3.Purposeoftheinspectionanditsjustification
a)TheRequesterisnotanattorney,buthespecializesin
documentingFraudUpontheCourt
TheRequesterisnotanattorneyandhasnoformallegaleduction.
However,hisexpertiseinexaminationofcourtprocessandcourtrecords
hasbeeninternationallyrecognizedoverthepastdecade(seearticle4,
below).
Therecords,whichtheRequesterhasachancetoobserveininstant
courtfileraiseconcernsregardingthenatureofcourtprocessininstant
courtfilepursuanttothelawoftheStateofIsrael,orasjudicialprocess
inanycompetentcourt.
Giventheunderlyingmatterstreetdwellerssheltersinthepublicspace
andthesuspicionofseriousperversions,theRequesterisinterestedin
additionaldetaileddocumentationoftherecordsandprocessininstant
courtfileforinclusionintheupcomingUniversalPeriodicReviewof
HumanRightsinIsraelbytheUNHumanRightsCouncil(Attachment
A).
Theobviousconcernisthattherecordsandprocessininstantcourtfile
areanadditionalexampleofconditionsthathavebeenrecently
describedinmediabyseniorlegalscholarsasatotaljungleinthe
courts.[5]
b)TheRequesterisnotapartyininstantcourtfile,butnowheis

TheRequesterisastreetdweller,whohasresidedintheVolovelsky
Gardenforover4yearsinaproteststent(Figure1).

Indoingso,theRequesterexercisestherighttoprotest,pursuanttoa
November2012agreementbetweenprotestactivistsandtheCityofTel
Aviv,andsimilartoprotesttents,whichstandandstoodinother
locationsinIsrael.TheRequesterhasextendedtheagreementona
monthlybasis.
TheRequesterhasneveraskedforanyhousingassistanceoranyother
welfareservicesfromtheCityofTelAvivoranyotherStateauthority.
TheRequesterisnotaparty,butisaffectedbycourtprocessininstant
courtfile,asdetailedbelow.
Inrelationshiptoinstantcourtfile,CityofTelAvivhastakenactionsin
recentdaysagainsttheRequesterofInspection,whichareperceivedas
extortionunderthecoloroflaw,asdetailedbelow.
c)TheRequesterisunabletoidentifythefundamentalsofDue
ProcessininstantcourtfileandintheOutline.
TheRequesterhasrecentlyattemptedtofollowuponprogressininstant
courtfile,buttheRequesterisunabletoidentifythefundamentalsof
DueProcessininstantcourtfile,asdetailedbelow.
Initialexaminationraisesseriousconcernsthatcourtprocessininstant
courtfilelacksanyfoundationinthelaw,thatpartieswereneverduly
designated,thatpersonswhoarenotpartiesbecamepartofinstant
courtfile,thatattorneysappearedasCounselwithnocertificateof
counsel,andthatJudgeEliyahuBacharissuedsimulated(fabricated/
draft)courtrecordsininstantcourtfile.
AdditionalseriousconcernwasraisedthatCityofTelAviv
(Respondent)isnowengagedinarbitraryandselectiveenforcement
underthecoloroflawandcourtauthority,basedonrecordsandprocess
ininstantcourtfile.TheOutline,whoselawfulnessandvalidityare
perceivedasdubious,isemployedforextortion:
(1)Attempttocoercepersons,whoarenotpartiestoinstantcourtfileto
subjectthemselvestotheauthorityofaparticularsocialworker,withno
foundationinthelaw.
(2)Arbitraryandselectiveenforcementitisalreadyclearthatthe
OutlinewillbeenforcedonlyonIsraelicitizens,butwillnotbe
enforcedonourgoodneighborsinVolovelskyGarden,whoarenot
Israelicitizen(Iraqicitizens),butareStatePersons(thatwasthe
explanationwhichwasprovidedbyCityofTelAvivinpreviousyearsfor
thearbitraryandselectiveenforcement).
(3)Threatsofimmediatedemolitionofthesheltersofstreetdwellers,
wholiveinthegarden,iftheywerenotpartytothecourtprocessin
instantcourtfile.

(4)Attempttodeprivetheexerciseoftherighttoprotestinthegarden,
asagreedfollowingtherelocationoftheRothschildprotestcampto
VolovelskyGardeninNovember2012.
d)TheRequesttoInspectalsoservesasanoticetoJudgeEliyahu
Bacharregardingseriousconcernsofperversionofrecordsand
processininstantcourtfile,expectingtheinitiationsuasponteof
correctivemeasures.
ByfilinginstantRequesttoInspect,thefileralsonotifiesJudgeEliyahu
Bacharregardingtheconcernsofvalidityandeffectofrecordsand
processininstantcourtfile,andconductoftheCityofTelAviv,
purportedlyfoundedonprocessininstantcourtfile.Consequently,itis
expectedthatacompetentandhonestjudgewouldinitiatesuasponte
correctivemeasures.

