andexecutionofarrestwarrants,andtoexpresstheirpoliticalanddiplomaticsupportfortheCourt.

I.InvestigationsandProsecutions

Overtheweek,theOTPpresented10filingsinthevariouscasesandconducted5missionsin5countries.

I.1.SituationintheDemocraticRepublicoftheCongo(DRC)
This situation was referred by the DRC in April 2004. The OTP opened its investigation in June 2004, focusing on Ituri where the most
seriouscrimeshadbeencommittedbythemainarmedgroups.FourarrestwarrantshavebeenissuedagainstThomasLubangaDyiloand
Bosco Ntaganda, leaders of the UPC, and Germain Katanga and Mathieu Ngudjolo Chui, leaders of FNI and FRPI. The trial of Thomas
LubangaDyilobeganon26January2009.ThetrialofKatangaandNgudjoloChuibeganon24November2009.BoscoNtagandaisatlarge.
InSeptember2008,theOTPannouncedthestartofitsinvestigationintoallegedcrimesintheKivus.

1 June UN Special Rapporteur on extrajudicial, summary or arbitrary executions, Philip Alston, concluded in his DRC
missionreportthattheDRCauthoritiesrefusetoinvestigateandarrestsuspectedwarcriminals,includingBoscoNtaganda,
subjectofanICCarrestwarrant,andexpressedconcernregardingtheimpunityforseniormilitarycommanders.

I.2.SituationinUganda
ThissituationwasreferredbyUgandainJanuary2004.TheOTPopeneditsinvestigationinJuly2004.Fivearrestwarrantshavebeenissued
against top leaders of the Lords Resistance Army (LRA): Joseph Kony, Vincent Otti (allegedly killed in 2007 on order of Kony), Okot
Odhiambo, Raska Lukwiya (killed on 12 August 2006, whose arrest warrant has been withdrawn), and Dominic Ongwen. These arrest
warrantsareoutstanding.Sinceearly2008,theLRAisreportedtohavekilledmorethan1,500,abductedmorethan2,250anddisplacedwell
over300,000inDRCalone.Inaddition,overthepastyear,morethan80,000peoplehavebeendisplaced,andcloseto250peoplekilledby
theLRAinSouthernSudanandtheCentralAfricanRepublic.

2 June President Museveni in his annual State of the Nation Address, said in reference to Joseph Kony: The havoc he
occasionallywreaks in Congo or CAR will be stopped. Theworld should not just sitback and watch. The stepthe USAhastaken [the
signingintolawoftheLRADisarmamentandNorthernUgandaRecoveryBill]isawelcomedevelopment.

3JuneProsecutorMorenoOcampomettheleaderoftheUgandaPeoplesCongressparty,OlaraOtunnu,whostressedthe
importance of the work of the OTP in the case against Joseph Kony and requested new investigations on alleged crimes
committedbytheUPDF.

6JuneUNHighCommissionerforHumanRights,NaviPillay,highlightedtheimportanceofbringingLRAleaderssubject
toICCwarrantstojustice.ItismyferventwishthatthethreesurvivingLRAleadersforwhomICCarrestwarrantshavebeenissued
willverysoonbecapturedandprosecuted.PillayalsocalledontheUgandanauthoritiestoinvestigatehumanrightsviolations
duringarmyoperationstodisarmresidentsintheKaramojaregion.

