Michael Keith Estep v. Tazewell County Jail, and Linda McQuire Donna S. Murray, 2 F.3d 1149, 4th Cir. (1993)
3d 1149
Appeal from the United States District Court for the Western District of
Virginia, at Roanoke. Samuel G. Wilson, District Judge. (CA-92-644-R)
Michael Keith Estep, Appellant Pro Se.
Robert Vincent Ward, Bristol, Virginia, for Appellee.
W.D.Va.
DISMISSED.
Before NIEMEYER, HAMILTON, and WILLIAMS, Circuit Judges.
OPINION
PER CURIAM:
Michael Keith Estep seeks to appeal the district court's orders granting the
Tazewell County Jail's Motion to Dismiss and denying Estep's Motion for
Reconsideration. We dismiss the appeal for lack of jurisdiction because the
orders are not appealable. This Court may exercise jurisdiction only over final
orders, 28 U.S.C. Sec. 1291 (1988), and certain interlocutory and collateral
orders, 28 U.S.C. Sec. 1292 (1988); Fed. R. Civ. P. 54(b); Cohen v. Beneficial
Industrial Loan Corp., 337 U.S. 541 (1949). The orders here appealed are
neither final orders nor appealable interlocutory or collateral orders.
