COMES NOW, Carbon County Attorney and states on information and belief
that the Defendant, THOMAS EDWARD EGLEY, committed the crimes of:

COUNT 1
CRIMINAL HOMICIDE, MURDER IN THE SECOND DEGREE, in violation of
Utah Code Ann 76-30-1 (1953) as follows: That on or about July 30, 1970, at 468 East, Fourth
South, in Carbon County, Utah, the Defendant, THOMAS EDWARD EGLEY, unlawfully
killed Loretta Jones, a human being, with malice aforethought.
COUNT 2
RAPE, a First Degree felony, in violation of Utah Code Ann 76-53-15 (1953) as
follows: That on or about July 30, 1970, at 468 East, Fourth South, in Carbon County, Utah, the
Defendant, THOMAS EDWARD EGLEY, engaged in an act of sexual intercourse with Loretta
Jones, a female who was not his wife, when Loretta Jones was incapable of giving consent; or
resisted, but her resistance was overcome by force or violence, or when at the time the Defendant
knew she was unconscious of the nature of the act; and in the course of the act the defendant
caused serious bodily harm to the victim.

THIS INFORMATION IS BASED ON EVIDENCE OBTAINED FROM THE


FOLLOWING WITNESSES:

Thomas Edward Egley, (Defendant); Sgt. David Brewer and Detective Wally Hendricks,
(Carbon County Sherriffs Office); Heidi Jones; Marsha Hidalgo; Barbara Battison; Rudy
Sanfelice; Edward Wilson M.D., (Medical Examiner); Sue Ann Horvath; Albert Passic, Arthur
Poloni, Charles Nelson Kirkwood, Margret Hamilton; Lisa Carter; Lori Kulow; and Jim Kulow.

DECLARATION OF PROBABLE CAUSE:


Your Declarant, Sgt. David Brewer, with the Carbon County Sheriffs Office, based on
information in Carbon County Sheriff report number 20100590, interviews of witnesses, and
investigation by law enforcement officers states as follows:
On the evening of July 30, 1970, twenty-three (23) year-old Loretta Jones died inside her
home, located at 468 East, Fourth South, in Carbon County, Utah. Lorettas four (4) year old
daughter, Heidi Jones, was in the adjoining room at the time of her mothers demise.
On the morning of July 31, 1970, Lorettas daughter, Heidi, after finding her mother
lying on the floor of the living room, told her neighbor, Sue Ann Horvath, she thought her
mommy is dead. Horvath looked inside of Lorettas home and discovered Lorettas body in the
living room. She was lying face down between the couch and a coffee table, and was naked
from the waist down, her back and hair matted with blood. Horvath called police and Price City
Police Chief Art Poloni responded to the scene. When he arrived, Poloni observed the house was
clean and orderly, the windows and back door were locked, and nothing had been turned over.
There was a fairly large bloodstain on the living room couch. Poloni assisted Sheriff Albert
Passic, the county attorney and a medical examiner in identifying two (2) stab wounds in
Lorettas chest, fourteen (14) stab wounds in her back, and one (1) wound to her throat. Poloni
also found Lorettas shorts and underwear lying next to her body and the underwear appeared to
have been cut by a knife or another sharp object.
An anonymous phone tip led investigators to question THOMAS EDWARD EGLEY

(Defendant) on August 1, 1970. EGLEY admitted to being in Price, Utah, on the night of
Lorettas death, but denied going to visit her. When asked, EGLEY said he could not identify
anyone who could confirm his alibi. EGLEY was interviewed by Sheriff Passic later that month
and again denied his involvement with Lorettas death. EGLEY gave Passic a hat and a set of
clothes he claimed to have worn the night of Lorettas death and three knives which he owned.
EGLEY was arrested for the murder of Loretta Jones, and a preliminary hearing was held
on November 5, 1970. Among the witnesses called were:
1. Sue Ann Horvath, who testified about finding Lorettas body the morning of July 31,
1970.
2. Arthur Poloni, who testified about what he saw at the crime scene, the evidence he
collected, and what information EGLEY revealed during his interview.
3. Albert Passic, who testified to photographing the crime scene and searching
EGLEYs hotel room.
4. Edward Wilson, M.D., who testified that Loretta Jones died by homicide due to
internal bleeding, caused by stab wounds in the pulmonary artery, lungs, and heart.
Dr. Wilson testified that semen was discovered in Lorettas vaginal cavity. Dr.
Wilson estimated it took between five (5) and twenty (20) minutes for Loretta to die.
5. Charles Nelson Kirkwood, who testified to driving EGLEY from Helper to Price the
night of Lorettas death. He remembered EGLEY was wearing a colorful hat and a
white t-shirt and jeans.
6. Margaret Hamilton, owner of the Highway Rendezvous Bar, testified that EGLEY
visited her bar twice on the day of Lorettas death. When EGLEY visited the bar the

