A pplicant: Submit this application and the following additional items to the Lansing City Clerk's

4133. A pplication must be submitted to the City Clerk with supporting documentation at least

1. Proof of insurance coverage for public liability of $500,000 for injury to one
person and $1,000,000 for injury to two or more persons resulting from the same
accident. The certificate of insurance or bond shall provide a minimum of
$500,000 property damage and the City shall be named as co-insurer on the
certificate.

Basis of Eligibility
As to the eligibility of this project under the OPRA legislation, investigation of the
property on March 23, 2010 by the City Assessor concluded the following:

'The subject property was originally designed/used as a retail store or restaurant with
either supporting office space or living space in the upper floors. The inspection of the
property revealed physical deterioration resulting from rotting floor joists, interior water
damage from leaking roofs and inadequacies of design in location of basement
entrances. The subject property lacks compliance with current ADA (Americans with
Disabilities Act) standards with the only restrooms for the restaurant located in the
basement with no handicap access. The property also suffers from curable and
incurable obsolescence requiring modernization. If the subject property were continue to
be utilized as a restaurant, as it was originally designed, all of the plumbing, heating and
cooling mechanical systems along with the electrical systems would need to be updated
or installed, to provide for efficient operation.

In conclusion, the property located at 104 S. Washington Square., parcel identification


number 33-01-01-16-325-070 suffers from obsolescence, as defined by the State of
Michigan Assessor's Manual and the Brownfield Redevelopment Financing Act."

The OPRA tax abatement is a significant component of this project. The petitioner has
estimated the renovation costs at approximately $2.9 Million. Renovations are

This form is issued as provided by Public Act 146 of 2000, as amended. This application should be filed after the district is established. This project will
not receive tax benefits until approved by the State Tax Commission. Applications received after October 31 may not be acted upon in the current year.