I.3.SituationinDarfur,theSudan
ThissituationwasreferredbytheUNSecurityCouncilinMarch2005.TheOTPopeneditsinvestigationinJune2005.Threearrestwarrants
andonesummonstoappearhavebeenissuedagainstAhmadHarunandAliKushayb,OmarAlBashir,andBaharIdrissAbuGarda.Three
arrestwarrantsareoutstanding.TheProsecutionappealedthedecisionofthemajorityoftheChambertodismissthechargesofgenocide
against President Al Bashir. On 3 February the Appeals Chamber ruled that it was a legal error to reject the charges of genocide against
PresidentAlBashir.AbuGardavoluntarilyappearedbeforetheCourtpursuanttoasummons.Followinghisinitialappearanceon18May
2009,hewasallowedtoleaveTheNetherlands.Theconfirmationofchargeshearingwasheldon1930October2009.On8February2010the
PreTrialChamberissuedadecisiondecliningtoconfirmthecharges.TheOTPrequestedleavetoappealthisdecisionon15Marchandthis
wasdeniedbythePTCon23April.TheOTPwillpresentadditionalevidence.On25MaythePTCChamberissueditsDecisioninforming
theUnitedNationsSecurityCouncilaboutthelackofcooperationbytheRepublicoftheSudaninthecaseagainstHarun&Kushayb.

3 June UnderSecretaryGeneral for Humanitarian Affairs, John Holmes, in his briefing to the UN Security Council
highlightedthedifficultiesofaccessingmanyareasinDarfur,notingthatlittlehaschangedsincetheGovernmentofSudan
expelled more than a dozen aid groups in 2009. According to Holmes, displacement, conflict, lack of access and the
kidnappingofhumanitarianworkerscontinued.

I.4.SituationintheCentralAfricanRepublic(CAR)
This situation was referred by the CAR in December 2004. The OTP opened its investigation in May 2007. One arrest warrant has been
issuedagainstJeanPierreBembaGomboforcrimescommittedin20022003.Theconfirmationofchargeshearingwasheldon1215January
2009.On15June2009,PreTrialChamberIIrendereditsconfirmationofchargesdecision.On18September,thecasewasreferredtoTrial
ChamberIII.Thetrialissettostarton5July2010.On2728April,theTrialChamberheldahearingonadmissibility.Inparallel,theOffice
continuestomonitorallegationsofcrimescommittedsincetheendof2005.

I.5.Kenya
The Office made its examination of the postelection violence of December 2007January 2008 public in February 2008. On
9July2009,theAfricanUnionPanelofEminentAfricanPersonalities,chairedbyKofiAnnan,announcedthesubmissiontotheOTPofa
sealedenvelopecontainingalistofpersonsallegedlyimplicatedandsupportingmaterialspreviouslyentrustedtoMr.AnnanbytheWaki
Commission. On 5 November the Prosecutor informed President Kibaki and Prime Minister Odinga of his view that crimes against
humanity had been committed and of his duty, in the absence of national proceedings, to act. Both the President and the Prime Minister
committed to cooperate with the Court. On 26 November the Prosecutor requested authorization from PreTrial Chamber II to open an
investigation,noting that: 1,220 persons had been killed;hundreds raped, with thousands more unreported; 350,000 people were forcibly
displaced;and3,561injuredaspartofawidespreadandsystematicattackagainstcivilians.On31MarchthePreTrialChamberauthorized
the Prosecutor to commence an investigation covering alleged crimes against humanity committed during the events that took place
between1June2005and26November2009.TheProsecutormadehisfirstvisittoKenyasincethebeginningoftheinvestigationon812
May.

1JuneKenyasAttorneyGeneral,AmosWako,informeddelegatesattheopeningsessionoftheICCReviewConferencethat
theKenyanGovernmentisfullycommittedtocooperatingwiththeICC:ThePresidentandthePrimeMinisterhaveassuredthe
ProsecutoroftheICCoftheirsupportfortheongoinginvestigationandprosecution,ifany.

II.PreliminaryExaminations

StatisticsonArticle15Communicationsandotherpreliminaryexaminationactivities.

ApreliminaryexaminationisthefirstphaseoftheOfficeoftheProsecutoractivities,inordertoassessifaninvestigationshouldbeopened.
ItisaphaseduringwhichtheOfficefirstassessesthejurisdictionoftheCourt,whethercrimesfallingundertheICCjurisdictionmayhave
been,orarepossiblybeing,committedinagivensituation;iftheconditionsaremet,whethergenuineinvestigationsandprosecutionsare
being carried out by the competent authorities in relation to these crimes; and, as a third step, whether the possible opening of an
investigationbytheProsecutorwouldnotgoagainsttheinterestsofjustice.Duringthisphase,andinaccordancewithArticle15,theOffice
proactively evaluates all information on alleged crimes from multiple sources, including communications from individuals and parties
concerned.Thetriggeringofapreliminaryexaminationdoesnotimplythataninvestigationwillbeopened.

