BRIEFING ON THE OUTCOMES OF CBTA JOINT COMMITTEE RETREAT AND


NATIONAL TRANSPORT FACILITATION COMMITTEE (NTFC) SOM MEETING
AND DEVELOPMENT OF SSI/SWI AT LAO BAO DANSAVANH

The Ministers decision to launch the issuance of GMS Road


Transport permits under CBTA Protocol 3, with common Temporary
Admission Documents (TADs) under CBTA Annex 8 starting on 1
January 2017 is a welcome first step towards the GMS vision of an
integrated subregional transport market

It complements work undertaken by some GMS countries (e.g.


Lao PDR, Thailand and Vietnam) to facilitate frontier crossing
formalities by implementing Single Stop/Single Window inspection
under IICBTA-type MOUs in compliance with CBTA Annex 4

The challenge we face is to maintain this momentum,


implementing the CBTA throughout the GMS subregion, including
the Agreements key transit provisions under CBTA Annex 6 to
further speed border clearance, reduce costs and facilitate trade

Lao Bao border checkpoint was established in 1978 and


upgraded to International Border gate in 1994

As one 15 border checkpoint pairs (alongside Dansavanh in


Lao PDR) included under CBTA Protocol 1, Lao Bao border
checkpoint expects the CBTA once implemented by all
Parties to significantly increase the volume of traffic and
economic opportunities along GMS corridors

5 sector agencies operate at Lao Bao: Border Guard


(Immigration), Customs, Human Health Quarantine, Animal
Quarantine and Plant Quarantine, plus 2 service agencies: a
Bank and Insurance company and a Public Service Provider:
the Bordergate Management Center (BMC)

Effective agreements and documents:


Under the GMS framework, in 2003 Laos PDR, Thailand, Cambodia,
Vietnam, China and Myanmar signed the GMS-CBTA, effective from
31/12/2003 (an ADB initiative)
The signatories of the GMS-CBTA are committed to apply SWI/SSI at
the International Checkpoints along the GMS corridors, including the
EWEC based on CBTA Annex 4
On 25/3/2005 Vietnam and Lao PDR signed an MOU on initial
implementation of GMS-CBTA, agreeing to pilot the SSI/SWI model at the
Lao Bao Dansavanh International Bordergate Checkpoints

Vietnams Ministry of National Defense and Laos Ministry of Public Security


signed an MOU on joint control to provide legal foundation for joint control and
examination and assigning staff for joint work at the Lao Bao Dansavanh;
The Vietnamese and Lao Ministries of Finance signed an MOU on the
implementation of Stage 4 for Customs at Lao Bao Dansavanh;
Vietnams Ministry of Agriculture & Rural Development and Lao PDRs Ministry
of Agriculture and Forestry signed MOUs on SWI/SSI for Plant and Animal
Quarantine;
Vietnams and Lao PDRs Ministries of Health exchanged discussions on Human
Health Quarantine;
Quang Tri Provincial Peoples Committee (Quang Tri PPC) issued Decision
No.1382/Q-UBND dated 7/7/2014 re-establishing the provincial Steering
Committee to oversee the implementation of SSI/SWI at Lao Bao and Decision
1395/Q-UBND on 01/7/2015 on strengthening the Steering Committee to meet the
new requirements. In addition, Quang Tri PPC issued Decision No. 155/Q-UBND
dated 27/01/2016 establishing Assistant Group for above Steering Committee.

The SSI and SWI Pilot carried out at the Lao BaoDansavanh
border crossings consisted of 4 phases (with phases 2 and 3
combined)
* Stage 1: The Contracting Parties of the MOU coordinate to
jointly inspect commodities at the CCA (Common Control
Area) of the country of entry (from 30.June.2005).
* Stage 2 & 3: Customs Agencies and Quarantine Agencies of
the two countries coordinate to work together to carry out all
the procedures concerned at the country of entry (from 1st July
2005 to 5th February 2015)
* Stage 4: Fully carry out all the procedures by all border
agencies for SSI and SWI. All the competent agencies
coordinate to implement their duties (from 6th February 2015
up to now)

2.3 Infrastructures:
1. Renovation of the Interagency
Control Complex in the middle of

II. PERFORMANCE
AGENCIES

1. Customs:
* Performance in 2015:

- 4,515 customs declarations were processed,


totaling 343.154 tons of goods at USD181 mil
(Exports: USD42.423; Imports: USD138.943 ),
of which:
+ Joint examination: 2,098 declaration forms;
26,537 tons of goods, USD31mil.
+ VNs Customs examination: 2,417
declaration forms; 316,617 tons of goods,
USD146 mil.
* Performance in first 6 months of 2016:
1,456 customs declarations were processed,
totaling 59,403 tons of goods at USD48.967 mil
(Exports: USD22.697; Imports: USD26.170).

tons/m3;
+ Exports: 110 lots, weighing 10,047 tons/m3;
+ Imports: 1,584 lots, weighing 96,819 tons/m3.
+ Food safety control : conducted on 90 lots,
weighing 2,454 tons/m3.

