REGULATION ORDINANCE NO. 2015-431


AN ORDINANCE REQUIRING BOTH PUBLIC AND PRIVATE BUSINESS
ESTABLISHMENT, OFFICES, AGENCIES, SCHOOLS AND HOSPITALS
IN THE CITY OF ILOILO TO CONDUCT EMERGENCY DRILLS
AMONG THE TENANTS, OCCUPANTS, STUDENTS, AND EMPLOYEES
THEREIN AND PROVIDING PENALTY FOR VIOLATIONS THEREOF
AND FOR OTHER PURPOSES

WHEREAS, the Philippines is a disaster- prone country and that fires constantly occur
while the threats of earthquakes cannot be discounted owing to the Philippines being the Pacific
Ring of Fire, a region in the Pacific that is disaster-prone;
WHEREAS, the City Government of lloilo has adopted various measures on disaster plan
and management and intends to harmonize these with the provisions of R.A. I 0121, otherwise
known as the "Philippine Disaster Risk Reduction and Management Act of2010", as we11 as the
provisions of the Implementing Rules and Regulations of R.A. 9514, otherwise known as the
Revised Fire Code of the Philippines of2008;

WHEREAS, the administration of the Local Government of Iloilo City desires to protect
its citizens, employees, infrastructures and properties in times of emergency, disasters and/or
calamity and coordinate with the National Government Agencies (NGAs) and Non-Government
Organizations (NGOs) in charged with assisting the Iloilo City residents in case of any emergency,
disaster and/or calamity;
WHEREAS, this ordinance seeks to m1t1gate risks caused by disasters/calamity by
preparing the residents of Iloilo City, particularly in both public and private business
establishments, offices, agencies, schools and hospitals on the proper response and actions to take
in cases of fires, earthquakes, and other hazardous phenomena;
Be it ordained by the Sangguniang Panlungsod of the City oflloilo, THAT:
Section 1. Tide. This ordinance shall be known and cited as "EMERGENCY DRILLS
ORDINANCE IN THE CITY OF ILOILO".

Section 2. Declaration of Policy. It is hereby declared the policy of the State to train its
people in the quick and proper response in times of fires, earthquakes, and other hazardous
phenomena so as to reduce the risks on their lives, limbs, and properties.
Section 3. Scope. The mandate ofthis ordinance requiring the conduct of emergency drills,
as hereinafter provided, applies to every educational institution and healthcare institution, whether
public or private, and to business establishment, office, or agency, with thirty five (35) occupants
or more whether public or private, located in Iloilo City. The provisions of this ordinance is not
intended in any way to reduce the standards set by the Implementing Rules and Regulations of the
Revised Fire Code of the Philippines of2008. The requirements set herein are without prejudice
to the requirements of other agencies or offices.

Section 4. Emergency Drills. Emergency drills, as used in this ordinance, shall include
but are not limited to fire exit drills, earthquake drills, and emergency evacuation drills and bomb

threat drills. The drills shall include practice and instruction concerning the location, use and

operation of emergency exits, fire escapes, doors and fire extinguishers and other facilities
provided for such purpose in buildings as well as the proper evacuation of buildings by persons in
the event of fires, earthquakes and other hazardous phenomena.
Fire and Earthquake drills shall include complete evacuation of all persons from the
building, if necessary. Teachers and/or administrative personnel of institutions and establishment
subject of this ordinance shall be trained in assisting their students, employees, tenants and other
stakeholders in the evacuation of a building in times of fire, earthquakes, and other hazardous
phenomena.
The conduct of emergency drills should be coupled with disaster risk reduction awareness
orientations and information drives in col1aboration with the Iloilo City Disaster Risk Reduction
and Management Council and the Bureau of Fire Protection.
Section 5. Frequency of Emergency Drills

