PER CURIAM:
Appellant seeks to appeal the district courts order denying
relief on his petition filed under 28 U.S.C.A. 2254 (West 1994 &
Supp. 1998). We have reviewed the record and the district courts
opinion and find that Appellants 2254 petition was not timely
filed in the district court.* See 28 U.S.C.A. 2244(d)(1), (2)
(West Supp. 1998). Accordingly, we deny a certificate of appealability and dismiss the appeal. We dispense with oral argument
because the facts and legal contentions are adequately presented in
the materials before the court and argument would not aid the decisional process.
DISMISSED
