NOTICE: Fourth Circuit Local Rule 36(c) states that citation of unpublished
dispositions is disfavored except for establishing res judicata, estoppel, or the law
of the case and requires service of copies of cited unpublished dispositions of the
Fourth Circuit.
Lawson's request was unsupported by any showing that the desired discovery
was required for any pending litigation. Thus, the magistrate judge did not
abuse his discretion in denying the motion. Fed.R.Civ.P. 26(b)(1); cf. 18 U.S.C.
Sec. 3504 (1988) (admissions regarding surveillance not discoverable if no
action pending).
AFFIRMED.
