COUNTY IN THE MATTER OF THE APPLICATION Of THE STATE OF FLORIDA FOR AN ORDER FOR SUBSCRIBER INFORMATION, AND AUTHORIZING THE INSTALLATION AND USE OF A PEN REGISTER DEVICE, TOUCH TONE DECODER AND CALLING PARTY IDENTIFICATION SYSTEM/TRAP AND TRACE DEVICE FOR TELEPHONE FACILITY NUMBER 727-599-4374 AND THE DISCLOSURE OF CELLULAR COMMUNICATION RECORDS, TO INCLUDE CELL TOWERS AND REAL TIME LOCATION APPLICATION Matthew Wroe, a Detective with the Pinellas County Sheriff’s Office, a law enforcement officer as defined in Florida Statute 934, hereby applies to the Court for an Order, pursuant to Chapter 934 Florida Statutes and consistent with Title 18, United States Code sections 2703(d) and 3122, directed to Cellco Partnership doing business as Verizon Wireless, or any wireless company providing service to the listed telephone, for disclosure of subscriber information, authorizing the installation and use of a Pen Register, Touch Tone Decoder, authorizing the installation and use of a Calling Party Identification system/Trap and Trace Device, and ordering assistance in the installation and use of the devices, all with respect to a cellular telephone, specifically assigned Mobile Directory Number (MDN) 727-599-4374, serviced by Cellco Partnership doing business as Verizon Wireless, and the disclosure of cellular communication records, to include cell towers and real time location. In support of this Application, Matthew Wroe, a Detective with the Pinellas County Sheriff's Office certifies the following: Your Applicant is a Law Enforcement Officer as defined by Florida Statutes and therefore, pursuant to Chapter 934, Florida statutes, may apply for disclosure of telecommunications records and the installation of a Pen Register, Touch Tone Decoder and Calling Party Identification System/Trap and Trace Device. Your Applicant certifies that the information sought is relevant and material to a legitimate ongoing criminal investigation, to-wit: 1. The Pinellas County Sheriff’s Office is conducting an investigation of Battery on a Person over 65 Years of Age which cccurred on August 1, 2013 at 16325 Redington Drive, st. Petersburg, Pinellas County, Florida. The suspect has been identified as James Edward McLynas, a White Male, DOB: November 14, 1958. dames Edward Mclynas is the subject of an active warrant for Arrest for Battery on a Person over 65 Years of Age. 2. During the course of this investigation, it was learned that James Edward McLynas is utilizing Cellco Partnership doing business as Verizon Wireless telephone number 727-599-4374, serviced by Cellco Partnership doing business as Verizon Wireless. James Edward McLynas’s location is unknown. Your Applicant’s reason for this belief is as follows. Your Applicant has reviewed ,the affidavit authored by Deputy Sean Moran that on August 1, 2013 at 16325 Redington Drive, St. Petersburg, Brenda Wooldridge, who is a 71 year old realtor, was visiting the residence of a client to verify that it was vacant. Upon arrival, she encountered James McLynas inside the residence. James McLynas began screaming at her to exit the property. The affidavit indicates that after Brenda Wooldridge exited the property, James McLynas grabbed a water house and sprayed her with the water hose. Based on this affidavit, a judge found there to be probable cause, an Information was filed, and a warrant was issued on October 11, 2013 with a bond amount of $15,000. Your Applicant was also advised by Detective Larry McLean of the Pinellas County Sheriff's Office Arson/Auto Theft Unit that he is investigating several offenses for motor vehicle title fraud. Detective McLean advised that he has attempted to locate James McLynas for the purpose of conducting an interview and went to 16325 Reddington Drive, St. Petersburg, Pinellas County, Florida on several occasions for the previous six weeks. Det. McLean advised that this residence is vacant. James McLynas has not been located. Det. McLean stated that he has probable cause for his arrest based on his investigation and intends to arrest James Mcbynas when he is located. Your Applicant has reviewed a police report authored by Deputy David Savalox regarding an incident that occurred on October 28, 2013 at 2431 Indian Trial East, Palm Harbor. This xeport stated that Laura McLynas made a complaint regarding having been battered by her 10 year old daughter. Upon arrival on scene, Deputy Savalox encounted the child and she was belligerent and combative. Deputy Savalox took her into custody. This report also indicated that James McLynas provided his name and phone number to dispatch asking for Deputy Savalox's sergeant to return his call. The number he provided was 727-599-4374. The report also indicated that Sergeant Craig Chaisson did speak with James McLynas at 727- 599-4374, but James McLynas did not come to the scene. Your Applicant also noted that 727-599-4374 has been listed as a contact number for James McLynas in the Pinellas County Sheriff's Office report writing system since 2009. Based.on the information provided by Det. McLean and Sgt. Chaisson, your Applicant believes that James McLynas has no ascertainable place of residence and is transient. your Applicant reasonably believes