I am requesting funding for the Update of the Lake Texoma Shoreline Management Plan in fiscal
year 2009. The entity to receive this program is the U.S. Army Corps of Engineers, Tulsa District
- Operation and Maintenance, the City of Denison and other entities will benefit from the update
of the Shoreline Management Plan.

The City of Denison made an initial application for a lease for public park and recreational
purposes with the United States Army Corps of Engineers on the Little Mineral East Cove
adjacent to Lake Texoma. This land represents a significant economic development opportunity
for the City of Denison, the County of Grayson, and the State of Texas due to the potential for
investment, tourism attraction, and other public access benefits to the area. The proposal will
attract significant investment in the community.

The land is currently owned and controlled by the U.S. Army Corps of Engineers. The Water
Resources Development Act of2007 mandated a transfer of the land to the City of Denison for
fair market value. Because Lake Texoma is managed by the Army Corps, they have told the City
that in order to approve access to the water for this project that the entire Lake Texoma Shoreline
Management Plan must be updated at a cost of $2.5 million but that it was not included in patt of
their O&M budget submission to Congress. According to the U.S. Army Corps of Engineers, the
Lake Texoma Shoreline Management Plan was opened for a 30-day review in November, 2004,
which resulted in the conclusion that a Final Environmental Impact Statement would be required ..

I am requesting funding for the Red River Chloride Control Project, TX & OK.
The entity to receive this program is the Red River Authority of Texas and Lugert Altus
Irrigation District.

This project is designed to control natural chloride brine emissions at three major
source areas to improve water quality for municipal, industrial, and agricultural use.
Improvements include constluction of a low flow dams, pump stations, and diversion
pipelines to Truscott Brine Dam. This project is a select major water strategy of the 2007
Texas Water Plan for the region and recently the state of Oklahoma expressed a renewed
interest in the Area VI element of the proj ect and supports the Area VI reevaluation
efforts undelway. Area VI is located on the Elm Fork of the North Fork of the Red River
in Harmon County, Oklahoma. I certify that neither I nor my spouse has any financial
interest in this project.

I am requesting funding for the Advance Artificial Science and Engineering


Research Infrastructure at Texas A&M University-Commerce in fiscal year 2009. The
entity to receive this program is Texas A&M University-Commerce, located at 2600
South Neal Street, Commerce, Texas 75428.

The objectives of this proposal are twofold: (1) to implement and operate a high-
powered computing grid (a virtual computing environment) that will facilitate the
solution of interdisciplinary computational and engineering models, and (2) to develop a
computational model of complex electromagnetic wave transmission, propagation, and
reception, and analyze that model using new Computational Science methods within the

This responds to your letter of April 18, 2007 seeking confirmation from the
Committee that you do not have a financial illterest in an earmark you have requested.
Based on your letter and the additional information your staff provided at Committee
counsel's request, the background in this matter is as follows,

You recently submitted a number of earmark requests for flood control and water
development projects in your congressional district. In particular, one request is for a $2
million appropriation to complete a feasibility study and develop levee il:nprovement
alternatives for areas bound by the Sacramento and Feather Rivers in Sutter COlUlty,
California. You submitted this request on behalf of the county and the City of Yuba City,
California. According to your letter, "more thm165,OOO Sutter County residents and over $2
billion in properly and lnfrastructure are protected by the levee system" in the county. You
own a 200-acre ranch in Sutter COllnty that is protected by the levees. The levees are not
located on or adjacent to yom property, The property includes a family-owned ranch and
the operations for a propane gas company. You believe that any benefit to the property
that IIlay result because of the eannark request "would be 'remote' and speculative" lllld
"would only be indirect, in the sense that [you] happen to be part of a much larger class
of Sutter County citizens who would receive the benefit of enhanced flood protection."

As you know, House Rule 23, clause 17, part of the House Code of Official
Conduct, requires that Members who request an earmark certify that the requesting Member
(and the Member's spouse) "has no flnancial interest" in the eannark. On March 27,2007.
the Committee issued an advisory memorandum that describes the factors Members must
consider when determining whether they have a financial interest in an earmark. The
Committee stated that a financial interest will exist in an eannark when it would be
reasonable to conclude that the provision would have a "direct and foreseeable effect on the
pecuniary interest of the Member,"

In the advisory memorandum, the Committee stated that an effect is foreseeable ifit
is "anticipated or predictable," and we cited 5 C.F.R. § 2640.1 03(a)(3), a regulation
promulgated by the Office of Govermnent Ethics, which defines a similar tenn,

''predictable,'' as <La real, as opposed to a speculative, possibility that the matter will affect
the financial interest:' That regulation also defines the tenn "direct" as "a close causal link.
between any decision or action to be taken in the matter and any expected effect of the
matter on the financial interest," and states that a ''particular matter that has an effect on a
financial interest only as a consequence of its effects on the generaJ economy does not have
a direct effect within the meaning of this part." For purposes of this response, we adopt that
definition. Further, the Committee stated in the memorandum that a financial interest does
not include a ''remote, inconsequentIal, or speculative interest."

Determining whether an eannark would hav~ a direct and foreseeable effect on a


Member's financial interest in real estate, under the definitions set forth in the preceding
paragraph, requires the consideration of a number of factors. Such factors may include,
but are not limited to, the following:

• the value of the real estate;


• the proximity of the real estate to the area that would benefit from the
earmark; and
• whether the real estate would be affected uniquely or as part of a class
belonging to landowners in the area generally.

Furthermore, we recognize that MembetS typically own a personal residence or other types
of property in their congressIonal district, and that Obe of a Member's principal
responsibilities is to promote the interests of the district, including by seeking funding for
roads, utilities, and other public works projects.

Based on the representations made to the Conunittee in this matter, we conclude


that it is within your discretion for you to conclude that your ranch does not constitute a
financial interest in the earmark you requested on behalf of Sutter County and the City of
Yuba City. Of primary consideration here is that you are one of 65,000 county residents
who are protected by the levee system in Sutter County. Furthermore, no specific
infonnation has been provided that would lead us to conclude that your financial interests
would be affected in any direct manner, as defined above, if the feasibility study earmark is
funded.
