PER CURIAM:
Francisco Leodan Duran-Hernandez pled guilty without a
plea agreement to unlawful reentry into the United States by a
deported alien in violation of 8 U.S.C. 1326 (2000), and was
sentenced to seventy-one months in prison. Duran-Hernandez appeals
the district courts judgment, arguing that the district court
erred
in
determining
that
his
prior

warranting
application
of
sixteen-level
concedes that the district court erred and agrees that DuranHernandez should be resentenced, we are not at liberty to vacate