that the requested devices will identity continued use of the telephone to evade capture, and will allow law enforcement to apprehend James Edward McLynas in a manner to better insure the safety of the public, while being the least intrusive means reasonably available. Your Applicant seeks an Order that Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone expeditiously furnish, in printed form, electronic format, or orally, as requested by the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, for the period beginning 30 days prior to the date of the Court’/s Order and ending 60 days from the date of the Court’s Order, all information and records pertaining to the subscriber or customer of 727-599-4374 (including any veplacement MDN), whether maintained by Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone as call detail records, as transactional records, as information stored in computer databases dedicated to fraud detection, or in any other form or location, specifically including: a) The Electronic serial Number (ESN) or Mobile Equipment Identifier (MBID) on the cellular telephone currently using 727-599-4374 and any replacement MON and ESN or MEID combinations; b) The MDN and ESN or MEID for any additional cellular telephones owned by or leased to the same account or subscriber, (herein referred to as ‘additional customer telephones") ; ¢) Subscriber names, addresses, billing information, payment method and credit information for 727-599-4374 and all additional customer telephones; a) Records of all published and non-published numbers dialed or pulsed from and to 727-599-4374 (excluding post cut through dialed digits or any dialed digit extraction features) and all additional customer telephones; e) Date, time and duration of all calls to or from 729-599-4374 and all additional customer telephones; £) Records reflecting the precise geographic locations where any and all cellular activations, including mobile-to-mobile, MMS or Media Message Detail and SMS or Text Messaging (excluding the content thereof), uncharged call detail, CDR and iDEN network search engine reports, IP Session Information/Detail (including cellular sites and tower locations), IP Source-Destination Reports, Viador Reports, airtime usage detail, and cellular packet data, and access to so- called Automated Message Accounting Data Bases and Calls-to- Destination requests as needed, and cell call detail and cell towers for “direct connect” or any push-to-talk like feature and non-billed calls, such as Text Messaging (excluding the content thereof) of 727-599-4374 and all additional customer telephones took place, including identification of the geographic location of towers activated (including corresponding cell site sectors and any Real Time Tool or RTT data); and, upon request, provide enhanced-911 signal triangulation or precision-based geo-location data. Your Applicant further seeks an Order that Cellco Partnership doing business as Verizon Wireless , Cricket Communications, Sprint Nextel Corporation, AT&T, Metro PCS, Inc., ‘TracFone Wireless, Inc. d/b/a Simple Mobile, and T Mobile USA expeditiously furnish, for the period beginning 30 days prior to the date of the court's Order and ending 60 days from the date of the Court's order, subscriber names, addresses, billing information, payment method and credit information related to any and all telephone numbers being called from or calling to 727-539-4374, as reflected in the records produced by Cellco Partnership doing business as verizon Wireless or any wireless company providing service to the target telephone. Your Applicant requests that the Court issue an order authorizing, upon the request of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, to Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone after ite review of the records, the installation and use of a Pen Register, Touch Tone Decoder Device for a maximum period of 60 days from the date of this order, to record the numbers dialed or pulsed from 727-599-4374 (excluding post cut through dialed digits or any dialed digit extraction features), to record the dates and times of such dialing or pulsing, and to record the duration of all calls dialed or pulsed. Your Applicant further requests that the Court issue an Order authorizing, upon the request of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement to Celleo Partnership doing business as Verizon Wireless or any wireless company providing service to the target telephone after its review of the records, the installation and use of a Calling Party Identification system/Trap and Trace Device on 727-599-4374, to xecord the incoming electronic or other impulses which identify the originating mmber of a wire or electronic communication and the date, time and duration of such incoming impulses for a period of (60) days, being geographically limited only by the technology of Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed cellular telephone(s) and the technology of the originating telephone number service providers. Your Applicant further requests that the Order direct Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed cellular telephone(s) to furnish forthwith, unobtrusively