You will require this approval if you intend to manage the operations of a business that sells or serves alcohol. It is a
requirement that all such businesses possess a relevant liquor licence and that an approved manager is present at the
licensed premises at all times that the premises is open.
Both an unrestricted and restricted approval are available. You will require an unrestricted manager's approval if you
operate a business under a commercial licence, such as a tavern or liquor store. You will require a restricted

Approval to Build Over or in the Vicinity of Water Service Infrastructure - Western Australia
You will require this approval if you intend to develop, alter, or remove an obstruction near a water services licensee's
infrastructure. This approval also applies if you intend to drill, bore, excavate or use impact equipment with close
proximity to water service infrastructure. Types of obstructions include:

electrical, telecommunications and similar cables


gas mains
power poles and other poles and towers
drains
ground anchors
material stockpiles
roads and airstrips.

Small trees of no more than five metres in height and fences and similar structures that can easily be removed are not
included as obstructions. Close proximity is determined by the Water Services Licensee who owns the infrastructure in
accordance with the regulations.
Please note that the relevant water services licensee may be the WA Water Corporation, your local council or a

Approval to Discharge Trade Waste - Western Australia


You will require this approval if you intend to conduct an activity where trade waste will be discharged into a
wastewater inlet connected to sewer owned or managed by a water services licensee.
Trade waste is any wastewater that differs from the kind and volume ordinarily discharged from an ordinary home
used solely or primarily as the home of its occupants.

Approval to Erect a Commercial Advertising Sign on a Road or Highway - Western Australia


You will require this approval if you intend to place, construct or exhibit a hoarding or other advertising structure,
including a sign, on or in the vicinity of a highway, main road or part of a road subject to a control of access
declaration.
Control of access refers to a road or part of a road which has been declared to be subject to control of access and as
such is only intended for use by prescribed traffic and may only be entered or exited at specified places.
This includes a sign inside a building on your premises, if the sign is primarily directed at drivers or if the sign is lighted
by artificial light.
Approval is not required in all circumstances, including a:

For sale or for lease sign that is no greater than 1 square metre in area;
Sign affixed to a building on a premises indicating the name, or the name and the business of the occupier of
the premises that does not exceed 0.4 square metres in area; and
Sign that is erected on a place between the boundary of a road and the building line of a premises that
indicates the name, or the name and the business of the occupier of the premises.

Approval to Use Containers Other than a Receptacle - Western Australia - City of Belmont
You will require this approval if you intend to deposit rubbish or refuse in a container other than the receptacle (rubbish
container) supplied by the Council. You can apply for this approval if your premises consists of more than three
dwellings, is used for commercial or industrial purposes, or is a food premises (such as a restaurant).
Separate approval is also required to dispose of industrial or commercial waste into a rubbish container or receptacle
that is to be collected by the local council or an authorised person.
The following materials are classed as commercial or industrial waste:

Hot or burning ashes;


Oil, motor spirit or other flammable liquid;
Liquid, paint, or other solvent;
Bricks, concrete, earth or other like substances;
Drugs, dressings, bandages, swabs or blood samples unless placed in a sealed impervious container;
Hospital, medical, veterinary, laboratory or pathological substances containing blood unless placed in a sealed
impervious container;
Syringes, needles, surgical hardware, broken glass, sharps or other sharp objects unless placed in a sealed
impervious container; or
Cytotoxics, radioactive substances and dangerous chemicals.

The container must be kept in a sanitary manner and meet all applicable health standards.

Australian Standard AS 2030 Gas Cylinders - Western Australia


You will be required to comply with this standard if you intend to use a gas cylinder at your workplace.
You must ensure that each gas cylinder has a current inspection mark in accordance with this standard and is only
filled in ways that comply with this standard.
This Standard specifies requirements for the verification, filling, handling, inspection, testing, and maintenance of
refillable gas cylinders for the storage and transport of compressed gases. It is only applicable to cylinders which
exceed 0.1 kilograms but do not exceed 3000 kilograms water capacity. It is not applicable to acetylene cylinders,
non-refillable cylinders and vacuum-insulated cylinders.
This Standard does not apply to cylinders forming part of aircraft equipment and used solely in aircraft.

