OPINION

Joseph Marion Head, Jr., appeals from the district court's order dismissing
Head's submissions pursuant to 28 U.S.C.s 1915(d) (1988). Our review of the
record and the district court's opinion discloses that this appeal is without merit.
Accordingly, we affirm on the reasoning of the district court. In re Head, No.
CA-93-92-4 (W.D.N.C. June 15, 1993). We dispense with oral argument
because the facts and legal contentions are adequately presented in the
materials before the Court and argument would not aid the decisional process.
Leave to proceed in forma pauperis is granted, and the motion for appointment
of counsel is denied.
AFFIRMED
