The roots of Lankhorst reach back over 250
years. Established in 1751 as a ropery and
sailmakers loft in Sneek in The Netherlands,
the company became known as Lankhorst
after Nikolaas Jurgen Lankhorst took over the
company from his in-laws in 1803. During the
19th and 20th centuries, Lankhorst grew from
a local artisan business into a world-wide
supplier of rope and ships mooring lines.
These activities still form our core business Lankhorst Ropes is the largest company within
the Lankhorst group, and a world leading rope
manufacturer.
After several years of working within a
strategic alliance with the Portuguese rope
and netting producer, Grupo Euronete SGPSA,
Lankhorst and Grupo Euronete merged into
the Lankhorst Euronete Group. This group
holds a leading position in many international
markets. In addition to maritime and offshore
ropes Lankhorst is now the largest producer of
fish netting in the world, and one of Europes
market leaders in plastics recycling. Through
innovation and product development, we
have also built strong market positions in industrial yarns, pure composites products, and
the yachting and agriculture markets.
In July 2012 the Royal Lankhorst Euronete
Group was acquired by WireCo WorldGroup
Inc., a global leader in producing and
marketing of wire rope, electromechanical
cable and a major producer of wire products,
headquartered in Kansas City, Missouri.
The immediate benefit to customers is Lankhorsts ability to serve as a one-stop shop for
all its maritime customers synthetic and steel
wire requirements, and enhanced capability in
crane ropes. In addition, Lankhorst Ropes global stock point network now feature increased
stocks of wire ropes.

Founded in 1803, Lankhorst Ropes has over
200 years experience in the manufacture
and supply of high performance ropes for
mooring and towing applications.
Our core business is the development and
production of high performance, synthetic
and steel wire ropes for mooring and anchor
systems, as well as towing and crane hoisting
and luffing application. We are committed
to setting the standard for maritime ropes
through our leading rope brands - TIPTO

PREFACE TO THE NEW CATALOGUE


Longer lasting tow ropes and safer towing
The innovative KO-LINK towing ring developed by KOTUG
International BV is available exclusively from Lankhorst
Ropes. The KO-LINK ring significantly increases synthetic
towing line service life by preventing the HMPE pennant
from cutting through the line.
KO-LINK is a highly polished, lightweight, aluminium
ring, which is inserted and attached to the splice eye
of the towline. The ring connects the main towline and
the pennant in such a way that a controlled weak link
is created, preventing towing-line overload. As well as
increasing towing line service life, the KO-LINK connection
reduces the time required for rope operations, without
compromising safety. In addition, the KO-LINKs compact
ring design allows it to be used without causing damage
to the towing gear, tugs winches and deck.

The KO-LINK can be used with all types of synthetic rope, and is available for rope diameters from 54mm to 189mm,
covering the whole range of synthetic towing ropes.
The KO-LINK is an important addition to the Lankhorst Ropes range and will allow operators to reduce the cost of
towing operations. Lankhorst Ropes is committed to providing operators with high performance products backed by
our comprehensive through life Technology and Rope Service package. In so doing we enable operators to focus on

AEO Status Streamlines Rope Delivery


Lankhorst Ropes has been approved
as an Authorised Economic Operator
(AEO) by the Customs Administration
of The Netherlands. AEO status allows
Lankhorst to conduct part of the
customs procedures in-house, giving greater control over when
orders are dispatched for delivery.
The Authorised Economic Operator certificate is an internationally
recognised quality mark and acknowledges Lankhorsts secure role
in the international supply chain through compliant and efficient
customs controls and procedures.

Gaining AEO certification continues our commitment to bringing


customers the highest level of service. By handling most of the
customs procedures here in Lankhorst we have greater control over
when orders are despatched, enabling us to give customers a more
accurate delivery time.

Pre-tension service for Steel Wire Rope


Lankhorst Ropes now offers a spooler rental service for pre-tensioning steel wire
rope when installing onto a winch system. The tensioner rental also includes an
independent power supply and skilled operators who are professionally trained to
install the steel wire rope wherever the tensioner is needed.
Pre-tensioning rope when loading onto a winch is critical to ensuring longer
wire rope service life and safe operation. Its important to pre-tension to avoid
damaging the rope when it is first tensioned during lifting operations. Our pretensioner will ensure the wire rope is installed at the correct tension to prevent it
diving between the rope layers on the winch, commented Nico Jongkind, Sales
Director, Lankhorst Ropes -Steel Wire Ropes Offshore.
The tensioner allows pre-tensioning between 5 tonnes minimum to 100 tonnes
maximum, manually adjustable. With 1800 mm drum diameter and seven grooves,
it is suitable for rope up to 120 mm diameter tensioned. Additionally Lankhorst is
also able to supply a 40T spooler to handle the wire rope transport reel.

Increased reliability, stability and strength with SK78


Lankhorst Ropes has enhanced the performance of the LANKOFORCE rope with the
introduction of the latest high modulus polyethylene (HMPE) yarns from Dyneema. Using
the Dyneema SK78 fibers the rope has a better creep resistance and the most uniform fiber
thickness, resulting in a safe, well balanced high performance rope.
LANKOFORCE is widely used in maritime applications demanding high strength including
mooring, towing, salvage and lifting. The strength of the 12 strand braided LANKOFORCE
rope is comparable to conventional steel wire ropes. However, it weighs 7 times less than
conventional steel wire ropes making it easier to handle. SK78 has a maximum strength
rating of 35 cn/dtex compared with other HMPE yarns offering up to 30 cn/dtex.

Recycling scheme for retired maritime ropes


Ten years ago, as part of Lankhorst Ropes drive for greater sustainability, a rope recycling scheme was
established. Once Lankhorst high performance ropes have reached the end of their service life they can
be transformed into picnic tables, garden furniture and many more products. The recycling programme
is gradually growing in popularity and has already surpassed 120 metric tons material on a yearly
basis. It is an integral part of our sustainability policy and helps many of our partners enhance their
environmental policies.

Improved abrasion resistance


Lankhorst Ropes has developed two innovative abrasion resistant products, Challenger coating
for LANKOFORCE (R-9) towing ropes and Force Web Sleeve for hawser protection.
Challenger simultaneously improves abrasion resistance and makes the ropes easier to handle.
The LANKOFORCE Challenger coating is an alternative to the protective jacket normally used to
safeguard the rope during handling.
Where the rope is exposed to high levels of abrasion, Lankhorst Ropes has developed the Force Web Sleeve. The Sleeve is
constructed from Dyneema cloth resulting in an extremely abrasion resistant, lightweight and flexible rope cover. The flexible
sleeve is secured to the rope with Velcro and can be spooled directly onto the winch drum ready for use.