Australian Standard AS 3301 - 1992 Approval and Test Specification - Particular Requirements for
Microwave Ovens - Western Australia
You will be required to comply with this standard if you intend to use or sell a new microwave oven for purposes other
than domestic or scientific. A microwave oven cannot be sold as a new microwave oven unless it complies with the
requirements of this standard.
Your microwave oven must have passed a compliance test carried out in accordance with this standard within the last
three years.
This standard has been superseded and is now referred to as AS/NZS 60335.2.25:2002: Household and Similar
Electrical Appliances-Safety Part 2.25: Particular Requirements for Microwave Ovens Including Combination
Microwave Ovens.

You will require this licence if you intend to play copyrighted music in your business.
This licence covers the use of any of the following devices for the broadcast of background music:

Background music systems, including CD, tape player, radio, music services, or each zone or channel of a
multi-channel device;
Radios or TV sets or large screens; or
Audio or video juke boxes.

This licence will apply to you if you operate any of the following:

Hotel, club, motel, tavern or bar;


Restaurant or cafe;
Retail outlet;
Health or beauty service;
Fitness centre or trainer;
Theatre or cinema;
Corporate or business workplace;
School, university or other tertiary institution;
Dance school or eisteddfod organiser;

Building Approval Certificate - Western Australia - City of Belmont


You may require this certificate if you are required to obtain approval for work that was completed without a building
permit or to demonstrate an existing building's compliance with any relevant standards.
Building approval certificates are voluntary. However, if unauthorised construction has been conducted, you may be
required to demolish all works that have not been approved by the relevant Council.
A building approval certificate can also be issued for the purpose of obtaining a strata title. However, if you intend to
obtain a strata title you cannot use the certificate to retrospectively approve works conducted without a building permit.

Building Permit - Western Australia - City of Belmont


You will require this permit if you intend to conduct building work. The permit must be obtained from the relevant
Agency, generally the local government, prior to work commencing.
If you intend to build a Class 1b, or Class 2 to 9 building, the plans must be certified. Certification involves engaging a
registered building surveyor to complete a Certificate of Design Compliance (CDC) which must be submitted with your
application.
Buildings of Class 1a and Class 10 may be either certified or uncertified. An uncertified application does not require
the use of a registered building surveyor instead; the Agency will assess the plan for compliance with all relevant
standards before issuing a CDC.

Eligibility Requirements
To be eligible for this permit you must:

Obtain planning approval and any other required approvals, including approval for installation of a sewage
treatment apparatus (if required);
Provide a certificate of design compliance for the building or structure signed by a building surveyor;
Provide each technical certificate signed by a specialist that the building surveyor has relied on to sign the
certificate of design compliance;
Provide a copy of the plans and specifications for your building or structure;
Notify the Heritage Council of Western Australia (if relevant);
Provide details of the builder who will carry out the work;
Pay any applicable building services levies;
Provide any other information required on the application form; and
Pay the application fee.

There may be additional requirements before approval is granted to your application. These requirements will vary
dependent on factors such as the future purpose of the building or any other requirements dictated by the relevant
permit authority.

The relevant Agency has a limited period of time in which to approve or reject your application. For certified

contains workplaces.
This code provides information on how to minimise the risk of infection from the bacteria which cause legionnaires
disease. In Australia, the sources of legionella bacteria in recorded outbreaks of legionnaires' disease have been
traced to either large air conditioning plants or hot water distribution systems that have been incorrectly commissioned
or poorly maintained. However, the bacteria has also been known to accumulate in:

Evaporative condensers;
Hot and cold water systems;
Spas;
Humidifiers or foggers and water misting systems;
Coolant in industrial milling machines;
High pressure cooling and cleansing processes;
Potable water aerosols, such as shower heads;
Nebulisers; and
Other domestic and industrial-based water systems.