7JuneFollowingquestions,theOTPclarifiedthatSriLankaisnotaStatePartytotheRomeStatute.However,theICCcould
potentiallyhavejurisdictionovercrimescommittedbynationalsofStatePartiesontheterritoryofSriLanka.

II.1.Afghanistan
TheOfficemadeitsexaminationpublicin2007.ItexaminesallegedcrimeswithinthejurisdictionoftheCourtbyallactorsinvolved.The
OTP met outside Afghanistan with Afghan officials and organizations. The OTP sent requests for information to the Government of
Afghanistanandhasnotyetreceivedananswer.

II.2.Colombia
The Office made its examination public in 2006. It examines alleged crimes within the jurisdiction of the Court and
investigations/proceedingsconductedinColombiaagainsttheallegedlymostseriousperpetrators,paramilitaryleaders,politicians,guerrilla
leaders and military personnel. The Office is also analysing allegations of international networks supporting armed groups committing
crimesinColombia.

II.3.Georgia
TheOfficemadeitsexaminationpublicon14August2008.TheGeorgianMinisterofJusticevisitedtheOTP.Russia,aStatenotPartytothe
Statute,hassent3,817communicationstotheOTP.TheProsecutorrequestedinformationfromtheGovernmentsofRussiaandGeorgiaon
27August2008.BoththeRussianandGeorgianauthoritiesresponded.TheOfficeconductedavisittoGeorgiainNovember2008andto
RussiainMarch2010.

II.4.Palestine
On 22 January 2009, the Palestinian National Authority lodged a declaration with the Registrar under Article 12(3) of the Rome Statute
whichallowsStatesnotpartytotheStatutetoaccepttheCourtsjurisdiction.TheOTPwillexamineissuesrelatedtoitsjurisdiction:first
whetherthedeclarationacceptingtheexerciseofjurisdictionbytheCourtmeetsstatutoryrequirements;andsecondwhethercrimeswithin
the Courts jurisdiction have been committed. The Office will also consider whether there are national proceedings in relation to alleged
crimes.AdelegationfromthePalestinianNationalAuthority,andRepresentativesoftheArabLeaguevisitedtheCourton1516October
2009 to present a report in support of the PNAs ability to delegate its jurisdiction to the ICC. On 11 January, the OTP sent a letter
summarizingitsactivitiestotheUnitedNationsattheirrequest,inthecontextoffollowingupontheGoldstoneReport.On3May,theOTP
published a Summary of submissions on whether the declaration lodged by the Palestinian National Authority meets statutory
requirements.TheOTPhasnotmadeanydeterminationontheissue.

II.5.CtedIvoire
TheCourthasjurisdictionoverthesituationinCtedIvoirebyvirtueofanArticle
12(3) declaration submitted by the Ivorian Government on 1 October 2003. The
declarationacceptsthejurisdictionoftheCourtasof19September2002.Themost
serious crimes, including alleged widespread sexual violence, were committed in
20022005. On 1718 July 2009, highlevel representatives of the OTP visited
Abidjan.

Ocampo met with Cte dIvoire Minister of Justice, Mamadou Kon, who
briefedtheProsecutoraboutrecentdevelopmentsintheirjudicialactivities.