TIPTOTWELVE, available in
the diameter range of 16 mm
till 48 mm, is the successor of
the well-known TIPTOEIGHT.
The construction is different,
the material remains
the same. The 12-strand
braided construction makes
the rope rounder, more
stable, more compact and
more regular on the surface.
This increases the abrasion
resistance and the life-time
of the rope even more.
TIPTOTWELVE can be used
for mooring, using either
bollards and/or winches.
All TIPTOTWELVE coils will
be fitted with a quality
label, stating Original
product of Lankhorst Ropes.
TIPTOTWELVE ropes in the
range from 32 mm up to 48
mm have been upgraded
with an extra marker yarn.
The rope size can now easily
(and above all) without
mistake be identified.

A dedicated floating
winchline developed
especially to be used on
(self tensioning) winches.
The load-bearing
7-strand core combines
high strength and
relative low elongation.
The non load-bearing
braided jacket provides
protection to the core
(longer life-time) and
increases crew-safety by
minimizing the risk of
snap-back. The smooth
operation of the vessel is
increased by the ease of
handling of the rope due
to its low weight and the
floating characteristic of
the rope.

Mooring tail to provide


shock/energy absorbing
within the mooring
system. The EUROFLEX
Mooring Tails surpass
the nylon tails in quality,
the energy absorption is
better, the rope remains
elastic for a longer time
and the rope does not
lose a large portion of its
dry MBF when it is wet.
As the strength is higher
than that of nylon, a
smaller diameter of rope
can be used, providing
better handling. Made
of polyester and
polypropylene composite
yarns, the standard length
produced is 11m Effective
Working Length, with 2
protected eyes of 2,0m
and 1,0m respectively.

LANKOFORCE

12 strand braided rope, made of Dyneema yarns. This rope forms


an excellent alternative for heavy and lumbersome steelwire
ropes in situations requiring manual handling of the rope. The
strength is higher than that of conventional steelwire rope and
the corresponding weight is 7 times lower! The better handling
characteristics are especially appreciated in towing and mooring
applications. This rope is floating! When replacing fibre rope the
reduction in diameter can lead to substantial saving
of weight and size of e.g. the mooring winches, and
when incorporated in the design of the vessel at
newbuilding to a saving of cost as well.

overall jacket of polyester.
Typical applications
where LANKOTECH

When STRONGLINE is installed on a towing


winch, twists in the rope induced during
installation could reduce the life time of the rope
once put to work. It is crucial to use a turning
table for unwinding from a coil. To facilitate the
installation with respect to avoiding induced
twists, a longitudinal marking has been made to
the STRONGLINE from the factory. Please make
sure the longitudinal marking line is
always on the same position while winding up
the STRONGLINE on your towing winch.

STRONGLINE rope has a construction consisting of a


parallel core with a braided protective cover. The parallel
core results in a very high strength compared to the
diameter and material. The protective cover ensures a long
life-time of the rope due to its excellent resistance against
abrasion. Regular maintenance can lengthen the life-time
even more. The main application of this rope will be towing
and mooring.

A High Performance Protection Sleeve for
permanent fixing on a hawser, towing line
or pennant. The braided strands offer a high
abrasion resistance. The sleeve is made in a
hollow braid, the sleeve can therefore easily be
adjusted to the circumferential size of the rope to
be protected. The DEFENDER can be made from
different types of yarns, offering extra strength,
floatability and other characteristics. Please
consult our sales staff for the optimal product in
your application.

TIPTO AND FORCE WEB HAWSER PROTECTION SLEEVES


Hawser protection sleeve, easy to apply where and when
you need it. The use of this protection sleeve will drastically
improve the life-time of any of your mooring ropes. The
TIPTO and FORCE WEB sleeve can easily be wrapped around
the hawser at the exact spot where it is needed.

FORCE WEB
The FORCE WEB sleeves are made
out of Dyneema cloth, which is
extremely abrasion resistant, light
weighted and very flexible at the
same time. It is designed to be
used on rope sizes of 20 ~38 mm
diameter and is 3 meters long. The
sleeve will be folded around the
rope and secured by Velcro. This
version will not have any eyelets.
Because of its flexibility it can easily remain on the rope, in
case it is spooled on the winch drum. Ready to be used for
the next time mooring.

The TIPTO WEB sleeves are finished with a protective seam
all around, two large Velcro strips enable the sleeves to be
applied easily and to accommodate different diameters of
hawser, two eyelets, one on either side, enable the crew to
secure the sleeve in the right position on the hawser. The

KO-LINK

HARDWARE

KO-LINK
KO-LINK is a highly polished, light weight seawater
resistant aluminum ring, which is inserted and
attached to the spliced eye of the main tow line.
The ring connects this main towline and the
pennant by a LANKOFORCE (HMPE) seizing. The
advantage of such a connection is that a tow line
configuration overload protection is created. This
will avoid that the main towing rope as well as
the pennant will break, increasing the life time. In
addition to this, by using the KO-LINK there is no
need to use the common cow-hitch knot, which,
if poorly made, can cause unequal loading on
the eyes resulting in premature line failure. In the
event a cow hitched pennant parts, often the eye
of the main line gets distorted as well. This could
result in a total replacement of the whole towing
rope configuration.
The KO-LINK also makes it possible to replace
the pennant on an easy, quick and safe way.
By implementing the KO-LINK in your towing
configuration, it will reduce your cost per tow and
increase your safety on board.

GROOVES IN SHEAVES
Apart from the sheave diameter, the lifetime of a rope also depends on the design and dimensions of the groove. If the
groove is too narrow, the rope gets wedged in it, the strands and wires cannot move as is required for bending, and this
condition is detrimental to the life time of the rope. On the other hand, too wide a groove also has an adverse effect on
rope life time due to the high surface pressure between rope and sheave.
The adjacent graph clearly shows that a radius 5% larger than half the rope diameter will give the longest service life of
the rope. For traction sheaves the radius of the groove is usually adapted as closely as possible to the radius of the rope
to obtain maximum traction. The rope is supported in the best possible manner if the arc of contact with the groove
contour can be 150 deg. This corresponds to a throat angle of 30 degrees. However, with a large fleet angle or with
oscillating loads, the throat angle should be larger (till 60 degrees) to avoid undue wear of the rope and sheave flanges.
The height of the flanges should be at least 1,5 times the rope diameter to prevent the rope running off the sheave.

The rope and groove are inevitably subject to wear during operation. Since the diameter of a rope becomes smaller
due to abrasion and stretch, it will wear out the groove to the smaller diameter of the worn rope. If a new rope is laid in
such a worn groove, it will get wedged in the narrow groove and this will have a very adverse effect on its life. It is also
possible that the rope cuts its profile into the groove. Therefore the grooves should be inspected before installing a new
rope and if necessary they must be re-machined, preferably with a profile cutting tool. If a groove shows excessive wear,
this may be an indication that the sheave material is too soft. In this case a sheave of a harder grade steel must be used
which better resists the abrasive effect of the rope, or a larger diameter sheave should be taken.