6. Bordergate Management Center (BMC):

Quang Tri BMC is a public service provider, under Quang Tri


Economic Zone Management Board, responsible for
coordinating the operations of state administrative agencies
and other functional bodies at Lao Bao and La Lay
International checkpoints; providing trade-facilitating
services at the bordergates and working with the local
government and bordergate management body of Lao PDR.
At present, Quang Tri BMC has total 42 staff, including 13
part-time staff and 29 full-time ones working at two
international border checkpoints of Lao Bao and La Lay.
(La Lay National border checkpoint was established in 1995 and
being upgraded to the International Border gate in 6/2014. It is
110 km from Lao Bao, located on PARA-EWEC)

Key responsibilities include:


Working with other agencies at Lao Bao to receive study
delegations, as well as planning and organizing work under the
SSI/SWI model at the Common Control Areas (CCA) on the
both sides of the border.

Implementing Peoples Council's on levying, managing and


spending proceeds from fees and charges of using bodergate
structure infrastructure facilities in Quang Tri province
(starting collection of fees on 20/01/2015 in Lao Bao and La Lay
up to now reached VND25,4 billion, or VND50-60million/day on
average from both checkpoints).

In addition, between 12-16/3/2016 and 20-21/8/2016 the BMC has


been working with the border control agencies and ADB to : (i)
finalize an Operational Manual for joint processes and
procedures and specific procedures for each sector agency at the
2 checkpoints; (ii) finalize lists of equipment requested for
procurement; and (iii) develop a language training program to
support SWI/SSI operations.

Assessment:
* Strengths:

Thanks to implementing 04 stages of SWI/SSI simultaneously, the


processing time has reduced for people and goods. Example: one stop is
required for people and goods for formalities at the border checkpoint,
reducing 40 50 % of time to wait, move and do formalities.
Thanks to joint procedures at the CCA in the country of entry,
communication becomes quick, work processing better coordinated.
Promoting economic development, trade, movement of goods and people
through the border; improved transparency.
Enhancing confidence, capacity and coordination among border control
agencies;
New investments made in development and renovation of facilities,
facilitating management and operationalization of the SSI/SWI model,
providing better services for traders and people.

* Weaknesses/challenges:

Incomplete sync among all border agencies, gaps in


regulations/procedures within each sector of the two countries results in
incomplete SSI/SWI.
Differences in regulations on goods/items subject to plant quarantine
between the two countries. Laos plant quarantine does not issue Plant
Quarantine Certificate for goods exported to Vietnam (only Plant
Quarantine Registration Document for national use), which is not in
compliance with international standards, causing gaps in required
documents for imports to VN.
Lack of facilities despite investments (lack of CCTV, passenger luggage
scanner, stable supply of electricity... in Dansavanh side).
Simultaneous implementation of SSI/SAWI and long working hours (722hrs) stretch the resources of all agencies.
Challenges in trade, people and vehicles crossing the border:
Despite the full implementation of the Stage 4 of SSI/SWI at Lao Bao
started in 6/02/2015, but the above Table shows that: trade performance
and the movement of people and vehicles through Lao Bao have decreased
in comparision with 2014. Reasons are included as followings:

- Exports: Despite incentives, exports from Vietnam to Laos have been limited
due to limited market and low income, focusing on low value goods:
construction materials, consumption goods Exchange of goods among local
residents are at low value and not recorded as formal trade.
- Imports: Traditional higher value goods from Laos to Vietnam through Lao
Bao include: woods, copper, gypsum, rubber, coffee beans, fruits, home
appliances, electrical and electronic goods ... The import of such goods fell
sharply in 2015: woods reduced from 65% to 47% of total revenues (recentlly,
Lao government has issued a instruction to forbid export natural woods to
oversea, the volume of woods exchanged between the borgers will be limitted
in the future); copper from 26% to almost zero; import of gypsum decreased
sharply due to high transportation costs and low price of selling in the market;
fruits transportation has changed the routes, via other border crossings.
- Savanakhet Provincial Government introduced policies to protect local
vehicles (motorized vehicles) to pass the borders. This in contrary to the
Bilateral Road Traffic Agreement between the two countries, limiting trade
and exchange between the two sides, especially activities among the local
people on the 2 sides of the border.

