This guide book has been published as reference for all importers, agents and
forwarding agents who are involved in the importation of products listed under
The Customs Ordinance (Import Prohibitions) 1998 Amendments 2003/2004.
The contents of this book have been dedicated to procedures in the importation
of construction products to Malaysia. All imported construction products to be
imported must conform to the technical specification stipulated in the respective
Malaysian Standards. The importers/agents are obliged to execute the essential
testing requirements in an effort to provide evidences on the conformity of the
imported products to the corresponding Malaysian Standards.
It is hoped that this guide book will serve as a useful reference for all
importers, agents and forwarding agents towards expediting the importation
of construction products listed under The Customs Ordinance (Import
Prohibitions).

OBJECTIVE
To enforce the compliance of the imported construction materials / product to MS.

Submission of verification application through e-permit not less than 14 days before
the arrival of the product at port .

This method can further be categorised into two. In this method the importer
can appoint any Local or Foreign CB for the issuance of PC. Hence it can be

categorised as follows:
i)
LOCAL Category
In this category, the PC is issued by a local CB accredited by
STANDARDS MALAYSIA or that which has been approved by
CIDB.
ii)
FOREIGN Category
In this category, the PC is issued by a foreign CB at source country
which is accredited by an accreditation body in that country and must
be members of PAC IAF, MLA, APLAC, ILAC, and MRA signatories.
However, in exceptional circumstances CIDB may have a direct
arrangement with the CB as and when necessary.
CIDB will carry out market sampling and results from product tests will be
given out to the relevant CBs.
f)
Upon the issuance of PC the importer shall make arrangements for CIDB
officers to visit plant for inspection and product verification. The importer is
required to make all essential arrangements with the foreign manufacturer to
expedite the plant inspection. All travel expenses, air tickets, visa, airport tax/
passenger surcharge as well as accommodations and transportation to and
from the plant will be borne by the importer.
g) The importers adopting this method of confirmity will hold the responsibility
in assuring the confirmity of products to MS specification especially product
marking.

The Laboratory Test Report can be further categorised into four as follows:

Reports must be in the English Language and in accordance to CIDB
approved format.
i.

CIDB officers will collect product samples from the manufacturing plant for
Consignment Full Test (UPK). The test report is valid for a period of 6 months
from the date of issuance. CIDB will issue the Consignment Full Test Certificate
upon receive the application for the delivery of the first consignment. This
certificate is valid for 3 months from the date of the first COA issued.
Importers are given options of having their products tested in a local or foreign
laboratory.
Notes:
i. Importers are required to submit a full set of documents to CIDB for
verification purposes at the Malaysian point of entry as stipulated in the
procedure for Importation via Product Certification, Copies of Product
Certification replaced by certified true copies of Test Results. Importers
must bear all test cost.
ii. Only declared products/models that have been passed will be cleared for
import.
iii. Only cement products are subjected to a Compulsory Critical Test on every
consignment.

This method is meant for importers who engaged the services of third party
inspection body for the purposes of certifying products to MS. This IB must
be accredited by a recognised AB. Those using this method are required to
submit their IB details to CIDB for validation. They are further required to
make essential arrangements between CIDB and the related IB, prior to actual
import of the products. The importer is also required to submit a full inspection
report from the IB to CIDB for each consignment imported.

them to a laboratory.
Notes :
CIDB is not responsible nor be held responsible for any loss/damage
on property or, any damage or injury whether directly or indirectly on
individual persons during a sampling or verification procedure by CIDB/
CB/agents or any authorised personnel to undertake the procedure with/
without CIDBs prior consent.

8.
VERIFICATION PROCEDURE
The verification procedure on inspection of product is as follows:

The importer shall contact the named Verification Officer for a confirmation on
appointment time and place. All related expenses must be borne by the importer
except for the Verification Officers transportation and meal during domestic
verification ( within Malaysia ).
c.
The verification of products can be carried out during week days or week ends.
d.
The Verification Officer shall prepare a Verification Report within 24 hours after the
inspection.
e.
The importer shall bear all the essential cost on the factory visit at the source country
by CIDB officer.
f.
Importers shall ensure the Verification Officers safety at all times during the
verification exercise. The Verification Officer has the right to withdraw from the
procedure at any time if he feels that his safety is at stake.
g.
Regardless of the manner of importation, the importer has to show that the product
being imported meets the requirements of the relevant MS. COA will only be issued
after the completion of a Verification process. Each verification process is chargeable
according to the table below. Importers who fail to arrange verification at the agreed/
fixed date, or, fail to inform CIDB a day prior to verification date will be subjected to
a second time charge and is required to make a new appointment for a verification
date.

VERIFICATION REGULATIONS
Product verification regulations that need to be complied by importers are as follows:
9.1 Verification Regulations
a)

iii. The original seal on the container shall not be removed before the
arrival of the Verification Officer.
iv. In cases where importers have to break the original seal for lab test,
the seal must be kept inside the container for inspection by the CIDB
Verification Officer.
v. The importer shall provide necessary equipment, digital camera,
forklift, manpower, machinery and other relevant appliances for the
unloading of construction product sampling from any part in the
container by the Verification Officer.

iii. Ensure that all safety measures during inspection adheres to all
safety procedures.
The importer must provide transportation for the Verification Officer to and
from the Verification location, whenever the need arises. All transportation
costs must be borne by the importer.
b) The importer or its authorised agent (via an agent authorisation letter) must be
present throughout the verification process.
c)
The importer must ensure physical safety measures are made for the Verification
Officer during the verification process.

Blacklisting of Importer

iii. Perform any form of activities that deemed to taruish the image and credibility
of CIDB.
D. Any transfer of ownership without prior consent from CIDB, the new PC holder
shall not be certified by CIDB for a period of three (3) months from the date of PC
transfered if CIDB allows the transfer to be made, then the relevant CB can then
proceed with the transfer.
Importers found violating any regulations in a COA application process will be subjected
to the following disciplinary actions:

Applications for exemption of COA can be considered based on the following criterion:
a)

Imports for laboratory tests that have been approved by CIDB. A supporting letter
from CIDB must be attached to the application.
c)
Samples taken by any CIDB official from a foreign manufacturing plant which are
meant for testing.
d)
Tiles that are not in the manufactured according to MS scope, e.g hand made tiles,
not dry pressed or extruded types, modes of manufacturing not covered by MS ISO
13006..
f)
Importation of sanitary wares of the types unintended for the purposes set out in
MS 147, MS 1522 & MS 795 such as sanitary ware not made of Vitreous China.
g)
h)
CIDB assessment reveals the limited usage of the imported materials or any other
reasons that can be interpreted justifiable by CIDB.

1. All applications for exemption must be submitted by the product owner and
accompnaied by the following documents:
i. Application letter
ii. Specifications/brochure/technical report/product images
iii. Bill of Lading/Air Way Bill/Transportation Bill
iv. Invoice
vi. Packing List
vii. Other relevant documents

Exemption of COA approval that does not fulfill the above requirements will be
determined by the Application for COA Exemption Assessment Committee.