When ropes are wound on drums, attention must be paid to the fleet angle, that is the included angle between the
rope running to or from the extreme left or right of the drum and an imaginary line drawn from the centre of the sheave
normal to the axis of the drum. When this angle is too large, the rope in this extreme position will be pressed with great
force against the flange of the sheave which causes undue friction and wear of both the rope and travel too fast from the
side to the centre of the drum thereby leaving gaps between the wraps. When winding a second layer, the rope is forced
into these gaps which results in serious deterioration. When, on the other hand, the rope is wound past the centre of the
drum, a too large fleet angle will cause the next wrap to scrub against the preceding wrap as the rope runs more towards
the side of the drum.
If the fleet angle is too small, the rope does not travel fast enough towards the centre of the drum and, apart from
scrubbing, at a certain moment the wraps will pile up i.e. the next wrap is laid on top of the preceding one and is then
pressed to the side of the preceding wrap with great force. This has a detrimental effect on the rope and the equipment
on which it is used (shock loads).
For plain faced drums a maximum fleet angle of 1 degree is recommended. For grooved drums this figure is 2 degrees
maximum. In terms of length these figures correspond to a minimum distance between sheave and drum of 40 x a
(a= half the drum width) for faced drums and minimum 30 x a for grooved drums (approximate values). Hence, for
a grooved drum, 1 metre in width, the distance between sheave and drum should be 30 x a = 15 metres minimum,
or conversely, if the distance between drum and sheave is 7 metres, the maximum drum width should be (7:30) x 2 =
approx. 47cm.

In case two sheaves are not in line,


attention must be paid to the fleet
angle. Depending on the construction a
maximum fleet angle is given:
- special non rotating (35x7) : 1 degree
- special multi strand
(8,9 and 10 strands) : 2 degrees
- 6 strand rope : 3 degrees
These values are approximate and based
on a throat angle of 45 degrees.

Installation of a wire rope on a plain (smooth) face drum requires a great deal of care. The starting position should be
at the correct drum flange so that each wrap of the rope will wind tightly against the preceding wrap (see figure). Here
too, close supervision should be maintained all during installation. This will help make certain that:
1) the rope is properly attached to the drum;
2) appropriate tension on the rope is maintained as it is wound to the drum;
3) each wrap is guided as close to the preceding wrap as possible, so that there are no gaps between turns;
4) and that there are at least two dead wraps on the drum when the rope is fully unwound during normal
operating cycles.
Loose and uneven winding on a plain (smooth) faced drum, can and usually does create excessive wear, crushing
and distortion of the rope. The results of such abuse are lower operating performance, and a reduction in the ropes
effective strength. Also, for an operation that is sensitive in terms of moving and spotting a load, the operator will
encounter control difficulties as the rope will pile up, pull into the pile and fall from the pile to the drum surface. The
ensuing shock can break or otherwise damage the rope.
The proper direction of winding the first layer on a smooth drum can be determined by standing behind the drum
and looking along the path of the rope travels, and then following one of the procedures illustrated in next figure. The
diagrams show: the correct relationship that should be maintained between the direction of lay of the rope (right of
left), the direction of rotation of the drum (over wind or under wind), winding from left to right or right to left.
By holding the right or left hand with index finger extended, palm up or palm down, the proper procedure for
applying left and right lay rope on a smooth drum can be easily determined.

SPLICE INSTRUCTIONS FOR TIPTOWINCHLINE

DESCRIPTION
This splice is made in a 7-strand rope with a cover-braided
jacket. The jacket has to be removed in two places.
Start with marking the rope. The first mark should be placed at
the end of the rope measuring back upwards for 45 times the
diameter, place a mark here. Then mark the length of the eye,
this part will stay on, and finally mark the splicing area,
which should cover a length of 35 times the diameter of the
rope.
Make sure the core is not damaged when removing the jacket.
Strip the jacket of the first marked area of the outer cover
(length approx. 45-times rope diameter) to expose the 7 strand
core. Tape each of the 7-strands to keep yarns together.
The part of the jacket covering the eye should remain in tacked.
Now strip the jacket of the splicing area (length approx. 35
times the rope diameter). Bend the rope to form the eye and
use tape or a whipping to keep the two rope parts
together at the start point of the splice.

For the first tuck use strand 1, being closed to the running part and which does not disturb
the rope construction. Tuck this strand under 3 strands (A,B,C) WITH the lay of the rope
(right hand lay).

Second strand tuck


Use strand no. 2 and tuck this one under two strands (A and B) WITH the lay of the rope.

Third strand tuck


Strand no. 3 has to be tucked under strand (A) WITH the lay of the rope.
The core is now released.

Fourth strand tuck


Strand no. 4 together with the core is tucked under one strand (F) WITH the lay of the rope.

Fifth strand tuck


Strand no. 5 is tucked under the following strand of the rope (E), WITH the lay of the rope.

Sixth strand tuck

COVERING THE SPLICE
First start with securing the jacket to the core. Stitch a large needle with thread through
the jacket and core. The ends of the thread must be tucked back into the splice. Do this at
both ends of the formed eye as well as the start of the jacket after the splice. Ensure that at
least 3 full tucks are made.
Now cover the splicing area with a whipping. Sometimes it is easier to first cover the
splicing area with tape before starting with the whipping.

Final preparation
An 8 strand rope consists out of 4 left hand lay (S) and 4 right hand lay (Z)
strands. Always keep the left (S) and right hand lay (Z) strands apart (S) by (S)
and (Z). Tape each individual strand at the end in order to avoid untwisting.
Then unlay the strands up to the point where the eye is formed and where the
seizing is placed.
Starting the splice
Tuck two S-lay strands under two Z-lay strands of the body of the splice;
Tuck the first Z-lay strand under the two preceding Z-lay strands of the body.
Tuck the second Z-lay strand only under the first Z-lay strand;
Tuck the third S-lay strand under the first S-lay strand of the body and tuck the
4th S-lay strand under the next S-lay strand of the body;
The third Z-lay strand is tucked under the outer Z-lay strand of the body and
the fourth Z-lay strand is tucked under the inner Z-lay strand of the body;
We are back to the first two S-lay strands. Tuck the first S-lay strand under the
outer S-lay strand of the body and tuck the second S-lay strand under the inner
S-lay strand of the body.
All strands have now been tucked into the right position. Make sure that S-lay
strands are tucked under S-lay strands of the body and that Z-lay strands are
tucked under the Z-lay strands of the body;
Continue with tucking two S-lay strands under S-lay strands and two Z-lay
strands under Z-lay strands of the body;
Turn the rope and continue by tucking two S under S and two Z under Z;

