OPINION

Joseph P. Payne appeals the district court's denial of his Fed. R. Civ. P. 60(b)
motion which urged the district court to hold his 42 U.S.C. 1983 (1988)
action in abeyance pending the exhaustion of state remedies. Payne's original
action challenged the constitutionality of his confinement and sought damages.
See Hamlin v. Warren, 664 F.2d 29 (4th Cir. 1981), cert. denied, 455 U.S. 911
(1982).