- As reported by Vietnamese and Laotian businesses, on Route


No.9, in both sides there have emerged several checking stations to
check goods and vehicles before and after clearance through Lao
Bao - Densavanh, causing delays, congestion and increasing costs
for traders. Number of such stations in Vietnams side (from Lao
Bao to Dong Ha) has been reduced, but little improvement has been
made in Laos side.
- At Lao Bao Special Economic Zone, an intermediate location for
imported goods into Vietnam, since the issuance of Circular
109/2014/TT-BTC dated 15/8/2014 of MOF guiding implementation of
Decision 72/2013/Q-TTg dated 26/11/2013 of the Prime Minister
providing financial regulations for bordergate economic zone, almost
all imported goods became subject to duties immediately (import Tax,
Vealue Addition Tax, Special consumsion Tax, Environmental Tax)
resulting in sharp reduction in goods consumed in this zone (only
USD5.1mil, down by 92.5% compared to 2014).

So far, the area has attracted 67 investment project with a total register capital of over
VND 4.000 billions, the hired areas is 300 hectares,in which:
+ 04 FDI Projects with total investment capital of 36 millions USD.
+ 34 projects operated with total investment capital of 2.745 billions VND
+ 26 projects were issued Certificate of Investment with total investment capital of 857
biliions VND
+ 06 projects are being checked in investment with total investment capital of 160
billions VND.

First:

Clearly identify each stage in detail, relevant agencies and


timeframe for implementation, responding to the specific local
circumstances.
Second:

Need to set up a body/mechanism to provide direction,


advice and coordination for implementation.
Third:

Invest full necessary infrastructures, facilities, equipment,


staff resources needed for implementation.
Fourth: Develop and strengthen comprehensive, mutually
beneficial cooperation between the two sides before, during and
after introduction of the model.

Fifth: Processes and procedures should be organized reasonably;


strengthening control and oversight and pilot of the model at both
border checkpoints before official launching of last stage (Stage 4.

Sixth: Raise awareness on coordination responsibilities to deliver


the SSI/SWI in its genuine sense.

1. For ADB:
1.1 To provide consultant guidance and financial support to carry out the
forthcoming activities for SSI/SWI, such as: Making Operational Manual,
Providing necessary supplies and equipments suggested by the involved
agencies; Traning courses in English, Vietnamese and Laotian as proposed by
Vietnamese and Laotian concerning agencies.
1.2 To coordinate with government and ministries of Vietnam and Lao in
guidance and instruction the privincial departments and localities to build
and carry out a national common process as well as functional separate
process so that SSI/SWI can be put into practice with full enough meaning.
1.3 To provide financial support to communication activities: Developing
signage, edition and posting of information/images on LED screen to promote
the SSI/SWI at the border checkpoint; Producing reportage, publications on
mass media; Building and developing website for promotion and access to relevant
information on SSI/SWI process and procedures.

1.4 To provide financial support for study tours to countries/locations where


similar operations have been/are going to be introduced (such as: Study tours
in the other border checkpoints: Lao Cai (Viet Nam) Hekou (China), Moc Bai
(Viet Nam) Bavet (Camphuchia), Savanakhet (Lao) Mukdahan (Thailand) to
draw lessons and develop plan to improve SWI/SSI at Lao Bao Densavanh.
1.5 To continue granting fund for the both sides of Vietnam and Lao to complete
infractructure of the bordergates, so that can we can carry out activites of
SSI/SWI with better results.

2. For Ministries:
2.1 To provide sources of Agreements, MOUs, relevant documents on GMS
CBTA and SSI/SWI, provide guidance to Quang Tri PPC and BMC in
development of SWI/SSI Operational Manual;
2.2 To coordinate with ADB, Office of Government to guide on procedures to seek
funding for equipment, language training and infractucture to complete the
facilities required for effective implementation of SWI/SSI.

2.3 To coordinate in organizing study tours to countries/locations where similar


operations have been/are going to be introduced.
2.4 To combine together studying carefully and solving all difficulties that
bordergate agencies facing with during last implemetion of SSI/SWI in Lao Bao
Densavanh.
2.5 Consulting the Government of the both sides feasible mechanism, policies of
export, import, goods exchanged between the two countries and borders in line
with measures to enhance the flow of people, vehicles and goods passing the
boders with bigger volumes day after day.
2.5 To provide adequate staffing to meet the highly-specialized control work under
the SWI/SSI regime at the border checkpoint.
