SECTION 1: Findings
Congress makes the following findings:
1) In 1996, California banned state universities from from considering
race or ethnicity in their admission decisions.
2) Test-takers of the SAT or ACT test are required to state their race or
ethnicity upon taking the test.
3) Results from the application histories of eight elite universities in
California from 1997 show Asians having the lowest acceptance rate.
4) Results from the application histories of eight elite universities in
California from 1997 show that Asians have the lowest acceptance rate in
each range of SAT test scores.
5) Results from the application histories of eight elite universities in
California from 1997 show that being Asian is equivalent to a 140 point
penalty on your SAT score.
SECTION 2: Purpose
This bill provides that students of all races or ethnicities have an equal chance of
being accepted into university, based on total acceptance rates, as well as
acceptance rates in standardized test score ranges.
SECTION 3: General Provisions
This act will require that all standardized tests do not require students to state their
race or ethnicity on the test. It will also require that an applicants race or
ethnicity will not be required anywhere in ones application to college or
university. Finally, universities, colleges, or any higher education facilities are
banned from comparing an applicants race or ethnicity with their standardized
test scores. This will prevent colleges from even having the opportunity to
discriminate applications based on the applicants racial background.
Statistics showing students admissions rates based on a specific test score range
should all be equal. No Asian student should have to have a higher test score to
have the same chance at acceptance as a Hispanic, white, or black student with
a lower test score.
Rather than looking at race as a defining factor of the decision, they instead look at
their previous education available to them, their social class and their income.
SECTION 4: Definitions
Race: a category of humankind that shares certain distinctive physical traits
Ethnicity: the fact or state of belonging to a social group that has a common national
or cultural tradition.
Standardized Test: any form of test that (1) requires all test takers to answer the
same questions, or a selection of questions from common bank of questions, in
the same way, and that (2) is scored in a standard or consistent manner, which

makes it possible to compare the relative performance of individual students or


groups of students