RECOMMENDATIONS ON TOWING LINES

Sufficient turns on the drum. The load on the towing line


should not be transferred to the fixing point of the dead end
of the rope on the drum. Depending the friction coefficient, a
minimum number of turns will be required on the drum. For
LANKOFORCE ropes (HMPE) the minimum is 10 full turns, on
EUROFLEX and STRONGLINE (polyester based) a minimum of
6 should be respected.
Back tensioning. The first time the rope is being spooled
on the drum, this must be done with back tensioning on the
rope. A load of 5-10% of the MBF should be sufficient. This will
prevent slipping of the rope (due to elongation properties in
the rope) and it will prevent the rope to burry into lower layers
on the drum. (See picture 1)
Twist in the rope. Unwind the new coil of rope from a turn
table or from an elevated pallet connected to a crane wire with
a turnbuckle. The rope should be installed onto the winch drum
without any twists in the rope. Please note that 2 turns in 1
meter of NEW rope, will result in a loss of MBF of easily 10% on
a twelve strand rope and up to 25% in an eight strand rope.
(See picture 2+3)
Cow Hitch. Synthetic ropes can be connected to each other by
means of a cow hitch. Tie a small rope or a webbing sling into
the eyes to facilitate taking the cow hitch apart in a later stage.
In case of using a grommet the ABF will reduce. (See picture 4)
Smooth path for the ropes. Prepare the vessel in such way
that all the contact points with the rope are as smooth as
possible. Polished stainless steel plating is commonly applied.
Low friction will minimize the abrasion on the rope and will
reduce heat generation. (See picture 5)
Repairs on a jacket. Ropes with a non-load-bearing jacket
should be repaired once the jacket has been damaged.
Preferably with a thin line, that has good abrasion resistance
and that has good elongation properties (polyester / nylon).

KO-LINK LASHING, CALCULATION,


SEIZING AND SECURING INSTRUCTIONS

INFORMATION

Main purpose for using KO-LINK connector is to prevent the HMPE rope from cutting through the synthetic tow
line / stretcher, and create a weak link between synthetic tow line / stretcher and HMPE pennant.
How to use
Choose type of KO-LINK to match the ropes to fit to (see technical data sheet H-16). Mount the KO-LINK into the eye of
towline / stretcher and fix it with small lashing to the eye. Connect the towline or stretcher with lashing through the
inner hotle of the KO-LINK, to the eye of the pennant (see figure 1 to 26).

Lashing
Best rope to use for lashing is LANKOFORCE
(R-9), with a working length of approx. 6 till 8m.
(depending on link type). One plain end, the
other end an eye of 15cm. The rope diameter
used for lashing and creating the weak link is
depending on the break load of the pennant and
towline / stretcher. First make three reevings.
Only at the last reeving pull the plain end through
the eye. To secure the lashing, use the special
knot (see illustrations to the right).

When the lashing and knot are installed, tension


up the lashing, so the special knot can settle
down. After this is done, tie a single knot behind it
(see figure B) and cut off excess material.
The lashing is now finished (see figure C).

Calculation example
A towline with a MBL of 280 Mt should have a
weak link at least 30% below MBL of rope. The
lashing for connection should thus have a MBL
of 196 Mt. A LANKOFORCE rope diameter 24mm
has a spliced MBL of 48,9 Mt. We have 3 windings
around the KO-Link secured with the lashing knot
as prescribed above.

Step 1: Mark position of seizing


Place the KO-LINK into the bearing point of the eye and make
mark A ( 1x KO-LINK length).
Shift the KO-LINK to the inside of the eye and make mark B
(so totally 1 x KO-LINK length).
Place the KO-LINK back into the bearing point of the eye and tie the
legs together at mark B, ensure that the securing hole of the KO-LINK
is positioned in the middle and inside of the eye (figure 3).

Weight, length and diameter are measured in accordance with EN 919. The breaking force of new, unused synthetic
ropes, both standard and high performance, are in accordance with EN 919. All data in this brochure is provided for
technical reference and guidance only, it does not constitute a guarantee. Lankhorst Ropes reserves the right to amend
details of their specification in line with technical developments. For calculation purposes customers should consult
the salespeople of Lankhorst in-depth and up to date technical details.
It can be expected that the strength of the rope will decrease from the moment it is taken into service. At any time
avoid using ropes that show signs of wear and abrasion. If in doubt contact the salespeople of Lankhorst Ropes. We
recommend taking the rope out of usage until possible repairs have been made or the rope has been rejected.
Joints and knots can cause loss of strength, in extreme cases up to 50%. When ropes are running over pulleys or
sheaves, one also should take care of proper D/d ratios as well as grooves. If in doubt about any of the mentioned
actions, please contact our salespeople for details.
CONSTRUCTIONS
3 and 4 strand
3 and 4 strand hawser laid constructions are easy to splice and have an excellent abrasion resistance.
8 strand plaited
A 100% torque balanced rope due to the 4 left and 4 right hand lay constructed strands.
This construction does not kink, is easy to terminate and has a great abrasion resistance.
12 strand plaited
A 100% torque balanced rope due to the 6 left and 6 right hand lay constructed strands.
This construction does not kink, is easy to terminate and has a great abrasion resistance.
Cover braids
Cover braided constructions can be offered with a variety of cores. In most cases the jacket (cover) does not contribute
to the ropes strength. The non load bearing jacket provides a protection to the ropes core, this being the strength
member. If the jacket is damaged, this does not automatically mean loss of strength. The larger sizes of cover braids
especially, will retain their breaking strength even if the jacket is completely abraded. Our cover braids offer maximum
strength at a minimal diameter and thus weight.
Extruded jackets
Extruded jackets can be provided upon request depending upon the application. However for certain application they
are provided as standard, like for instance our tower guys (HPTG). In order to provide a die-electric strength member
the rope core is surrounded by an abrasion and UV resistant, water proof jacket. Extruded jackets (PP,PE,PA,PUR)
normally provide a more abrasion resistant cover, but restrain the ropes use due to less flexibility (higher stiffness).
Specialities
Many varieties on above constructions can be provided. Plaited cores with braided jackets as well as extruded jackets
can be supplied if the application demands a special design. Lankhorst Ropes is not only able to design a rope, but is
also able to engineer specialty terminations suited for your needs.

a) A wire rope that is repeatedly bended over sheaves will show fatigue breaks
in individual wires. The breaks are square and can be seen on the picture
alongside. This type of damage is related to items 2, 3, 6, 7, 10 and 11 in above
drawing.