second time it was around 11:30 p.m. Hamilton noticed red spots on EGLEYs shirt
and observed that he was acting very nervous.

The court determined the evidence was insufficient to bind EGLEY over for trial and
dismissed the case. EGLEY moved to Colorado the following year, where he has continuously
resided.
In 2009, Carbon County Investigators reopened the case at the request of Heidi Jones.
Over the next year, investigators located and interviewed Marsha Hidalgo (EGLEYs ex-wife),
and Barbara Battison, who was the owner of the Sportsmans Bar and EGLEYs former boss.
Marsha Hidalgo told investigators she remembered EGLEY coming home
uncharacteristically late the night of Lorettas death and that he took a bath in his clothing the
same night. She remembered EGLEY was not drunk when he came home. Hidalgo told
investigators that when she asked EGLEY where he had been, EGLEY admitted to bringing
hamburgers to a woman and her daughter. Hidalgo also told investigators that the next morning,
EGLEY gathered the clothes he was wearing the previous night, and took them to the
laundromat. Hidalgo told investigators this was unusual behavior for EGLEY. Hidalgo stated
that later that day, EGLEY returned from the laundromat with fewer clothes than when he left.
Hidalgo noticed EGLEYs clothing he wore the previous night was missing, and in a later
conversation EGLEY admitted to Hidalgo that he gave the police a different set of clothes than
what he was wearing the night of Lorettas death.
Barbara Battison, owner of the Sportsmans Bar and EGLEYs former boss, told
investigators that on July 31, 1970, she had observed EGLEY using the burn barrel by the

laundromat to burn items. Battison stated when she asked the Defendant what he was burning,
EGLEY told Battison he was burning clothes from the night before and that he gave police a
different set of clothes when they came and searched his hotel room.
In the spring of 2016, Carbon County exhumed Lorettas body. Within a short amount of
time, EGLEY spoke with his neighbor, Lisa Carter, and asked how long DNA evidence and
semen lasted. After further discussion with Carter, the Defendant agreed with her to come
clean to investigators. Carter arranged for EGLEY and Carbon County Investigators to meet at
EGLEYs home. On July 8, 2016, after being read his Miranda rights, EGLEY admitted to
slitting Lorettas throat.
On July 16, 2016, during a private conversation with Carter, EGLEY gave a more
detailed confession. EGLEY stated: I was there for sexI was turned down for sex[It made
me feel] like shitshe went to the kitchen or something after thatand when she came back I
stabbed herin the living room. She fellin front of the couch. EGLEY then stated he
thought Loretta was still alive when he had sex with her and could not remember whether
Loretta was wearing her clothes. EGLEY further stated he had sex with her and cut her throat
And I left.She was on the floor in front of the couch. EGLEY admitted to killing Loretta,
then returning to his hotel and bathing with his clothes on. EGLEY also admitted that the
following day, he took the clothes he was wearing to get rid of them and threw the knife in
the river behind the hotel.
WHEREFORE, THE AFFIANT PRAYS that an Arrest Warrant be issued ordering the
arrest of THOMAS EDWARD EGLEY based on the above Information. I request that a no
bail warrant be issued under U.C.A. 77-20-1(2)(C) for the following reasons: 1) To prevent

risk of injury to a person or property; 2) To protect the public safety and welfare of the
community or any individual; and 3) To secure the appearance of the accused.

declare, under criminal penalty of the State of Utah,
that the foregoing is true and correct.