and with a minimum of interference with the services provided to the subscriber of 727- 599-4374, all information, facilities, and technical assistance necessary to accomplish the installation and use of the Pen Register, Touch Tone Decoder and Calling Party Identification System/Trap and Trace Device, including furnishing any and all information and assistance necessary for the Pinellas county Sheriff's Office, with the assistance of the Florida Department of Law Enforcement to contemporaneously determine the precise geographic location where any and all cellular activations of 727- §99-4374 occur (including, if requested by Agents of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, signaling information, listings of control channels and their corresponding cell-sites, information revealing cell-site tower locations, sectors, propagations, and orientations and switch based technical assistance as requested) Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the target telephone shall be compensated by the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, for xeasonable expenses incurred in providing such information, facilities and technical assistance. Your Applicant further requests that authorizations given by the court apply not only to the target MDN listed in this Application but to any changed telephone number(s) subsequently assigned to the same Electronic Serial Number (ESN) or Mobile Equipment Identifier (MEID) utilized by the target telephone within the sixty day period. Your Applicant further requests that the Court’s Order direct Cellco Partnership doing business as Verizon Wireless , Cricket Communications, Sprint Nextel Corporation, AT&T, Metro PCS, Inc., TracFone Wireless, Inc. d/b/a Simple Mobile, and T Mobile USA and its agents and employees not to disclose to the subscriber, or any other person, the existence of this Order, the existence of the Pen Register, Touch Tone Decoder and Calling Party Identification System/Trap and Trace Device, or the existence of this investigation unless or until otherwise ordered by the Court and that the Application and order be SEALED except for one copy of the order to be served upon Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone. Your Applicant further requests that this Application and Order be sealed and remain sealed and filed with the Clerk of the court as long as the Pinellas County Sheriff’s office, with the assistance of the Florida Department of Law Enforcement, are continuing to conduct ongoing criminal investigations into subject. identified through the use of the records and/or such information is directly related to a pending prosecution and/or appeal. Your Applicant suggests that such information is exempt and confidential under Chapter 119, Florida Statutes, the Florida constitution and the Rules of Judicial Administration in that it constitutes active criminal investigative information and information revealing surveillance techniques, procedures or personnel and constitutes administrative records rather than court records. See Fla. Stat. 119.071(2)(c)2 and (d) (2010) and Rule Jud. Admin. 2.420. Furthermore, Florida Statute 934.33 requires orders for pen registers or trap and trace devices to vemain under seal until order otherwise by a court of competent jurisdiction. Additionally, disclosure of the instant application and Order could appear to be statutorily prohibited if it would obstruct or impede an ongoing investigation or prosecution. see Fla. Stat. 934.43 (making it a third degree felony to reveal a subpoena, application, order or other authorization issued pursuant to Chapter 934 if done with intent to obstruct, impede, or prevent and investigation, criminal prosecution on behalf of the State of Florida or to prevent the obtaining by an investigative or law enforcement officer of the information or 10 materials sought pursuant to such a warrant, subpoena, application or order). In light of these statutory requirements and/or the fact that this Application’ is made before any docket number has been created, any case number assigned nor any case file created, these documents would constitute ‘administrative records" at this time and that the procedures outlined in Rule of Judicial Administration 2.420(£)(3) which appear to govern sealing of court records” once a criminal case is docketed do not yet appear applicable and compliance would be virtually impossible and/or defeat the ends of justice. WHEREFORE, it is requested that the Court grant an Order: (1) Directing the communications services providers described above to expeditiously furnish the subscriber records and information described above; (2) Authorizing the installation and use of a Pen Register to vecord numbers dialed or pulsed from 727-599-4374 (excluding post cut through dialed digits or any dialed digit extraction features) ; (3) Authorizing the installation and use of a Calling Party Identification System/Trap and Trace Device to identify incoming calls to telephone number 727-599-4374; (4) Directing Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone to forthwith furnish Agents of the Pinellas County 1 Sheriff’s Office, with the assistance of the Florida Department