When sheaves are too small and heavy loads are applied, the wire rope
could be heavily damaged.
Of most importance is to observe the rate of breaking of wires, a high rate
indicates the wire rope will have to be replaced soon.

b) Corrosion can be both internal and external. Reduction in diameter could


be compensated by build up of rust. It is of utmost importance
to examine the wire rope internally as well. Corrosion may result that the
shape of the wire rope is flattened because the core no longer
supports the outer strands. With severe corrosion, the wire rope should be
replaced (related to items 4,7,9 and 12 in drawing on page I-18).

c) Sharp objects (related to items 1, 2, 5, 8 in drawing on page I-18) can damage the wire rope as shown. When the strands are damaged accordingly,
the wire rope needs to be replaced. This type of damage can be avoided
by adjusting proper bending radius.

d) The core of a wire rope will be protruded when a shock load is applied
to the wire rope. The wire rope can no longer be used (related to items 5
and 8 in drawing on page I-18).

e) Wear of the wire rope can be determined by measuring the diameter


(related to items 3, 6, 8, 9, 11 in drawing on page I-18).
When reduction in diameter by internal exceeds 3% for non rotating
wire ropes and 10% for other wire ropes, the wire rope shall be replaced.
Even if no broken wires are visible.
Wear is promoted by a lack of lubrication. Even if no broken wires are
visible, but the decrease in diameter exceeds 7%, the wire rope has to be
replaced.

f ) When the wire rope went over the edge of a sheave,it is applied to a
sharp bending (related to items 6, 8, 10, 11in drawing on page I-18). This
can be prooved when the individual wires are examined and ar either
broken as cup-cone breaks or shear breaks.
g) Drum crushing results in a flattened wire rope. This is caused when the
load applied to wind the wire rope is too high, the drum is too small or
when multiple layered winding (related to items 1 and 2 in drawing on
page I-18).

FIBRE ROPE INSPECTION AND RETIREMENT CRITERIA

INTERNAL WEAR(DIRT AND GRIT)


Where ropes have been used in a gritty environment, sharp grit may penetrate into their centre. It is important to open
the rope and examine between the strands to establish whether such damage is occurring. This examination must be
undertaken very carefully to prevent buckling and distortion of the strands which may itself cause trouble at a later date.
The presence of large quantities of fibre dust in the centre of the rope indicates that a replacement may be due. Oil and
grease deposits by themselves do not damage most rope materials. However they do trap dirt and grit and may make
the rope difficult or unpleasant to handle.
EXTERNAL WEAR
Some types of ropes will develop a fur or pile on their surface as the result of dragging over rough surfaces. This is
quite normal and will not cause weakening of the rope to any significant extent. Excessive wear is indicated by a major
proportion of the cross sections of the yarns on the outside of the rope being removed. Such wear usually is seen most
clearly on the strand crowns, on the inside of eye splices, in particular underneath a rope thimble, if incorporated.
MECHANICAL DAMAGE
Although most external abrasion is localized, mechanical damage will always weaken a rope. The weakening will depend
upon the severity of the damage. It must be remembered that mechanical damage, especially chafing, will always have a
more drastic effect on smaller ropes than on the larger ropes.
CUTS
Cuts require close examination to establish their depth, and hence how much of the ropes cross section has been
damaged. For jacketed ropes where the jacket is not load baring(e.g. Tipto-Winchline), a cut that does not damage the
core will probably not affect the strength. However core deformation or herniation could occur on subsequent use if
the jacket is not repaired. Also, cuts to jackets may cause adverse effects such as handling difficulties, inability to slide
through fittings smoothly and exposing the core to grit.
FLEX FATIGUE PULLEYS, ROLLERS, CHOCKS, FAIRLEADS
Constant bending of any type of rope causes internal and external fiber abrasion. This is frequently caused by running
over pulleys. But other types of flexing such as frequent bending over a small radius surface(chock/fairlead) can also
cause fatigue damage. Flexing over fixed surfaces is often accompanied by surface wear, especially if sliding action is also
present. Wear will appear on the surface of the contact area. The fibers will become matted on the surface and/or glazed
from heat build-up.
HOCKLE, TWIST OR CORKSCREW
If too much twist is introduced into a hawser laid rope it will tend to hockle(kink). Hockles that can not be turned back
easily to restore the ropes integrity indicate severe damage. The same applies for the opposite, corkscrews, when
restoring the rope back into its original structure is difficult or impossible the rope should be taken out of service.
Braided and plaited ropes should not display any twist and these ropes should not be used unless restored to normal
appearance.
CHEMICAL ATTACK
Deterioration of cordage by chemicals is usually not the result of the rope having been contaminated by a chemical
foreseen by the user. That is to say, ropes, which are used in known chemical environments usually, are supplied in
a quality to offer the highest resistance to the conditions. Rather, frequently contamination occurs by accident from
chemicals whose presence was not foreseen.

INSPECTION OF CORDAGE
Before a length of rope is issued for use, the entire length, including eye splices and/or long splices should be inspected
by a competent person. This examination should be undertaken to check the following:

SUNLIGHT DAMAGE
Ultra-violet radiation from sunlight can cause brittle, weak outer rope yarns in polyolefin lines and strength
deterioration in ropes from some other fibres.

INFORMATION

THERMAL DAMAGE
Friction of synthetic fibre ropes under high tension while rendering around bitts and winches, or while going through
fairleads, can generate enough heat to melt or fuse fibres, yarns or strands together.
The examination should determine whether any areas of fusion or carbonisation are present. If in doubt discard the
rope.
WETTING
Natural fibre ropes when wet or damp should not be left on the ground as in this way the germs of rot start. Also
particles of grit are picked up. Man-made fibre ropes although not affected by wet or damp are nevertheless liable to
damage by particles of grit. All wet ropes should be hung up in freely circulating air and allowed to dry naturally. If this
cannot be done the ropes should be loosely stacked on pieces of timber or any other suitable substance, clear of damp
ground or sweating concrete. Coils of new rope should be stacked in a similar manner. On no account should ropes be
dried by any form of heat.
MILDEW
Mildew does not attack man-made fibres although surface contamination may, under certain circumstances, provide a
nutrient, which permits the growth of moulds. Whilst these are unpleasant, they do not affect the strength of the rope.
They may be removed by washing in water. The use of harsh detergents should be avoided. Mildew will attack natural
fibre cordage if it is stored wet in stagnant air. The mould will live on the cellulose of the rope and in consequence a loss
of strength will inevitably occur.
ACCEPTANCE OR REJECTION
Reaching a decision on whether the cordage is, or is not, fit for further use must be based on the conditions of the
cordage, and what defects have been observed during the examination. The examination must only be undertaken by
someone who is competent. In forming a decision, the examiner should adopt a fail-safe policy. If there is any doubt
that the cordage may not sustain the stresses, which it is likely to have to bear, then it must not be used.
Rope/yarn damage regardless of the percentage leads to strength loss. The attached discard criteria may describe
a certain percentage after which the rope should be rejected. This percentage is valid for ropes in general service.
For ropes used in critical applications the retirement criteria should be determined in cooperation between user and
Lankhorst Ropes and will/can vary upon application.
Preferably a sample should be taken from the rope in order to determine the actual residual breaking strength of the
rope. When this is not possible the attached criteria should be used in order to determine whether or not the rope
should be taken out of service. In practice it has proven to be very difficult to estimate strength loss based upon visual
inspection alone. The visual examination should therefore be carried out very conservatively.

