Guam War Claims Program Authorized by Congress

PobleteTamargo, LLP is pleased to announce that the enactment of the National Defense
Authorization Act
of 2017 includes the creation of a Guam War Claims Program.
PobleteTamargo, a federal regulatory, international law and claims firm, was honored to have
provided advice to a bipartisan team of Guam and Congressional leaders during this process.
After a long time waiting, this program will help bring justice to victims of World War II
atrocities.
Mauricio Tamargo, a PobleteTamargo partner, chaired the Guam War Claims Review Commission
eleven years ago. The Commissions report, approved unanimously by Commission members,
became the bases for this legislation. Tamargo, the former Chairman of the FCSC, t estified
several times before Congress about the need for a claims program.

Many details still need to be developed in the coming months by the Foreign Claims Settlement
Commission at the Department of Justice, which Tamargo chaired for eight years until 2010. The
basic outline of the Program is four categories of claims and the amounts of awards are:
Death Claim
Award is $25,000, to certain heirs of those who died during the Japanese
occupation.
Rape or Severe Personal Injury
Award is $15,000, to certain survivors of the Japanese occupation who are still
living today and who suffered these relevant injuries.
Forced Labor or Personal Injury
Award is $12,000, to certain survivors of the Japanese occupation who are still
living today and who suffered these relevant injuries.
Forced March or Internment or In hiding
Award is $10,000, to certain survivors of the Japanese occupation who are still
living today who suffered these relevant injuries.