Employer Requirements - Superannuation Guarantee - Australian Government


If you are an employer you have an obligation to pay superannuation contributions on behalf of all your eligible
employees, in addition to their wages and salaries. This compulsory superannuation guarantee requires you to:

Pay superannuation for all your employees;


Contribute to their preferred super funds if available; and

Extended Trading Permit / Liquor Without a Meal Licence - Western Australia


You will require this permit if you already hold a liquor licence and intend to sell alcohol at a time or place that your
existing licence would not ordinarily cover. The purposes for which an extended trading permit may be used include:

selling liquor in a restaurant without meals


alfresco Dining outside or adjacent to a licensed premises
clubs selling alcohol to members of another association
selling alcohol with a meal in the dining area of a hotel, nightclub or producer's premises
off-site deliveries or supply by a liquor store after hours
extending the hours for an existing licensed premise
extending the area for an existing licensed premise.

An extended trading permit for the sale or consumption of liquor on a road or footpath will not be issued unless the
local council also consents to the application.

You may be required to comply with one or more of the food standards if you manufacture food or beverage products

You will require this approval if you intend to conduct a business from home. Home occupation approvals exist to
allow certain small volume trades or occupations to be practised in a residential environment while enabling the local
council to maintain sufficient controls to ensure that minimal disturbance and nuisance are created.
Home occupation must take place on land or in a dwelling that you own. You must also:

Not occupy more than 20 square metres;

Pay-Roll Tax Registration - Western Australia


You are required to register to pay this tax if you employ people in Western Australia. Pay-roll tax is assessed on the
wages that you pay to your employees in Western Australia. You have to pay the tax when you have a staff payroll
exceeding $70,833 during a month or an annual payroll exceeding $850,000.
Pay-roll tax is self-assessed. You must calculate the liability and then pay the appropriate amount to the Office of
State Revenue, by way of a monthly, quarterly or annual return. If you have, or are a member of a group that has, an

Permit to Use an Apparatus for the Treatment of Sewage - Western Australia - City of Belmont
You will require this permit if you intend to use an apparatus for the treatment of sewage after it has been constructed
or installed. A sewerage apparatus includes septic tanks, aerobic treatment units, compost toilets and any other
apparatus used for the treatment of sewage.
When the construction or installation of a sewage apparatus is complete, the Council must be notified. An
environmental health officer will inspect the apparatus to make sure it conforms to health and safety regulations. If the
environmental health officer is not satisfied with the inspection, then they will advise you to complete the necessary
works and arrange for a further inspection. This work must be completed within a prescribed time frame.
Prior to the inspection by the environmental health officer, you must fill the apparatus to overflow level with clean water
24 hours before the inspection, and also ensure that all drains, fixtures and fittings are visible.

Planning Approval - Western Australia - City of Belmont


You may require this approval if you intend to undertake any development or building activity.
Development includes demolition, erection, construction, alteration of, or addition to any building or structure, or
carrying out any excavation or other works. It also includes changing the use of land (the type of business activity or
purpose the land can be used for). Examples of types of land use include a dwelling house or caravan park.
Local and regional planning schemes and interim development orders state when approval is required. These
schemes divide land into different zones, with each zone containing development requirements specifying what types
of development require approval.
Approval from the Western Australian Planning Commission is required for certain developments. The Council will
determine if Planning Commission approval is required and will forward your application if necessary.

You will be required to register with or notify the Agency if you intend to use premises to operate a food business in
Kings Park or on Rottnest Island. A food business includes any business, enterprise, or activity that involves:

the handling of food intended for sale


the sale of food.

You must register your food business unless it is exempt from registration, in which case you will need to notify the
Agency of your premises. Exempt businesses include those that:

Registration for Fringe Benefits Tax (FBT) - Australian Government


You are required to pay Fringe Benefits Tax (FBT) if you provide any benefit to an employee or an employees'
associate (e.g. a family member, etc).
Benefits include any rights, privileges or services you supply to an employee in relation to their employment. For
instance, the following types of activities would require you to pay FBT:

Allow an employee to use a work car for private purposes;


Give an employee a cheap loan;
Reimburse an expense incurred by your employee (e.g. school fees); or
Provide entertainment by way of food, drink or recreation.