Finally, the user must take notice of the fact that even carefully used ropes will wear out if they receive sufficient use,
and care should be taken to withdraw them from service before this time is reached rather than allowing them to
continue in use until they fail.

1.1. All offers from, orders to, contracts with and deliveries
by Koninklijke Lankhorst-Euronete group B.V. and/or its
group companies, hereinafter: we or us, will be governed
exclusively by these terms and conditions. In these terms
and conditions group companies shall mean all companies
over which Koninklijke Lankhorst-Euronete group B.V. has
direct or indirect control and/or any company that is in any
way affiliated with Koninklijke Lankhorst-Euronete group
B.V., including Lankhorst Sneek B.V., WireCo Crane Center B.V.,
Lankhorst Touwfabrieken B.V., Lankhorst Pure Composites B.V.,
Lankhorst Engineered Products B.V, and Ekon B.V.
1.2. Any stipulations deviating from these terms and
conditions will apply only if and insofar as we have accepted
them explicitly and in writing. Such deviations from these
terms and conditions will apply only to the contract in
question.
1.3. The application of any general terms and conditions used
by the other party is explicitly excluded.
1.4. In these terms and conditions, other party means any
natural or legal person that has concluded or wishes to
conclude a contract with our business and, besides the latter,
their representative(s), attorney(s), assignee(s) and heirs.
1.5. These terms and conditions apply to the existing contract
between us and the other party. Unless otherwise agreed,
these terms and conditions shall also apply to subsequent
contracts between us and the other party.
1.6. We reserve the right, at our sole discretion, to change,
modify or otherwise alter these terms and conditions at any
time.
Article 2: Offers
2.1. All offers made will remain valid for a period specified by
us. In the absence of such a period, our offers will be free of
obligation.
2.2. All price lists, brochures, illustrations and other information
provided with an offer will be binding on us only if this is
explicitly confirmed in writing. We will not be required to
provide detailed information unless agreed otherwise in
writing.
2.3. Sending offers and/or (other) documentation will not
obligate us to deliver or accept the order.
2.4. We reserve the right to refuse orders without stating
reasons or to deliver subject to collect on delivery.
Article 3: Contract
3.1. Subject to the stipulations below, a contract will be
concluded with us only after we have received an offer signed
by the other party for approval or, if an offer approved in
writing is not used, we have accepted the order in writing. The
offer or order confirmation will be deemed to represent the
contract accurately and completely.
3.2. Any agreements or changes made later, as well as (oral)
agreements and/or commitments by our employees or made
on our behalf by our salespeople, agents, representatives or
other intermediaries will be binding on us only in and insofar
as they have been confirmed by us in writing by a person
authorized to do so. The costs we incur to execute the original
order will be at the other partys expense and risk.
3.3. For work for which, due to its nature and scope, no offers
or order confirmations are sent, the contract will be deemed
to have been concluded at the time we have actually started
to carry out the work. The invoice will be deemed to represent
the contract accurately and completely.
3.4. We will enter into all contracts under the condition
precedent that the other party - exclusively at our discretion proves to be sufficiently creditworthy to perform the contract.
3.5. We will be entitled upon or after entering
into the contract, prior to performing the contract (further),
to require security from the other party that will settle the
payment as well as other obligations.
3.6. We will be entitled - if we consider this necessary or
desirable - to engage others to ensure the proper performance
of the contract. The costs of such engagement will be passed
on to the other party in accordance with the quotation
provided. If possible and/or necessary, we will consult with the
other party about this.
Article 4: Prices
4.1. Unless stated otherwise, all quotations will be made
subject to price adjustment.
4.2. Unless stated otherwise, our prices are:
- based on the level of the purchase price, wages, wage costs,
social insurance and government charges, freight charges,
insurance premiums and other costs during the offer or on the
date of the order;
- based on delivery from our factory warehouse or other
storage place (Incoterm EXW);
- exclusive of VAT, import duties, other taxes, levies and
charges;
- exclusive of the costs of packaging, loading and unloading,
transportation and insurance;
- expressed in Euros (); any changes in exchange rates will
be passed on.
4.3. In case one or more of the cost price factors are increased,
we will be entitled to adjust the order price accordingly, with
due observance of any existing, relevant statutory provisions.
Future price increases already known must, however, be stated
when the order is confirmed. If such an increase occurs within
3 months after the contract is concluded, the other party
will be entitled to rescind the contract within a reasonable
period, subject to payment of reasonable compensation
of the costs directly incurred by us in connection with the
contract. If we have already manufactured goods before timely
cancelation, the other party will still be obligated, if we so
desire, to purchase the goods at the prices applicable prior
to the increase.
Article 5: Protection of rights
5.1. The offers and/or catalogs and/or drawings etc. we have
made available, as well the appendices which could be the
subject of any intellectual and/or industrial property right or
equivalent right will remain our property. Without our written
permission, these documents may not be copied, made
available to third parties for inspection or used in any other
way than agreed. They must be returned to us immediately
on request.
5.2. In case goods are manufactured according to drawings,
designs, samples or other instructions in the broadest sense,
received from the other party, the other party must fully
warrant that the manufacture and/or delivery of these articles
will not infringe any trademark, patent, utility or commercial

