3. What is the purpose of family courts ? Is they fulfil the purpose?

RESEARCH METHODOLOGY
The Doctrinal methodology of research has been adopted to make this project. It involved study of
various economies. Statistical data and relevant information provided on various sites has been used.
On the basis, of the information obtained an analysis has been made as to how foreign exchange rate
is determined in India. Books and information available on websites have been relied upon in making
this project.

SCOPE
This project is of immense importance to me. I had researched on this project to get a deep
knowledge of the family courts functioning and the way to solve the cases. This research could
probably used to find a solution of the loopholes in the purpose of serving speedy trial and
inclusive help to the people and judiciary functioning. The project can be used by scholars for the
purpose of reference to the topic.

INTRODUCTION
The concept of Family court implies an integrated broad- based service to families in trouble.
Litigation in regard to any matter concerning family, whether divorce, maintenance and alimony, or
custody, education and financial support for children etc . It has a different culture, it has a different
jurisprudence. The court engaged in this task requires a less formal and more active investigational
and inquisitional procedure. In other words, it is not a litigation in which parties and their counsel are
engaged in winning or defeating a legal action, nut an inquisition in which parties, social workers,
welfare officers, psychiatrists are engaged in finding out a solution to familial problems.
The need to establish the Family Courts was first emphasized by the late Smt. Durgabi Deshmukh.
After a tour of China in 1953, where she had occasion to study the working of family courts, Smt.
Deshmukh discussed the subject with Justice Chagla and Justice Gajendragadkar and then made a
proposal to set up Family Courts in India to Prime Minister Pt. Jawahar Lal Nehru. The formation of
family court was a mile stone in the history of Indian judiciary. The Family Courts Act 1984

established the creation of Family Courts through a Gazette notification by the Central Government.
These courts are to be established in a town or city where the population exceeds one million or in
any area where the State Government considers to establish it. One or more judges constitute the
Family Courts but each judge is competent to exercise all the powers of the court
