1.
THE PROJECT
1.1. Project Overview
INJAZ Development Co. has developed a landmark mixed use project
located on the coast halfway between Dammam & Al Khobar, Kingdom of
Saudi Arabia (KSA) called "ALMARINA" (M.P number: SH-D / 845) with an
area of 3,373,272 sqm. The 337-hectare development includes residential
villas, residential/office towers, hotels, shopping mall, public facilities, etc
to serve the current and future needs for the growing community.
The development will have a seafront location; its eastern boundary will
border the proposed waterfront Corniche with direct access to the beach.
To the north, the site is bordered by the An Nawras development, which is
zoned for two-storey residential use. To the south, the site is bordered by
the King Faisal University development and to the west by the King Faisal
Highway, which is currently being upgraded to a 6-lane highway.

The Tenderer shall keep confidential and shall not release to any third
party any of the foregoing items.
The Tenderer shall return the Tender Documents forthwith to the Owner
(marked for the attention of the Chairman of the Tender Committee) at:

Tender Committee and must complete Paragraph 8. of its Form of Tender

SUBMISSION OF TENDERS
5.1. The original of all of the documents referred to in Paragraph 8.1. and three
copies of those documents referred to in Sub-paragraphs 8.1(a) and (d) must
be delivered by hand no later than 12:00 hours on 27th June 2016 (or such
later time as may be notified by an addendum issued in accordance with
Paragraph 5). to the Owner at Al Marina Development Project INJAZ Site
Offices, Dammam, KSA marked for the attention of the Chairman of the
Tender Committee. Any Tender received after the tender closing date will not
be considered. Save as aforesaid, the original and each copy shall be identical
but if, in default of this provision, there is any inconsistency the original shall
prevail.
5.2. The original set of the documents referred to in Paragraph 8.1. shall be clearly
marked ORIGINAL and signed and initialed manually. The three sets of copies

of the documents referred to in Sub-paragraphs 8.1. (a) and (d) shall be clearly
marked COPY and whose signatures and initialing may be photocopies.

5.3. The original and each of the three copies of the documents as described in
Paragraph 7.1. above shall be enclosed in a plain envelope or parcel with wax
seals and marked:
5.4. In each case a written receipt will be issued stating the time and date of
delivery.
5.5. Tenders submitted by mail will not be considered. A facsimile will not be
accepted in lieu of a sealed Tender nor will a facsimile of the sealed Tender be
accepted.
5.6. No Tender once delivered to the Owner may be added to, amended or
withdrawn at any time whatsoever save at the written request or with the written
consent of the Owner.
6.
TENDER DOCUMENTATION
6.1. In order to tender, the Tenderer must submit the following documents by the
time and in the manner stated in Paragraphs 5.1., 5.2. and 5.3. above, such
documents bearing the stamp of the Tenderer in the bottom right hand corner
of each page (as applicable):

The Tender Bonds shall when issued be valid for ninety (90)
days after the latest date by which Tenders have to be
delivered as stated in Paragraph 5.1. or, if it be earlier, and the
Tenderers Tender has been accepted, up to the date of
delivery of the Performance Bond to be delivered under the
Contract and issued by a local registered bank in the Kingdom
of Saudi Arabia.

7.1. No erasure, alteration or addition shall be made by the Tenderer to the Tender
Documents or any addenda thereto issued in accordance with Paragraph 5.
Above other than completing, signing and witnessing the Form of Tender.
The documents referred to in Paragraph 6.1. Above shall not include copies of
the Tender Documents produced by scanning the originals thereof or re-typed
versions of the Tender Documents in lieu of the said originals.
8.
TENDER SUM
8.1. The Tenderer shall note that the Tender Sum for the Operations Services shall
be based on the monthly rate and annual rate as per the break down for each
of the section. For the purpose of partial days of payment, daily rate calculated
pro rata from the monthly rate shall be applied.
8.2. The Tenderers price shall be deemed to be the tender sum offered for the
operation and maintenance for the complete Works as defined in the Tender
Documents and included everything necessary to complete the Works to the
required quality standards and within the period for completion as stated by the
Tenderer.
8.3. The Owner may award one or multiple sections to Contractors.
8.4. By submitting a Tender and regardless of any information provided by the
Owner the Tenderer shall be deemed to have satisfied itself as to the
correctness and sufficiency of and all conditions and circumstances affecting
the Tender Sum. It also has accepted the site conditions and its surroundings,
the
climatic
conditions,
the
extent
and
nature
of
the
Works,
the
superintendence, the labour, the plant and Contractors equipment and all other
things, whether of a temporary or permanent nature, required for carrying out
and completion of the Works including risks and contingencies which may be
relevant to the performance and observance of all the Contractors Obligations
under the Contract. The rates and prices stated in the Tender sum break down
are fixed for the duration of the Contract and shall not be subject to any
adjustment in respect of rise or fall in the cost of labour, materials, plant,
contractors equipment, transport or any other matters affecting the cost of
execution of the Contract.

9.
CURRENCY OF TENDER
9.1. The sums and rates to be inserted in the Form of Tender shall be expressed in
VALIDITY OF TENDER
10.1. The Tender shall be valid and binding upon the Tenderer for a period of
ninety (90) days from the tender closing date as described in Paragraph
5.1.
11.
DETAILS CONFIDENTIAL
11.1. All Tenderers receiving copies of the Tender Documents (whether a
Tender is submitted or not) shall treat the details of the documents as
private and confidential and shall not communicate any matter or thing
contained therein to a third party, except that which is accepted as normal
during the course of tendering procedures.

LANGUAGE
12.1. All communications between the Owner and the Tenderer and all the
Tender Documents shall be in the English language and Clause 4.1
(Languages) of the Conditions of Contract shall apply in relation thereto.

result from or occur in connection with such visits to the Site by the
Tenderer.
13.2. Arrangements for such visits which are to be made during the working
days (Sunday to Thursday) and during normal business hours of the
Owner (between 07:00-12:00) may be made by contacting the Owner by
fax on +966 3 809 6813, marked for the attention of the Chairman of the
Tender Committee. The Tenderer shall give the Owner two (2) working
days notice of such proposed visits.

16.1. The Contractor shall not occupy or use any part of the adjoining properties
or interfere in anyway with road access, unless absolutely essential for the
execution of the works and then only with the written approval of the
Owner.
16.2. The Contractor shall make good and reinstate any fencing or road works
or landscaping or other works of the any existing developments adjacent
to the site which is damaged or removed as a result of carrying out the
Works.

21.1. The Tenderers particular attention is drawn to Clause 12.9. (Insurance) of
the Conditions of Contract.
20.
OPENING OF TENDERS
20.1. The Tenders will be opened in private by the Tender Committee of the
Owner after 12:00 hours of the tender closing date as per Paragraph 5.1.
21.
EVALUATION OF TENDERS
24.1. The Tenderer may be required, at its own cost, to visit the Owners offices
or other offices after the delivery of its Tender in order to discuss any
aspect of its Tender as required by the Owner and to answer any queries
raised by the Owner and its consultants.

24.2. The Tenderer shall take care not to make errors in the computation of its
Tender. If such errors are made then the Owner shall make the following
adjustments:

If the amended total of the said Bills is lower than the Tender Sum
then the said amended total shall be deemed to become the Tender
Sum.

24.
CONFORMITY
27.1. A Tenderer must conform to all the requirements of the Scope of Work,
the O&M Manuals and the terms, conditions and provisions of the Tender
Documents. The Tenderer shall give prompt notice of any error,
discrepancy or omission in the technical content of any Tender
Documents.