of Law Enforcement with all information, facilities and technical assistance necessary to accomplish the installation and use of the Pen Register, unobtrusively and with minimum interference to the service presently accorded the person whose telephone is to be the subject of the devices; (5) Directing the communications services _ providers described above, and their agents and employees not to disclose to the subscriber or any other person, the existence of the Court’s Order, the Pen Register, Touch Tone Decoder, Calling Party Identification system/Trap and Trace Device, or the existence of this investigation, unless or until otherwise ordered by the court; (6) Sealing this Application and the Court’s ordex. (7) Your Applicant further requests that the Court authorize in accordance with F.8. §92.605 that service of, and compliance with, the Order may be made by hand, United states mail, overnight delivery service, electronic format, or facsimile, as the circumstances permit. 12 I declare under penalty of perjury that the foregoing is true and correct. ORDER THIS MATTER, having come before the Court pursuant to an Application under Chapter 934 of Florida Statutes and consistent with Title 18, United states Code sections 2703(4) and 3122, by Matthew Wroe, a Detective with the Pinellas County Sheriff's Office, requesting the production of certain telecommunications records and installation of a Pen Register, Touch Tone Decoder and a Calling Party Identification System/Trap and Trace’ Device with regard to a cellular telephone, specifically Mobile Directory Number (MDN) 727-599-4374, serviced by Cellco Partnership doing business as Verizon Wireless, and the disclosure of cellular communication records to include cell towers and real time location. The Court finds that the Application has certified that the information likely to be obtained through the requested action is relevant and material to a legitimate ongoing criminal al investigation leading to the arrest of dames Edward McLynas, a person for whom probable cause exists for his arrest for Battery on a Person over 65 Years of Age, and for whom James Edward McLynas, a White Male , DOB: November 14, 1958 is the subject of a warrant for Arrest for Battery on a Person over 65 Years of Age; and is the least intrusive means reasonably available, that specific and articulable facts exist to support disclosure of customer records, and that there is probable cause to believe that the targeted telephone is being used for a criminal purpose. IT IS ORDERED, that Celico Partnership doing business as Verizon Wireless, or any wireless company providing service to the listed telephones shall expeditiously furnish to the Pinellas County Sheriff’s office, with the assistance of the Florida Department of Law Enforcement, for the period beginning 30 days prior to the date of this Order and ending 60 days from the date of this Order, all information and records pertaining to the subscriber or customer of 727-599-4374 (including any replacement MBN), whether maintained by Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to- the listed telephone as call detail records, as transactional records, ae information stored in computer databases dedicated to fraud detection, or in any other form or location, specifically including: a) The Electronic Serial Number (ESN) or Mobile Equipment Identifier (MEID) on the cellular telephone currently using 727- 399-4374 and any replacement MDN and ESN or MEID combinations; b) The MDN and ESN or MEID for any additional cellular telephones owned by or leased to the same account or subscriber (hereinafter referred to as “additional customer telephones”) ; c) Subscriber names, addresses, billing information, payment method, credit information for 727-599-4374 and all additional customer telephones; a) Records of all published and non-published numbers dialed or pulsed from and to 727-599-4374 (excluding post cut through dialed digits or any dialed digit extraction features) and all additional customer telephones; e) Date, time and duration of all calls to and from 727- 599-4374 and all additional customer telephones; £) Records reflecting the precise geographic locations where any and all cellular activations, including mobile-to- mobile, MMS or Media Message Detail and SMS or Text Messaging (excluding the content thereof), uncharged call detail, cpR and iDEN network search engine reports, IP Session Information/Detail (including cellular sites and tower locations), IP Source- Destination Reports, Viador Reports, airtime usage detail, and cellular packet data, and access to so-called Automated Message Accounting Data Bases and Calls-to-Destination requests as needed, and cell call detail and cell towers for “direct commect” or any push-to-talk like feature and non-billed calls, such as Text Messaging (excluding the content thereof) of 727-599-4374 and all additional customer telephones took place, —ineluding identification of the geographic location of towers activated (including corresponding cell site sectors and any Real Time Tool or RIT data); and upon request, provide enhanced-911 signal triangulation or precision-based geo-location data. IT IS FURTHER ORDERED, that