AFFIDAVIT OF DESISTANCE

I, _______________________., of legal age, married, with residence at P________________________, after having been duly sworn to an oath hereby
depose and state that:
1. That I am the father of ______________________. and the private-complainant
against the latter in connection with the violent threats he committed last
October 24, 2016 which incident is now the subject of the preliminary
investigation under NPS _______________________ with the City Prosecutors
Office;

2. That upon reflecting the subject incident, I have come to realize that my son
did not have the intention to commit the aforesaid threats and might have
only been brought about by his being intoxicated at that time. Moreover,
upon consultation with his personal doctor, ____________________________, I
have been informed that my son is presently suffering from a mental illness
described as PARANOID SCHIZOPHRENIA as indicated in the attached
Medical Certificate;

3. In this regard, I am formally withdrawing my complaint against my son as

his health and mental condition negates any intent to commit any
wrongdoing. More importantly, his continuing confinement at the detention
facility aggravates his mental illness and as such, we request that he be
released thereat for possible confinement in a mental institution instead;

4. That this Affidavit of Desistance is hereby entered into voluntarily solely for
the cited reasons;