model or any other right of third parties. The other party


must indemnify us with respect to all claims of any third party
whatsoever.
Article 6: Delivery and delivery time
6.1. The most recent provisions of the Incoterms will apply
insofar as they do not depart from these general terms and
conditions. The offer and/or order confirmation will contain
the Incoterm preferred by us. If no Incoterm is contained in
the offer and/or order confirmation, delivery will be made ex
works (Incoterm EXW). The time of delivery will be the time
the articles are ready for transportation to the other party or
placed at the other partys disposal on our premises.
6.2. The other party must check the goods delivered and the
packaging immediately upon delivery for any shortages or
damage, or carry out this check after notification from us that
the articles are at the other partys disposal.
6.3. We reserve the right to make partial deliveries. In such a
case, each delivery will be considered a separate transaction.
Partial deliveries may be invoiced separately. The other party
must pay in accordance with Article 13 of these terms and
conditions.
6.4. On-call delivery must be called up and purchased within
the agreed time. The other party will be in default through the
mere expiration of an on-call period and we will have the right
to rescind the contract or not, or to send the goods.
6.5. The statement of the delivery time will always be made by
approximation, unless explicitly agreed otherwise. Exceeding
a delivery time will not obligate us to pay compensation. The
other party will not be entitled to additional or substitute
compensation or nonperformance or suspension of any
obligation arising for him from the contract. Nor will the other
party be entitled to rescind or terminate the contract in that
case. If we exceed the delivery time for reasons other than
those referred to in paragraph 6.6. of this article, the other
party will have the right to set a new delivery time for us in
writing. If we do not observe it, the other party will be entitled
to rescind the contract, insofar as not yet performed, by giving
notice in writing. In that case as well, the other party will not
be entitled to compensation of any loss he has suffered.
6.6. The delivery time will be extended at any rate by the
duration of the period in which force majeure or actions of the
other party, imputable or not, cause delay in the delivery. In
case the delay in delivery time is caused by actions of the other
party, we will be entitled to rescind the contract.
6.7. The other party must take delivery of the goods as soon
as we present them. All costs and losses we incur owing to
failure by the other party to purchase (part of ) the articles he
has ordered will be at the expense and risk of the other party,
including storage costs.
Article 7: Carriage/Risk
7.1. The manner of carriage, if and insofar as we provide for
this, shipping, packing and
suchlike, if the other party has not provided us with
instructions to that effect, will be determined by us with due
care, without us bearing any liability for this, except in case
of intent or deliberate recklessness Any specific wishes of the
other party regarding transportation/dispatch will be met
only if the other party states that it will bear the (additional)
costs thereof.
7.2. Articles will always be shipped at the expense and risk of
the other party, even if delivery free domicile has been agreed,
in that case even if the carrier demands that the clause be
included on consignment notes, road waybills and suchlike
that all transport damage will be as the shippers expense
and risk.
Article 8: Force majeure (Non-attributable failures)
8.1. Force majeure will exist on our part if the performance
of the contract is prevented wholly or partially - temporarily
or not - by circumstances beyond our control, and owing to
which the other party can no longer reasonably require us
to perform the contract. Force majeure is considered to be,
among other things: strikes, excessive sickness absence of our
employees, transport difficulties, fire, government measures
including at any rate import and export bans, quota systems
and business interruptions at us or at our suppliers, involuntary
interruptions or obstacles which make performance of the
contract more expensive and/or more onerous, such as storm
damage and/or other natural disasters, as well as default by
our suppliers owing to which we are unable or no longer able
to fulfill our obligations to the other party.
8.2. In case force majeure lasts longer than 30 days, both
parties will be entitled to suspend performance of the contract
wholly or in part, regarding the part to which the force
majeure relates, or to rescind the contract wholly or in part by
means of a written statement, without being obligated to pay
compensation on any basis. Consultations will be held with
the other party.
8.3. We are entitled to demand payment for the goods or
services delivered in performing the contract before the
circumstances causing the force majeure occurred.
8.4. We will also have the right to rely on force majeure if the
circumstance constituting the force majeure occurs after we
should have delivered our goods or services.
Article 9: Liability
9.1. Our liability in all cases, both contractual and under laws
and/or regulations, will be limited to the amount paid by our
liability insurance, plus the amount of the deductible which
according to the policy conditions is not payable by insurers.
9.2. If the insurer fails to pay in any case and/or the loss is not
covered by the insurance, we will be liable only for the direct
loss that can be attributed to us. Direct loss means only:
a. reasonable costs to determine the cause and extent of the
loss, in so far as such determination relates to loss within the
meaning of these terms and conditions;
b. any reasonable costs necessary to allow us to remedy the
faulty performance of the contract;
c. reasonable costs incurred to limit loss, insofar as the other
party demonstrates that these costs have resulted in limiting
of the
direct loss referred to in these general terms and conditions.
Our liability for other loss, such as indirect loss, which includes,
but is not limited to, consequential loss, business loss, loss due
to lost sales and/or lost profits, missed goodwill, damage to
assets and loss due to business interruption, including work
stoppage, is excluded.
9.3. Except in case of intent or deliberate recklessness of our
company management, our liability for the direct loss referred
to in 9.2 will be limited to an amount equal to 50% of the
invoice value relating to the faulty articles which caused the
loss. In case of partial delivery, we will be liable to compensate

50% at most of the relevant part of the invoice.


9.4. If the insurer does not pay and/or the insurance does not
cover the loss, our total liability for loss due to death or bodily
injury will be limited to a sum of 500,000 per event, whereby
a series of related events will count as one event.
9.5. We will not be liable for damage that might be done to
any good on which we have performed, are performing or
will perform work, nor for what the good contains or forms
part thereof, irrespective of whether that damage is caused
by persons employed by our company or by persons we have
engaged in a different way. Nor will it matter whether the
good is located on our premises or elsewhere.
9.6. Liability limiting, excluding or determining terms and
conditions which third parties can rely on against us may also
be relied upon by us against the other party.
9.7. For the rest, any claim against us will lapse by the mere
elapse of a period of one year after that claim arose, unless
a legal action is brought against us in relation to that claim
before that period expires.
9.8. All defenses we can derive from the contract concluded
with the other party to defend us against our liability may be
relied on by our employees and third parties engaged by us
in performing the contract with respect to the other party, as
if the employees and third parties were themselves parties to
the contract.
9.9. The other party must indemnify us, our employees or
persons put to work by us or on our behalf, for all claims
of third parties for compensation of any loss suffered by
those third parties, caused by or otherwise related to goods
originating from us.
Article 10: Complaints
10.1 Complaints mean all complaints from the other party in
relation to the soundness of the deliveries.
10.2. Complaints relating to externally observable defects
(shortages or damage) of the delivered goods and/or the
packaging must be made in writing within 8 days of delivery
of the goods as referred to in Article 6. Complaints relating to
defects which are not externally observable must be made
in writing as soon as possible after they are discovered, but
at any rate within 6 months from delivery of the goods by
us as referred to in Article 6, with a precise statement of the
nature and grounds of the complaints. Complaints about
invoices must be submitted within 8 days after the date on
which the invoices were sent. If the above-mentioned periods
are exceeded, any claim against us in relation to the defects
will lapse.
10.3. After the aforementioned period expires, the other party
will be deemed to have approved the goods delivered or the
invoice. At that time, we will no longer handle complaints.
Goods about which complaints are made must remain
undisturbed in the condition they were in at delivery until we
have investigated the complaint.
10.4. If we consider the complaint well-founded, we will only
be required, at our discretion, to replace or repair the faulty
goods, without prejudice to the general limitation of our
liability set out herein in article 9.
10.5. Submitting a complaint will never release the other party
from his payment obligations with respect to us, nor give the
other party a right to setoff.
10.6. Return of the goods delivered is possible only after our
prior, written permission, on terms to be set by us.
10.7. Returned goods sent back must be packed in their
original packaging. In addition to the original packaging and a
consignment note, the goods returned must be provided with
the return slip issued by us. Goods without a return slip issued
by us must be rejected.
10.8. Minor deviations in quality, color, length and thickness,
which are technically unavoidable, or are generally allowed
according to commercial customs, cannot constitute a basis
for complaints. In case of an offer or delivery according to a
sample, the sample will count only to determine the average
property. The quantity to be delivered by us will be allowed
to exceed the quantity agreed with the purchaser by 5%
and must be accepted by the purchaser. Information and
illustrations from official lists, brochures and suchlike do not
give entitlement to delivery according to that information, nor
may compensation be claimed in that regard.
Article 11: Warranty
11.1. Unless explicitly agreed otherwise, we will not provide a
warranty for the (parts of ) articles manufactured by us.
11.2. The warranty for (parts of ) articles we have not
manufactured ourselves, but which are delivered and installed
by us, will be limited to the warranty we receive from our
supplier.
11.3. Without prejudice to the general limitation of our liability
set out herein in article 9, the warranty will not in any case go
beyond repair of the defects occurring in the goods delivered
free of charge or free delivery of new parts. We will never be
liable for any loss suffered by the client and/or customer as a
result of this.
11.4. If the other party fails to fulfill his obligations under the
contract concluded with us, or fails to fulfill them on time, any
right to warranty will lapse.
Article 12:
(Extended) Retention of Title
12.1. The title to the goods delivered by us (and any goods
redelivered and resold by us) will be remain vested in us and
will pass to the other party only after payment in full by the
other of everything we have to claim from the other party on
any basis, including interest and costs and any damages.
12.2. If the goods delivered are processed, treated or mixed by
or at the other party, we will acquire a co-ownership right in
the newly produced good or goods and/or the good or
goods combined with the good or goods delivered or the
principal good, for the value of the (original) goods delivered
by us.
12.3. In case of non-payment of a due and payable amount,
suspension of payment, application for suspension of
payment, bankruptcy, placement under conservatorship,
death or liquidation of assets of the other party or if we fear
that the other party will fail to fulfill his obligations, we will
have the right without notice of default and without judicial
intervention to cancel the order or the part of the order that
still has to be delivered and to reclaim any goods delivered
but not yet paid or not yet paid in full as our property, with
deduction of any amounts already paid, without prejudice to
our right to demand compensation for any loss or damage. In
those cases, all claims we
have against the other party will be immediately due and
payable at once.

