I, Ryan M. Nishimoto, declare and state:

I am an attorney licensed to practice law in the State of California and a

partner with Arnold & Porter LLP (Arnold & Porter). I submit this declaration in

support of Defendants Sur-Reply to Plaintiffs Ex Parte Application for Leave to

Take Limited Immediate Discovery. I have personal and firsthand knowledge of the

facts set forth herein.

April 23, 2002) from the case styled Semitool, Inc. v. Tokyo Electron America, Inc.,

N.D. Cal. case no. 3:02-cv-00288-JSW, showing that plaintiff filed its motion for
