ORDINANCE NO.

________

AN ORDINANCE of the City Council of the City of


Bremerton, Washington, creating new chapter ________ entitled
“Rental License and Inspections” providing for the licensing and
inspection of rental dwelling units.

WHEREAS, the City Council of the City of Bremerton has determined that there
are residential tenants within the City of Bremerton living in residences that are substandard and
potentially dangerous to their health and safety; and

WHEREAS, substandard rental housing also has a harmful effect on the value of
nearby housing; and

WHEREAS, substandard rental housing also creates an environment which


creates an increased demand upon City services and thereby adversely effecting the health, safety
and welfare of the citizens of the City of Bremerton; NOW THEREFORE,

THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,


DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Section _____ of the Bremerton Municipal Code entitled


"______________________________________" is hereby amended to read as follows:

CHAPTER ________ RENTAL LICENSE AND INSPECTIONS

________ LICENSE REQUIRED. No person shall make available for rent, or rent,
lease, or let, any residential dwelling unit as defined in Section _________ of this title without
securing and maintaining a current business license as required by _________ .

________ DEFINITIONS
(a) “Dwelling Unit” is a structure or that part of a structure which is used as a home,
residence, or sleeping place by one person or by two or more persons maintaining a common
household, including but not limited to single family residences and units of multiplexes,
apartment buildings, and mobile homes.
(b) “Certificate of Inspection” means an unsworn statement, declaration, verification,
or certification made in accordance with the requirements of RCW 9A.72.085 by a qualified
inspector that states that the landlord has not failed to fulfill any substantial obligation imposed
under RCW 59.18.060 that endangers or impairs the health of safety of a tenant.
(c) “Property” or “Rental Property” means all dwelling units on a contiguous quantity
of land managed by the same landlord as a single rental complex.
(d) “Qualified Inspector” means a United States department of housing and urban
development certified inspector; a Washington state licensed home inspector; an American
society of home inspectors certified inspector; a private inspector certified by the national
association of housing and redevelopment officials, the American association of code

enforcement, or other comparable professional association as approved by the City of
Bremerton; a Washington licensed structural engineer; or a Washington licensed architect.

________ INSPECTION REQUIRED.


(a) As a condition for the issuance of a license required by this chapter, the applicant
shall provide a certificate of inspection that the applicant’s rental properties comply with the
standards provided in RCW 59.18.060.
(b) The inspections required by this Chapter shall be subject to the conditions
provided in RCW 59.18____ as currently enacted or hereinafter amended.
(c) To facilitate the availability of an inspection by each applicant, at the time of
application, an inspection renewal period shall be established upon which the applicant shall
submit its initial certificate of inspection and the corresponding renewal date of the certificate of
inspection three years thereafter. The renewal periods shall be divided into calendar quarters over
a three year period and assigned to the applicant at the time of registration on a rotational basis.
The first calendar quarter shall commence on the first date of January, terminating on the last day
of March; the second calendar quarter shall commence on the first day of April and terminate on
the last day of June; the third calendar quarter shall commence on the first day of July and
terminate on the last day of September; and the fourth calendar quarter shall commence on the
first day of October and terminate on the last day of December. Certificates of inspection shall be
submitted no later than the last day of the applicant’s assigned calendar quarter. During the first
three years of the implementation of this ordinance, the applicant shall be granted a provisional
business license pending the timely submission of its initial certificate of inspection.
(d) All inspection certifications shall be submitted on forms provided by the City or
approved by the United States Department of Housing and Urban Development.
(e) Nothing herein shall preclude such additional inspections as may be conducted
pursuant to the tenant remedy provided by RCW 59.18.0115 of the Residential Landlord-Tenant
Act; at the request or consent of a tenant, or issued pursuant to a warrant.

_________ VIOLATIONS.
(a) Any person violating any of the provisions of this chapter or failing to comply
with any of the requirements of this chapter, shall upon a finding that the act or omission had
been committed, be punished by a fine of not more than $500 dollars and shall be guilty of a civil
infraction. Each such person is guilty of a separate civil infraction for each and every day during
any portion of which any violation of any provision of this chapter is committed, continued, or
permitted by such person.
(b) Any person who knowingly submits or assists in the submission of a falsified
certificate of inspection, or knowingly submits falsified information upon which a certificate of
inspection is issued, is, in addition to the penalties provided in subsection(A) above be guilty of a
gross misdemeanor and shall be punished for a fine of not more than $5,000 dollars.
(c) In addition to the penalties provided above, any violation of this chapter may
result in the revocation of the business licenses provided in ____________. Any violation of this
chapter including, the determination by the City, after an inspection of the dwelling unit, that a
condition exists which substantially endangers or impairs the health or safety of a tenant may, in
addition to the penalties provided above, result in the issuance of a notice of civil violation
subject to the penalties imposed under the provisions of the Bremerton Municipal Code.

SECTION 2. Section _____ of the Bremerton Municipal Code is hereby
repealed in its entirety and a new section, Section _______ is hereby created to read as follows:

SECTION 5. Severability. If any one or more sections, subsections, or


sentences of this Ordinance are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this Ordinance and the same shall remain in full
force and effect.

SECTION 6. Effective Date. This ordinance shall take effect and be in force ten
(10) days from and after its passage, approval and publication as provided by law.
