City
Government should adopt a more aggressive and proactive approach in tackling the
problem of narcotics in the City. For our part, we shall continue our intensified and
aggressive conduct of anti-illegal drug operations. My men and women in the
Urdaneta City Police Station will face squarely the complexities of the illegal drugs
threat with a firm resolve to overcome and defeat it.

Article VII Section 52 of RA 9165 provided that: Abatement of Drug Related

Public Nuisances. Any place or premises which have been used on two or more
occasions as the site of the unlawful sale or delivery of dangerous drugs may be
declared to be a public nuisance, and such nuisance may be abated, pursuant to the
following procedures:
(1) Any city or municipality may, by ordinance, create an administrative board
to hear complaints regarding the nuisances;
(2) any employee, officer, or resident of the city or municipality may bring a
complaint before the Board after giving not less than three (3) days written notice of
such complaint to the owner of the place or premises at his/her last known address;
and
(3) After hearing in which the Board may consider any evidence, including
evidence of the general reputation of the place or premises, and at which the owner
of the premises shall have an opportunity to present evidence in his/her defense, the
Board may declare the place or premises to be a public nuisance.
It is shown on Annex A the alarming number of cases investigated and
arrested drug personalities by my personnel in Muslim Communities at Doa Trining
Village, Brgy. Camantiles and Doa Loleng Village Brgy. Nancayasan, Urdaneta City,
Pangasinan for violation of RA 9165 from the time of my assumption on September
11, 2013 to July 2016.
The support of the Urdaneta City Government through the enactment of such
ordinance will ensure the success of the national anti-drug program of action.
Together, we can soon declare and boast that Urdaneta City is a DRUG FREE!
