Bangladesh labor court

There are 7 labor courts in Bangladesh

4 at Dhaka
2 at Chittagong
1 at Rajshahi
1 at Khulna

The mission statement of the Labour Court is "To find a basis for real and substantial agreement
through the provision of fast, fair, informal and inexpensive arrangements for the adjudication
and resolution of trade disputes".
The Labour Court is not a court of law. It operates as an industrial relations tribunal, hearing
both sides in a case and then issuing a Recommendation (or Determination/Decision/Order,
depending of the type of case) setting out its opinion on the dispute and the terms on which it
should be settled.

Functions of Bangladesh labor court:


The Courts functions can be divided between those relating to industrial relations matters and
those relating to the determination of appeals in matters of employment rights

Industrial Relations

Investigate trade disputes


Investigate at the request of the Minister for Jobs, Enterprise and Innovation, trade
disputes.
Hear appeals of Adjudication Officers recommendations/decisions made under the
Bangladesh Labor Codes
Establish Joint Labour Committees and decide on questions concerning their
operation
Register Joint Industrial Councils
Investigate complaints of breaches of codes of practice made under the Bangladesh
Labor Code
Register employment agreements
Examine the terms and conditions of employment according to Bangladesh Labor
Code

Employment Rights

Hear all appeals on various Employment Rights and Pension Acts


Hear appeals of Non-discrimination Notices and Substantive Notices issued by the
Equality Authority
Approve working time agreements under the Organization of Bangladesh Labor Code
Approve collective agreements regarding casual part-time employees

Objectives:
Facilitate rules and principles designed to govern the normal typical
behavior of related parties.
The law is to ensure normal behavior in relations between employers
and employees.
Rules governing labour relations are an attempt to mitigate the
disequilibrium inherent in the employment relation
To improve the senile conditions of industrial labour so as to provide for
them the ordinal amenities of life, and by that process.
To bring about industrial peace this could in its turn accelerate
production activity of the country resulting in its prosperity.
