    resolve a dispute without court
    litigation;
    Optional way of resolving a domain
    name dispute out of court;
    Specialized handling of domain
    disputes based on UDRP or its
    variant versions;
    Same case as in Football (FIFA)?!

    3 key issues covered under ADR


    Domain being identical or
    confusingly similar to a Trademark
    or Service mark;
    Having no right or legitimacy
    interest of the domain name;
    Registration or use of a domain in
    bad faith.

    .tz ADR status

    Adopted variant version of UDRP & DRS by


    WIPO since 2012;
    Signed an agreement in 2015 with a local legal
    entity (Resolution Experts Ltd ResEx Ltd) to
    provide DRS (http://resolutionexperts.co.tz/);
    ResEx Ltd having an online DRS platform
    (http://iresolve.co.tz/);

    DRS by ResEx Ltd and WIPO effective Jan 2016.

    Leading to Full local management of .tz ccTLD.

    Recommendations
    Adoption of UDRP or Variant version is
    encouraged;
    Capacity building and local DRS
    provision for African CCs is key as
    domain business in Africa is growing;
    Affordable and timely DRS provisioning is
    very important and ADR is the right way
    to go.
