SETTLE THE PROPERTY DAMAGE CLAIM OF THE CITY OF OKLAHOMA CITY AGAINST SUNBELT RENTALS, INC. FOR DAMAGE CAUSED TO THE CITY PROPERTY ON MAY 19, 2016, AT OR NEAR MAY AVENUE AND NORTHWEST EXPRESSWAY IN OKLAHOMA CITY. WHEREAS, on May 19, 2016, a truck owned by Sunbelt Rentals, Inc. and operated by an employee of Sunbelt Rentals, Inc. struck the May Avenue Bridge over Northwest Expressway in Oklahoma City, Oklahoma, causing significant damage to the City property, impeding the flow of traffic along May Avenue and Northwest Expressway, and placing the health, safety, and welfare of the public in imminent danger; and WHEREAS, in response to urgent public health, safety, and welfare concerns, the City Manager declared a state of emergency to exist and directed immediate repairs to be made; and WHEREAS, emergency demolition and removal of the damaged portions of the bridge, bridge inspection report and construction plans, bridge construction and construction testing, traffic control and striping resulted in the total costs in the amount of $575,823.28 incurred by the City of Oklahoma City; and WHEREAS, the City Council has determined that the settlement of this claim in the amount of $575,823.28 is just and reasonable; WHEREAS, it is the desire of the City Council to make such settlement by authorizing the Municipal Counselor or his designee to draft and execute the necessary paperwork to settle this claim.
