APPLICATION FILED BY PLAINTIFF ALONG-WITH MEMO
OF FACTS BY THE COUNSEL FOR PLAINTIFF.
Plaintiff present. Advocate present.
Defendant present. Shri L.V.Nadi Advocate present
and filed Vakalatnama for defendant.
Plaintiff and defendant have filed joint Memo and
Joint Compromise Petition under Order 23 Rule 3 r/w
151 of CPC.
The said compromise petition is signed by plaintiff
and his advocate on record; and also signed by
defendant and his advocate, on record.
The contents of the joint compromise petition are
read-over and explained to the plaintiff and
defendant in Kannada language, known to them, in
presence of their respective advocates on record.
The plaintiff and defendant after understanding the
terms of contract of compromise have agreed
admitted and consented for each terms of the
compromise out of their free will and consent without
any undue coercion and influence.
The suit is filed by the plaintiff against defendant for
declaration and perpetual injunction in respect of suit
land sy.no.496/2, measuring 02-Acres 27-Guntas of
Rajeshwar. Consequently prayed to declare the Sale
Deed dated 19.01.2016, at document no.5517/201516, with respect to suit land as null and void.
Now ass the terms of agreement, the plaintiff has
received an amount of Rs.1,12,000=00 towards full
and final settlement of the case and has no right and
interest over the suit land in whatsoever manner.
As per the terms of agreement, the plaintiff further
admitted that defendant is owner and possessor of

suit land sy.no.496/2, measuring 02-Acres 27-Guntas
of Rajeshwar, with the following boundaries:
East: Land of Mahadevi Jamadar;
West: Land of Irappa Nalkante;
North: Hanadi;
South: Road leading to villge Mudbi.
As per the terms of agreement, the plaintiff further
admitted the appearance of name of defendant, in
the RoR of the suit land.
As per the terms of agreement, the plaintiff further
admitted that the defendant is at liberty to alienate
the suit land, and plaintiff has no objection
whatsover.
Therefore, the compromise entered in between the
plaintiff and defendant is not against any provisions
of Law, and it can be accepted and recorded by the
Court. Hence, the following;
ORDER
Compromise petition filed by the plaintiff
defendant is hereby allowed and accepted.

reduced into writing by their advocates on record,
singed by the plaintiff, his advocate, defendant and
his advocate is hereby recorded.
Office to draw decree in terms of joint compromise
petition, presented by the parties and accepted by
the Court.
Plaintiff, his advocate, defendant and his advocate
are directed to endorse their signatures on the order
sheets, acknowledging their presence, participation
and identification before the Court, for compromise
of the case.