FBT is separate from income tax and is based on the taxable value of any benefits you provide. You can process your
FBT via your monthly or quarterly Business Activity Statement (BAS).
Please note that you are required to pay FBT whether:

These benefits are provided by you, an associate of yours or a third party under an arrangement with you; and
An employee is a current, future or former employee.

Some employers, including charities, may need to work out the status of their workers. Many will be volunteers,
however, some will be contractors and employees. Generally, benefits provided to volunteers and contractors do not
attract FBT.

Registration of a Co-operative - Western Australia


You will require this registration if you intend to operate a co-operative in Western Australia. A co-operative is a legal
entity formed by persons who wish to meet certain business, cultural and social needs through jointly owned
enterprise. A registered co-operative is a body corporate and in Western Australia may be formed by a minimum of
five individuals or corporations.
In forming a co-operative, members agree to use its services and to contribute capital to fund the enterprise, usually
by purchasing shares. Funds are contributed not for capital gain but for service or trading benefits.
Co-operatives may be set up for a very wide range of social and economic activities, such as retailing, agriculture,
manufacturing, child care, housing, marketing, arts and crafts and taxi services. For instance, people in a rural
community may establish a co-operative supermarket to buy food in bulk so that its members have access to cheaper
goods.
You can also register as an existing corporation.

Eligibility Requirements
To be eligible for this registration, you must:

Submit an application for an available name, using the approved application form;
Attach two copies of the proposed rules signed and certified by the persons who acted as chairperson and
secretary at the formation meeting;
Lodge your application within two months of the formation meeting of your proposed co-operative;
Provide a statement listing the name, address, occupation and contact details of each person elected as a
director;
Provide a certificate signed by the chairman and secretary verifying that you have been authorised to register
the cooperative;
Submit annual reports; and
Pay any relevant fees.

Restaurant Liquor Licence - Western Australia


You will require this licence if you intend to sell or supply liquor for patrons to consume at your premises along with a
meal (for example at a restaurant). You can apply for this licence if the primary focus of your business is the supply of
genuine meals. The supply of alcohol must be secondary to this.
Applications for this licence may be made as:

an individual person
a director representing a company
two or more individual persons or companies jointly
an association.

To be eligible for the licence you must:

demonstrate that the application is in the public interest, having regard to the likely health and social impacts
on the community and sub-groups within the community
show that the position, nature and standard of your premises are suitable
be deemed fit and proper

For a venue to be suitable for a restaurant licence it must have a kitchen equipped to provide meals, sufficient toilet
facilities and a dining area must always be set up with tables and chairs for dining.

Trade Promotion Lottery Permit - Western Australia


You will require this permit if you intend to conduct a trade promotion lottery. A trade promotion lottery is a lottery
promoting the sale of goods or the use of services, in which every participant takes part:

without cost or
because they have purchased a good or service for the same cost the participant would have paid had they
not taken part in the lottery.

You are automatically covered by a permit if your trade promotion lottery meets the prescribed terms and conditions.
You do not have to submit an application.

WA Driver's Licence - Western Australia


You will require this licence if you intend to drive a motor vehicle on a public road. It is illegal to drive on a public road
in Western Australia without a current driver's licence. Overseas licence holders, who hold a permanent visa, are only
able to drive for up to three months using their overseas driver's licence.
Your licence will authorise you to drive particular classes of vehicle. Licences are available in the following classes:
moped, motorcycle, car, light rigid, medium rigid, heavy rigid, heavy combination and multi-combination.
To obtain your first driver's licence you must get a learner's permit. You will need to complete the minimum number of
supervised driving hours, and pass a driving test before you can move from a learner's permit to a driver's licence.
Your licence will be issued as a provisional licence if you are a novice driver or are under 18 years old. You will be
considered a novice driver unless you have held a driver licence for at least two years. Please consult the Contact

A registered higher education provider that employs staff; or

Registered higher education providers and businesses employing more than 500 employees are required to report to
