OF GERALDINE C. TUCAY
[Conducted and supervised by ATTY. EUGENE M. BALITANG in
their law office at 2/F Esmedina Building, National Road cor. San Jose
St., District IV, Bayombong, Nueva Vizcaya. The questions and answers
were conducted in the ilocano dialect, the language commonly known
to the witness and translated into English for purposes of this judicial
affidavit.]
ATTY. BALITANG: May it please the Honorable Court. The
testimony of the witness is being offered to prove that she is one of the
defendants in the above-entitled case; that she will reiterate their
averments in their answer to the complaint; that she will prove their
counter-claims and affirmative defenses as contained in their answer
and such other matters pertinent to the instant case.
The witness is answering the questions asked of her, fully
conscious that she does so under oath, and that she may face criminal
liability for false testimony or perjury.

graduate ken housewife laeng. [I am GERALDINE C. TUCAY, 45 years
old, a resident of Manggayang, Dupax del Sur, Nueva Vizcaya, high
school graduate and a plain housewife.]

3,340 square meters, iti suma total nan ket 6,340 sumurok kumurang;

[The first area is more or less 3,000 sq. meters which we redeemed
from Narcisa Gudoy in 1995; we expanded this and improved with an
additional 3,340 sq. meters, more or less, making a total of 6,340 sq.
meters, more or less; now we have bulldozed the surroundings so it will
be improved.]

that you redeemed the Gudoy Portion in 1995 from Narcisa Gudoy, how
much have you redeemed this portion?]
A: Twenty Thousand Pesos (P20,000.00) idi 1995 ket
nagpanayon pay ni nanang mi kanyami iti Fifteen Thousand Pesos
(P15,000.00) idi 1998 ket iti suma total na ket Thirty Five Thousand
Pesos (P35,000.00). [P20,000.00 in 1995 and our mother got an
additional P15,000.00 from us in 1998, making a total of P35,000.00.]

daytoy Gudoy Portion ken Increased Gudoy Portion nga adda kalawa
na 3,000 square meters iti umuna ken 3,340 square meters iti maudi?
[After you are paid, do you have any agreement with your mother
regarding these lots that we have referred to as Gudoy Portion and
Increased Gudoy Portion with an area of 3,000 sq. meters and 3,340
sq. meters, respectively?]
A: Iti tulagan mi manipud tawen 2005 ket dakami iti
mangtalon iti dagitoy nga daga ket ited mi iti share ni nanang me nga
one-third iti amin nga apiten mi wenno balor na nga one-third. [We
agreed since the year 2005 that we will till these lots and we will give
the 1/3 share of our mother from our harvests or give the 1/3 value
thereof.]

the 1/3 share of your mother since 2005 as you have agreed upon?]

Dominador Oliveros idi 2007 iti gatad nga P50,000.00 ket nagbingayan
mi kenni nanang ko daytoy nga gatad, P25,000.00 a sangkapada. Idi
2008 ket nagpanayon ni nanang ko iti P30,000.00 isu nga iti suma
total iti salda ket P80,000.00. [Yes, sir. The Gudoy Portion was
mortgaged to Mr. and Mrs. Dominador Oliveros in 2007 at the amount
of P50,000.00 and we divided this amount with my mother, P25,000.00
each. Then in 2008, my mother got an additional P30,000.00 from Mr.
Oliveros that is why the total mortgage is P80,000.00.]

P50,000.00. [Yes, sir. I have here the original Katulagan ti Salda
dated 05 December 2007 that we earlier entered into for the mortgage
of P50,000.00.]

here the Katulagan that we entered into on May 12, 2008 for the
additional P30,000.00 mortgage.]

ket adda pirma, nakin pirma ditoy? [Above the name Mr. & Mrs.
Petronila T. Catores is a signature, whose signature is this?]

Manipud iti daytoy nga gatad ket binayadan mi dyay P80,000.00 nga
salda kadagiti agasawa nga Oliveros. [No, sir. We transferred the
mortgage to spouses Nestor and Angelica Barroga in 2009 in the
amount of P100,000.00. Out of this sum, we paid the amount of
P80,000.00 mortgage to Spouses Oliveros.]

proof that you paid the amount of P80,000.00 to Spouses Oliveros?]

this document denominated as Katulagan is a handwritten proof of
receipt by Dominador Oliveros of the entire amount of P80,000.00 on
November 27, 2009.]

Pesos ket isu iti nayon nga P30,000.00 nga inala ni nanang ko
kadagiti agasawa nga Barroga idi September 30, 2010, ket iti suma
total iti salda ket P130,000.00. [This is the agreement we entered into
and signed with Spouses Barroga for the mortgage of the Gudoy
Portion earlier mortgaged to Spouses Oliveros. The notation here of
additional Thirty Thousand Pesos is the additional amount of
P30,000.00 that my mother got from Spouses Barroga on September
30, 2010, so the total mortgage is P130,000.00.]

ko, tig-P10,000.00 kami. [We divided the remaining P20,000.00 with
my mother at P10,000.00 each.]

adda ba bingay mo ditoy? [How about the additional P30,000.00 that
your mother got from Spouses Barroga on September 30, 2010, do you
have a share in this?]
A: Awan, sir. Inala amin ni nanang ko dyay buo nga
P30,000.00. [None, sir. My mother got the entire P30,000.00.]
25) Q: Daytoy ba nga salda nga P130,000.00 manipud kadagiti
agasawa nga Barroga ket haan pay nga nabayadan inggana itatta? [Is
the entire mortgage of P130,000.00 from Spouses Barroga still unpaid
to this day?]
A: Haan, sir. Binayadan mi dyay buo nga P130,000.00
kenni Mrs. Angelica Barroga idi March 16, 2011. [No, sir. We paid the
entire amount of P130,000.00 to Mrs. Angelica Barroga on March 16,
2011.]

