government is a
constitutional monarchy with

Spain has always had a monarchy type government, in which a singular


person has rule of the country. From 1939 to 1975 Gen. Francisco Franco was
Spains ruler, and he declared Spain a monarchy and establish a legislature.

CONSTITUTIONAL FRAMEWORK
After long negotiations, the Spanish constitution was nearly unanimously
approved by both houses of the legislature in 1978. This was the official
document that declared Spain a constitutional monarchy and supports the
values of freedom, justice, equality and political pluralism. The constitution
also created the separation of powers into executive, legislature and judicial
branches.

LEGISLATURE & EXECUTIVE


The legislature is known as the Cortes Generales and is composed o two
chambers. The lower chamber is the Congress of Deputies which has 350
members who are elected for four-year terms. The upper chamber is the
Senate, which is one-fifth composed of representatives of the communitites
and the rest are elected from mainland provinces.
The prime minister, the deputy prime minister and the members of the
cabinet all make up the executive. They are the ones who handle domestic
and foreign policy, including defense and economic polices. The prime
minister is usually the leader of the party that has the most deputies because
they have to be approved by a majority vote from the people in the
legislature. They also have th epower to dismiss a prime minister through
voting as well.

There are numerous courts, the
Supreme Court which is the highest
and has five chambers. The National Court composed of three chambers and has
jurisdiction throughout Spain. Each community and provinces has their own

courts that trail criminal cases. There is also the Constitutionla Court which is in
charge of
interpreting the consitution.
