This is a letter sent to the Erie County Board of Elections by Brian Nowak, campaign manager for the Mark Sacha for DA campaign.
In the letter, Brian requests formally information from the BOE regarding a poll taken for the Flaherty campaign.
More importantly, he points out that this relatively large expenditure does not appear to be reported in Flaherty's 32-day filings.

134 West Eagle Street Buffalo, NY 14202 Dear Commissioners, Last week, the public was made aware of a public opinion poll pertaining to the Erie County District Attorneys race. The poll was conducted July 28th 31st, 2016 by David Binder Research of San Francisco, California. The Mark Sacha for DA campaign viewed the poll from an online article by Time-Warner News. The campaign wishes to know if you received all required information within 48 hours, and how the campaign can be assured it has received the information in its entirety. More importantly, the campaign would like you to be made aware that this relatively costly polls expense does not appear to be reported anywhere within the Flaherty campaign 32-day filings. The poll questioned 400 respondents for about 15 minutes each. Clearly, this poll could not have been conducted without significant investment of time and money. The campaign asks for your assistance in investigating the campaign finance filings to ensure that the spending associated with this poll has been adequately reported. Its not the intention to accuse any wrongdoing based on our review of their filings, but it is important that all campaigns file complete and accurate campaign finance reports.
Regards, Brian Nowak Campaign Manager Mark Sacha for DA
