1. Who was the plaintiff? The plaintiff is Hans P. Plotseneder in this case.

2. What was his relationship to the defendants? Mr. Plotseneder was the
president and CEO of Blue Rainbow Software International and an employee
of the defendants company when they bought out Blue Rainbow.

3. Why did the plaintiff file suit? For what was he asking? The plaintiff filed suit
because he had written contracts with Quadron and Fischer and they
terminated him. He was asking to be paid $506,030, $6,030 for commissions
for European sales of $60,300 in which his contract stated that he would be
compensated 10% of total sales and $500,000 for the breach of the
development contract.

4. What kind of remedy is he requesting? A specific performance with


compensatory damages.

5. Did the Appellate Court agree? Why or why not? The appellate court agreed
that the trial court judgment was valid for the sales agreement but the
development agreement was not valid because the plaintiff could not prove
that he would be irreparably injured unless the contract was enforced.