a. EMERGENCY DRILLS IN EDUCATIONAL INSTITUTIONS - Principals,


School heads, or School Administrators of educational institution are required to
conduct emergency drills in their respective schools among their students, teachers,
and staff at least four times a year, one to be held either on March of each year in
celebration of the national fire prevention month or in July of each year in
celebration of the national disaster consciousness month and the rest to be held at
the discretion of the principal or the school administrator.
b. DRILLS IN HEALTH CARE INSTITUTIONS - Administrators of hospitals,
nursing homes, clinics, orphanages and other buildings or structures used for the
care of or occupied by the sick, infum, or disabled shall be required to conduct
emergency drills among their personnel once every quarter of the year, one to be
held on March of every year in celebration of the national fire prevention month or
in July of each year in celebration of the national disaster consciousness month and
the rest to be held at the discretion of the said administrator.
c. DRILLS IN ALL PUBLIC AND PRIVATE BUSINESS ESTABLISHMENT,
OFFICES, AND AGENCIES - Owners, managers, operators or administrators of
all public and private business establishments, offices and agencies with thirty five
(35) occupants or more in the City of Iloilo are hereby mandated to conduct frre
and earthquake drills among the tenants, occupants, employees or other
stakeholders therein, at least twice a year, one to held either in March of each year
in celebration of the fire prevention month or in July of each year in celebration of
the national disaster consciousness month and the rest to be held at the discretion
of the owners, managers, operators or administrators of such establishments.

Section 6. Records of Emergency Drills. Records or written reports of the conduct of


all emergency drills which are required by other authorities or agencies for purposes of granting
or renewing permits, licenses, accreditation and the like, must also be filed with the Iloilo City
Disaster Risk Reduction and Management Office (ICDRRMO) by the principal, head,
administrator, owner, or manager of establishments or institutions subject of this ordinance. The
same should contain the date and time it was conducted.

Section 7. PENALTIES.

a. Owners, managers, operators or administrators subject of this ordinance who


willfully and deliberately refuse to conduct emergency drills without any
justifiable reason, after due notice and hearing shall be punished as follows:
First offense -

Second offense Third offense -

a fine of Three Thousand Five Hundred Pesos (P 3,500)


a fine of Five Thousand Pesos (P 5,000) and suspension of
business permit or license for fifteen (15) working days
a fine of Five Thousand Pesos (P 5,000) and the revocation
of business permit or license

Provided however, that in case of juridical persons, the president or general


manager shall be held personally liable.
b. The following persons who willfully and deliberately refuse to participate in the
emergency drills without any justifiable reason, after due notice and hearing, shall
be punished as follows:
b. l Tenants, occupants, or employees of establishments/offices - a fine of Three
Thousand Five Hundred Pesos (P 3,500).
b.2 Students - sanction/disciplinary action to be determined and imposed by the
principal or the head of the school or educational institution except those who
are excused by the proper school authorities.
Section 8. Implementing Agency. The Iloilo City Disaster Risk Reduction and
Management Council (ICDRRMC) in consonance with the Iloilo City Disaster Risk Reduction
and Management Office (ICDRRMO) shall oversee the implementation of this ordinance and shall
keep a record of the reports submitted by owners, managers, operators, administrators, principals
or heads of establishments/institutions subject of this ordinance for purposes of documentation,
records and certification.

The emergency drills or exercises shall be conducted with the assistance, supervision and
of the Bureau of Fire Protection.
The City Legal Office shall be responsible for the filing and prosecution of appropriate
cases for the violation of this ordinance

Section 9. Repealing Clause. Any and all, ordinances, decrees, executive orders,
issuances, rules and regulations or parts thereof, inconsistent with the provisions of this ordinance
are hereby repealed, amended, or modified accordingly.
Section 10. Separability Clause. If any provision of this ordinance or part hereof shall
be declared unconstitutional or invalid, any other provisions herein not affected thereby shall
continue to be in full force and effect.

Seetion ll. Eft'ectivity. This ordinance shall take effect fifteen (15) days after its
approval and publication in a newspaper of general circulation in the City oflloilo consistent with
the provision of the Local Government Code of 1991.