12.4. The other party will not be entitled to alienate the


goods subject to retention of title or to grant third parties
any restricted right in them. The goods may not be used as
collateral, nor may they serve as security for a third-party
claim. The other party will, however, be entitled to sell the
goods and transfer the goods subject to retention of title in
the context of the normal business operations of his company.
If the goods are sold on credit, the other party must stipulate
retention of title from his customers on the basis of the
provisions of this article. If the other party alienates the goods
or grants third parties any right in them, if such a situation
occurs, the other party hereby establishes an undisclosed
pledge on all rights and claims he acquired upon (through)
the sale of these goods with respect to those third parties, as
security for settlement by the other party of everything we still
have to claim from the other party at the time that pledge is
established. At any rate, if necessary and as soon as possible,
the other party must cooperate in establishing and registering
this undisclosed pledge.
12.5. The other party must store the goods delivered under
retention of title with the necessary care as recognizable
property of us. The other party must insure and keep the
goods insured for the duration of the retention of title against
fire and water damage, as well as against theft, and allow us to
inspect the policy of this insurance immediately on request.
Article 13: Payment
13.1. Unless otherwise agreed in writing, payment must be
made within 30 days from the invoice date, without deduction
or setoff. Payment must be made either in cash or into one
of our bank accounts. The value date stated on our bank
statements will be decisive and will therefore be considered
the payment date.
13.2. Each payment by the other party will serve primarily to
settle the interest owed by him as well as the collection costs
and/or administrative costs we have incurred, and will then be
deducted from the longest outstanding claim.
13.3. If the other party exceeds an agreed payment period or
the general payment period, the volume discounts granted
to the other party on the invoice will lapse and he will be in
default by operation of law, without any prior notice of default
being required. As of the date on which the other party is in
default of payment, all other claims we have against the other
party will be due and payable and the default will immediately
apply to those claims as well without notice of default.
13.4. In case the other party:
a. is adjudicated bankrupt, assigns his estate or assets, submits
an application for suspension of payment or all or part of his
property is attached;
b. dies or is placed in conservatorship;
c. fails to comply with any obligation to which he is subject
pursuant to the law or these terms and conditions;
d. fails to pay an invoice amount or part thereof within the
period set to do so;
e. discontinues or transfers his business or a contributes a
major part of his business to a company to be formed or an
already existing company, or changes the purposes of his
business, the mere occurrence of one of the aforementioned
circumstances will give us the right either to consider the
contract rescinded without any judicial intervention being
required, or to demand in its entirety any amount due from the
other party on the basis of work performed and/or deliveries
by us immediately without any warning or notice of default
being required, all this without prejudice to our right to
compensation of costs, damages and interest.
13.5. We will be entitled at all times to set off our claim against
the other party against that which we owe the other party now
or in the future. Disputes of any nature whatsoever will not
give the other party the right to postpone the payment.
Article 14: Interest and costs
14.1. As of the day on which the other party is in default of
payment to us, the other party will owe us default interest on
all amounts due at a rate of 1.5% per month or part of a month
as long as his default on payment
continues.
14.2. All judicial and extrajudicial costs to be incurred will be
payable by the other party. The extrajudicial costs will amount
to at least 15% of the amount due from the other party,
including the aforementioned interest.
Article 15: Compliance
15.1 The other party has the obligation to make itself
familiar with and shall fully comply with all applicable laws,
regulations, rules, and other requirements of any applicable
governmental body in connection with the purchase, receipt,
use, transfer and disposal of the goods.
15.2 All applicable import and export control laws, regulations,
orders and requirements, including without limitation those
of the jurisdictions in which we are or the other party is
established or from which the goods may be supplied, will
apply to the receipt and use of the goods. In no event shall
the other party use, transfer, release, import, export, re-export,
divert, or transship the goods in violation of such applicable
laws, regulations, orders or requirements.
15.3 If the other party imports or exports the goods in
violation of any applicable law, regulation or rule, the other
party shall be solely responsible for any fines or penalties
imposed by competent authorities and shall indemnify and
hold us harmless for any fines, penalties, and costs (including
legal fees) incurred by us in connection with the other partys
violation.
Article 16: Applicable law
16.1. All our offers, contracts and the performance thereof are
governed exclusively by Dutch law. The applicability of the
Convention on Contracts for the International Sale of Goods,
Vienna, April 11, 1980, is explicitly excluded.
Article 17: Disputes
17.1. All disputes, including those which only one of the
parties considers as such, arising from or connected with the
contract to which these terms and conditions apply or these
terms and conditions themselves and their interpretation
or implementation, both factual and legal in nature, will be
settled by the Civil Court with competent jurisdiction in the
Netherlands.
17.2. In case of a difference of opinion on the contents and
purport of these general terms and conditions, the Dutch text
thereof will always be decisive.
