PROPOSED CONSTITUTIONAL AMENDMENTS

Section 1.
Public Policy, Legislative and Social
Responsibility - The public policy of the State and the duty
of each person is to provide and maintain a healthful
environment for the benefit of this and future generations.
Section 2. Right to a Healthful Environment - Each
person has the right to a healthful environment. Each person
may enforce this right against any party, governmental or
private, through appropriate legal proceedings subject to
reasonable limitation and regulation as the law may provide.
Section 3. The Right of Access to Information The right
of access on all matters concerning any concessions, timber
license agreements and similar agreements including the
process in the procurement of these agreements shall be
considered as public records and shall not be denied access
except in the interest of national security.
Section 4. The Right to Participate in Environmental
Decision - The public concerned shall be informed, either by
public notice or individually as appropriate, early in an
environmental decision-making procedure, and in an
adequate, timely and effective manner, inter alia, of:(a) The
proposed activity and the application on which a decision will
be taken; (b) The nature of possible decisions or the draft
decision; (c) The public authority responsible for making the
decision; (d) The envisaged procedure, including, as and
when this information subject to such limitations as may be
provided for by law.
Section 5. The Right of the Cultural Minorities to their
Ancestral Domains The right of the cultural minorities
especially the indigenous cultural people to their ancestral
domains and the resources and mineral found therein shall
be respected. The state shall not undergo any mining or
similar activities in their respective area without their
consent and in no case shall they be evicted or compelled to
move elsewhere. The state shall adopt measure to protect
their environment and culture.
Section 6. The Right of the people to Environmental Justice
No person shall be denied access on account of their race,
sex, creed or religion. The state shall ensure that every
person shall have access to clear air and clean water and
sanitation.
