Election of representatives of Employees on Council

i)
Whenever it becomes necessary for employees of the University to elect persons as members of Council as
contemplated in the MUT Statute paragraphs 9 (1) (e) and 9 (1) (g) respectively, the secretary to Council must invite all
employees to nominate in writing candidates to be elected as members of Council.
ii)
A nomination contemplated in subparagraph (1) must be lodged with the Secretary to Council on a date determined by
him or her.
iii)
Each nomination contemplated in sub paragraph (i) must be signed by at least ten employees and countersigned by the
nominee to denote his or her acceptance of the nomination.
iv)
If only one candidate is nominated in accordance with subparagraph (i), the secretary to Council declares such candidate
to be duly elected.
v)
If more than one candidate is nominated in accordance with subparagraph (i), the secretary to Council determines a date
for an election and notifies in a manner as determined by him or her the employees of such election and the names of all
such candidates.
vi)
The election is conducted by way of secret ballot.
vii)
Each academic employee is entitled to one vote in respect of nominations made in terms of paragraph 9 (1) (e) and each
administrative and technical employee is entitled one vote in respect of nominations made in terms of paragraph 9 (1)
(g).
viii)
A ballot paper sealed in the return envelope must be returned to the secretary to Council.
ix)
A ballot paper is invalid if:
a. It is received after the date determined for the election; or
b. It is not sealed in the return envelope; or
c. It is spoilt because it does not clearly indicate the candidate in whose favour the vote has been cast or because
more than one vote has been cast.
x)
The secretary to Council must take steps to ensure that employees cast one vote each.
xi)
The secretary to Council is the returning officer and may be assisted by two scrutineers nominated by the Principal and
Vice-Chancellor.
xii)
The secretary to Council declares the persons obtaining the highest number of votes in each category to have been
elected and in the event of an equality of votes, a further election must be held in accordance with paragraphs (v) to (xi).
