Deduction of Amount from the Payment Application -12

Dear Sir,
With reference to the above subject and MSK Interim Payment Application-12
Ref: msk/swa/1117/Billing_012 dated 18th September 2016, please find attached
financial status of the project. As per the financial status please be informed of the following;
1. MSK is not entitled for any payment as per the on account payment paid by the Client to the
Sub Contractors (Copy attached).
2. Advance payment Guarantee Cheque and Performance Bond Cheque is not enough to cover
the negative amount (without imposing delay Penalty and consultancy fee) which is owed
by Client from MSK, if Client terminates the employment of MSK under the contract.
3. Also if Client wish to impose delay penalty and consultancy fee on MSK, the amount in
advance Payment Guarantee Cheque, Performance Bond cheque and the retention up to date
is not enough to cover the amount owed by the Client from MSK.
Based on the above we will not recommend to paying any further amount to MSK unless Client has
any Guarantees from them.