A: Intuloy mi nga tinalon dyay Gudoy Portion ken intuloy mi
latta nga inted dyay 1/3 share ni nanang mi idyay Increased Gudoy
Portion. [We continued tilling the Gudoy Portion and continued giving
the 1/3 share of our mother from our harvest in the Increased Gudoy
Portion.]

manipud iti salda dyay Gudoy Portion? [All in all, how much cash did
your mother receive from the mortgages on the Gudoy Portion?]
A: Mapan nga P95,000.00 amin, sir; P55,000.00 amin
manipud kadagiti agasawa nga Oliveros ken P40,000.00 amin manipud
kadgiti agasawa nga Barroga. [A total of P95,000.00, sir; a total of
P55,000.00 from Spouses Oliveros and a total of P40,000.00 from
Spouses Barroga.]

Portion? [Do you have evidences to prove that you have been giving
the 1/3 share of your mother from the harvest in the Increased Gudoy
Portion?]
A: Awan ebidensya mi ta tinalek mi ket ngarud ta isuna iti
nanang mi. Ngem idi binayadan mi dyay buo nga P130,000.00
kadagiti agasawa nga Barroga idyay Gudoy Portion ket pinanunot mi
nga agpapirma iti kasuratan nga al-alaen na dyay 1/3 share na idyay
Increased Gudoy Portion ta naobserba mi nga sabali metten iti ugali na
ken ibagbaga na nga panawan mi dyay daga. Adda laeng duwa nga
resibo mi nga mangpaneknek nga inala ni nanang mi dyay 1/3 share
na. [We do not have evidences as we trusted her since she is our own
mother. But when we paid the entire amount of P130,000.00 to
Spouses Barroga on the Gudoy Portion, we decided to let our mother
sign receipts of her 1/3 share on the Increased Gudoy Portion as we
noticed that she is acting strange and asking us to vacate the lots. We
only have two (2) receipts evidencing receipt by our mother of her 1/3

from your sale of onions is a signature above the name Petronila
Catores, whose signature is this?]

the signature of my mother. I was present when she signed it.]
34) Q: Ken iti ngato iti nagan nga Glenn Peter Catores nga
kunana nga testigo, nakinpirma ditoy? [And above the name Glenn
Peter Catores purporting to be a Testigo, whose signature is this?]

A: Pirma dayta ni kabsat ko nga Glenn Peter. Addaak idi

pirmaan na. [It is the signature of my brother Glenn Peter. I was
present when he signed it.]

dated March 18, 2011 that witness brought out and identified be
marked as our Exhibit 5 for the defendants and the names and
signature above them of Petronila Catores and Glenn Peter Catores be

receipt by your mother of ten (10) cavans of rice grains (irik) is a name
Petronila Catores and signature above it, whose signature is it?]

signature of my mother. I was present when she signed it.]

dated April 23, 2011 that witness brought out and identified be marked
as our Exhibit 6 and the name and signature above it of Petronila
Catores be bracketed and marked as our Exhibit 6-A for the
defendants.

this case was filed in court, are there other offices that you discussed
this matter?]
A: Pinadas mi nga in-settle daytoy nga kaso idyay MARO
ken iti barangay lupon. [We tried to settled the matter before the
Municipal Agrarian Reform Officer (MARO) and before the Barangay
Lupon.]

that the matter was brought before the MARO, are you members of any
farmers or irrigators association?]
A: Ni lakay ko nga Ronald Tucay ket myembro iti GabutMangayang Irrigation Association. Adda duwa nga sertifikasyon nga
naaramid idi July 1, 2013 ken July 4, 2013 nga mangpaneknek ditoy.
[My husband, Ronald Tucay, is a member of the Gabut-Mangayang
Irrigation Association. I have here two (2) certifications dated July 1,
2013 and July 2, 2013 as proof of it.] **[Witness brought out two (2)
documents denominated as Certification of Membership dated July 1,
2013 and Certification of the Office of the BARC Chairman dated July 4,
2013]

apay awan settlement yu idyay? [You said that the matter was brought
to the barangay lupon, was there no settlement thereat?]
A: Adda pinirmaan mi nga amicable settlement nga naisurat
nga isalda ni nanang mi dagitoy lote nga naikaso iti gatad nga
P140,000.00; maibawas dyay suma total nga inala na nga P95,000.000
kadagiti salda iti Gudoy Portion. [There is an amicable settlement that
we signed in which our mother will mortgage to us the lots subject of
this case in the amount of P140,000.00 less the total amount of
P95,000.00 which she got from the mortgages of the Gudoy Portion.

Amicable Settlement dated April 1, 2011 which is marked as Exhibit F