II.6.Guinea
TheOfficemadeitsexaminationofthesituationinGuineapublicon14October2009.GuineaisaStatePartytotheRomeStatutesince14
July2003and,assuch,theICChasjurisdictionoverwarcrimes,crimesagainsthumanityandgenocidepossiblycommittedintheterritory
of Guinea or by nationals of Guinea, including killings of civilians and sexual violence. The Office has taken note of serious allegations
surroundingtheeventsof28September2009inConakryinaccordancewithArticle15oftheStatute.On12,13and15January2010,OTP
high level representatives held consultations with President Compaore of Burkina Faso, mediator for the contact group on Guinea, and
PresidentWadeofSenegaltoensurethattheyarefullyinformedofitsongoingwork.From15to19February2010,theOTPsentamission
toGuinea,ledbyDeputyProsecutorFatouBensouda,inthecontextofitspreliminaryexaminationactivities.From1921MayasecondOTP
missionmet with the Guinean Minister of Justice, Col. Lohalamou, and Guinean judges. The Guinean authorities extended full cooperation
to the Court.

1JuneGuinea,duringasideeventoncooperationorganizedbytheCICC,indicateditwasdedicatedtoimplementnational
proceedingsunderOTPcontrolandevaluation.

III.CooperationGalvanizingEffortstoArrest

ContinuationofthecoverageoftheReviewConference

1JuneProsecutorMorenoOcampometwithSouthAfricaDeputyMinisterof
JusticeandConstitutionalDevelopment,AndriesNell,anddiscussedissuesof
cooperation.

2 June Deputy Prosecutor Fatou Bensouda met with Botswana Minister of


Justice, Defence and Security, Ramadeluka Seretse, and Attorney General,
AthaliahMolokomme,andthankedthemforBotswanassteadfastsupportfor
theCourt.

2JuneProsecutorMorenoOcampoparticipatedinaworkinglunchorganizedbytheEuropeanParliamentdelegationand
discussedEuropeancooperationwiththeCourt.

keynote speaker Radhika Commaraswamy, UN Special Representative of the SecretaryGeneral for Children and Armed

2 June During the stocktaking panel on Peace and Justice, chaired by Kenneth Roth, Executive Director of Human Rights
Watch,thepanelistsagreedthatthisisanewworldwithamnestiesforRomeStatutecrimesoffthetable.KennethRothcalled
onStatestodemonstratetheircommitmentthroughexecutingarrestwarrantsandstandingupfortheICC.

3 June Prosecutor MorenoOcampo delivered a statement during the stocktaking discussion on Complementarity. The
Prosecutor highlighted that positive complementarity is about States assisting one another, receiving additional support from the
internationalCriminalCourtitselfaswellasfromcivilsocietytomeetRomeStatuteobligations.

3JuneDuringthestocktakingpanelonCooperation,formerICCPresident,PhilippeKirsch,notedthatpublicanddiplomatic
support, notably for the execution of arrest warrants, was of considerable importance in the achievement of successful
cooperationbetweenStatesPartiesandtheCourt.StatesPartiescouldcontributetothisbyregularlyremindingothersofthe
Courtsimportance,inparticularwhencircumstancesweredifficult.Moreover,thecooperationbynonStatesPartieswasof
crucialimportancetotheCourt.

3 June Prosecutor MorenoOcampo met with UN High Commissioner of Human Rights Navi Pillay and discussed
cooperationbetweentheorganizations.

3 June Prosecutor MorenoOcampo met with Rwanda Minister of Justice, Tharcisse Karugarama, as well as with DRC
MinisterofJusticeandHumanRights,LuzoloBambiLessa,todiscussissuesofcooperationwiththeCourt.

3JuneDeputyProsecutorFatouBensoudametwithMaliMinisterofJustice,MaharafaTraor,whounderlinedthesupport
ofhiscountryfortheCourtandtheworkoftheOTP.

5JuneTheUgandaPresidentsofficeindicatedthatPresidentAlBashirhasnotbeeninvitedtotheAfricanUnionsummitin
KampalainJuly,andthatSudanwouldberepresentedbyotherGovernmentofficials.Accordingtoreports,aspokesman
for the President said: Uganda has not invited Al Bashir because the findings of (the) AU select committee headed by former South
Africanleader,ThaboMbeki,donotdifferwiththatoftheICC.UgandalaterclarifiedthathewouldbeinvitedbutUgandawould
abidebyitsobligationundertheRomeStatute.
