3. SanctionforProsecution
1. It provides that previous sanction of the competent authority is necessary before a court
takes cognizance of the offences. The objective is to prevent harassment to honest public

handedorincasesofpossessingassetsdisproportionatetotheirknownsourcesofincome.
3. In many cases, the issue of the validity of sanctions gets raised after the prosecution has

1. Whenpublicservantscauselosstothestatebytheircorruptacts,theyshouldbemadeto
payback.Thisshouldbeputinthelaw.Adequatesafeguardsshouldbetheresothatbona

5. ConfiscationofProperties
1. The Act provides for confiscation of assets of public servants in excess of their known
sourcesofincome.However,theprovisionhasprovedinadequatebecausesuchforfeitureis
possibleonlyonconviction.
2. Anothershortcomingisthattheprocedureforattachmentcanstartonlyafterthecourthas
taken cognizance of the offence. In actual situations, this may be too late as the accused
maygetenoughtimetohideit.
3. The third weakness is that the government has to authorize the filing of a request seeking
attachment.
4. While seeing the property, the 'relatives' of the civil servant should also be seen and the
burdenofproofshouldbeonthemthatsuchpropertywastransferredforbonafidereasons

5. Benami transactions should be prohibited altogether and such properties confiscated.