Cellco Partnership doing business as Verizon Wireless , Cricket Communications, Sprint Nextel Corporation, ATsT, Metro PCS, Inc., TracFone Wireless, Inc. d/b/a Simple Mobile, and T Mobile USA or any subsequent provider of service, shall expeditiously furnish, for the period beginning 30 days prior to the date of this Order and ending 60 days from the date of this Order, subscriber names, addresses, billing information, payment method and credit information related to any and all telephone numbers being called from or calling to’ 727-599- 4374 (excluding post cut through dialed digits or any dialed digit extraction features) and all additional customer telephones, as identified in the records produced by Cellco Partnership doing business as‘ verizon Wireless or any wireless company providing service to the listed telephones pursuant to this Order. IT IS FURTHER ORDERED, that Agents of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, may install and use a Pen Register, Touch Tone Decoder Device for a period of 60 days from the date of this order, to record the numbers dialed or pulsed from 727-599-4374, (excluding post cut through dialed digits or any dialed digit extraction features) to record the dates and times of such dialing or pulsing, and to record the duration of all calls dialed or pulsed. TT IS FURTHER ORDERED, that Agents of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, may at their discretion, install and use a Calling Party Identification System/Trap and Trace Device on 727- 599-4374 to record the incoming electronic or other impulses which identify the originating number of a wire or electronic communication and the date, time and duration of such incoming impulses for a period of (60) days from the date of this Order, being geographically limited only by the technology of Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed cellular telephone(s) and the technology of the originating telephone number service providers. IT 18 FURTHER ORDERED, that Cellco Partnership doing business as Verizon Wireless or any wireless company providing service to the listed telephone shall furnish forthwith, unobtrusively and with a minimum of interference with the services provided to the subscriber of Cellco Partnership doing business as Verizon Wireless, all information, facilities, and technical assistance necessary to accomplish the installation and use of the Pen Register, Touch Tone Decoder and Calling Party Identification System/Trap and Trace Device, including furnishing any and all information and assistance necessary for Agents of the Pinellas county Sheriff’s Office, with the assistance of the Florida Department of Law Enforcement, to contemporaneously determine the precise geographic location where any and all cellular activations of 727-599-4374 occur (including, if requested by Agents of the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, signaling information, listings of control channels and their corresponding cell-sites, information revealing cell-site tower locations, sectors, propagations, and orientations and switch based technical assistance as requested) . TT IS FURTHER ORDERED, that Cellco Partnership doing business as Verizon Wireless , Cricket Communications, sprint Nextel Corporation, AT&T, Metro PCS, Inc., TracFone Wireless, Inc. d/b/a Simple Mobile, and T Mobile USA or any wireless company providing service to the listed telephone shall be compensated by the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, for reasonable expenses incurred in providing such information, facilities and technical assistance. IT IS FURTHER ORDERED that Matthew Wroe, a Detective with the Pinellas County Sheriff’s Office, along with any investigative or law enforcement officer assisting Matthew Wroe, a Detective with the Pinellas County Sheriffs Office, including but not limited to the Pinellas County Sheriff's Office, with the assistance of the Florida Department of Law Enforcement, shall use technology veagonably available to him or her which restricts the recording or decoding of electronic or other impulses to the dialing, outing, addressing, and signaling information used in processing and transmitting wire or electronic commmications so that the contents of any wire or electronic communications are not recorded or decoded. IY IS FURTHER ORDERED that this Order shall apply not only to the target MDN listed in this Application but to any changed telephone number(s) subsequently assigned to the same Electronic Serial Number (ESN) or Mobile Equipment Identifier (MEID) utilized by the target telephone within the sixty day period. IT IS FURTHER ORDERED, that Cellco Partnership doing business as Verizon Wireless and , Cricket Communications, Sprint Nextel Corporation, AT&T, Metro PCS, Inc., TracFone Wireless, Inc. d/b/a Simple Mobile, and T Mobile USA or any other subséquent provider of service and its agents and employees shall not disclose to the subscriber, or any other person, the existence of this order, the existence of the Pen Register, Touch Tone Decoder, Calling Party Identification System/Trap and Trace Device, or the existence of this investigation unless or until otherwise ordered by the Court.