rightsofotherpersonsevictionanddemolitionofsheltersofstreet
dwellersinVolovelskyGarden(theGardenDwellers).
JudgeEliyahuBacharpurportedlyapprovedtheOutline,basedon
agreementbypurportedCounsel.However,suchagreementdoesnot
freeJudgeBacharfromthedutytoexaminewhethertheagreement
betweenpurportedCounselfallswithingtheboundariesofthelaw,
fairness,reason,andadequacy.[7]

enforcementpersonvisitedandplacedanoticeonmyprotesttent.I
wastoldthatothersreceivedsimilarnoticesonthesameday,andwere

Workertoavoidcitydemolitionactionagainstthem.Thenextmoring,
whenIfoundthenoticeitwasillegibleduetotherain.

determinedthatthetemporarypermitfortentsinthe

For example, in a case that was subject of worldwide reporting following the 2008 banking
crisis, counsel for the SEC and Bank of America appeared in the US District Court, Southern
District of NY, and asked the Judge for approval of a Settlement. The process originated
in the unlawful taking by executives of USD 5.8 billions, and the Settlement was based on
the payment of USD 33 in fines to the SEC by the Bank shareholders (victims of the
unlawful taking), with no return of any of the unlawfully taken funds by the executives.
Judge Jed Rakoff rejected the Settlement, and wrote:
When, however, as in the case of a typical consent judgment, a ... agency seeks to
prospectively invoke the Courts own... power... the resolution has aspects of a judicial
decree and the Court is therefore obliged to review the proposal a little more closely, to
ascertain whether it is within the bounds of fairness, reasonableness, and adequacy

OccupyTLVcamp,whichismysoleresidenceoverthepast4years,andwhereIkeepallmy
belongingsasaTelAvivStreetDweller.
OnMondayeveningIheardthatamunicipalityenforcementpersonplacedanoticeonmy
tent,andthatifIwishedtopreventmunicipalityactionsagainstme,Ihadtoimmediately
registerwithaspecificsocialworker.Ifoundthenoticethenextmorning,butitwasentirely
unreadableduetotherain.
OnTuesdaymorningIwenttoMrZlufsofficeandaskedforacopy,whichwasemailedto
meandwhichIreceivedthismorning.
AlsoonTuesdaymorning,municipalityandIsraelPoliceappearedinthecampwitha
bulldozerwiththeintentofstartingthedemolitionofstreetdwellersshelters.Municipal
enforcementpersonAsulinexplainedtomethattheymaystartdemolishingmytentwithin4
hours.
SuchconductfailstomatchpublicstatementsbyMayorHuldai,pertainingtosocialprotest
andthetreatmentofstreetdwellersinTelAviv.
Suchconductalsofailstomatchthedescriptionofthecitysactionsandtheirpurportedlegal
foundation,aspublishedthismorning(Wed)inMaariv,andwhichreadsasinformation
derivedfromthemunicipalitysspokespersonskeyboard:
Thisisnotaneviction,butanongoingjointagreement,whichreceivedthe
validityofacourtdecisionAdditionally,itwasprovidedthatthetemporary
permissionfortentsintheparkwouldendbyMay31.[1]
Accordingtohearsay,petitionforatemporaryrestrainingorderwasfiledincourtalready
yesterdaybyothersinthismatter.
Itismyintentionaswelltoaddressthematterincourtandwiththeappropriateauthorities
ofTelAvivmunicipality.However,Iamunabletotakeanyaction,ifIhavetostandon

As in previous years, TLV Muni initiated a new winter offensive...
Yesterday, in the midst of a rainstorm, TLV muni and Israel police arrived at the camp with a bulldozer to start
demolishing tents. Some media were on location. TLV Muni placed notices on some of the tests, demanding that they
be removed within 4 hours or face demolition.
In contrast, news report, which reads like a release be TLV Muni spokesperson says that "it is not eviction, but
ongoing joint agreement that received the force of a court decision.... the temporary permit for tents in the park will
end on May 31."

courts.
TheRequesttoInspectraisesconcerns,includingbutnotlimitedto:
a)Validityandlawfulnessofcourtprocess,whereattorneysappearedasCounselwithno
certificatesofcounsel,inacourtprocess,whereitisimpossibletoclearlyidentifythe
parties;
b)TheusemadebytheCityofTelAvivoftheOutlinewhichwastheoutcomeofsuch
courtprocess,inanattempttodeprivethefundamentalrightsoftheGardenDwellers,

anduncertified.Suchrecord,onitsface,isnotavalid,effectualandenforceable
courtrecord.\

2. Therecordsininstantcourtfilearealsorequiredforfilingwithinternational
forums,includingtheupcomingUniversalPeriodicReviewofHumanRightsin
IsraelbytheUNHumanRightsCouncil.Therefore,IhereinrequestthatJudge
ShlomitBenYitzhakordertheOfficeoftheClerktoprovidemeacopyofthe

pertainingtotheChiefClerksofthevariouscourtshavesofarfailedtogenerate
anydocumentationoflawfulappointmentofanyChiefClerk.
Therefore,insofarastherequestedcertificationissignedbytheChiefClerkof
theTelAvivDistrictCourt,Ihereinrequestthatitbeaccompaniedby
documentationoflawfulappointmentofthatpersonasChiefClerk.

CertificationbytheMagistrateoftheCourt:
TheCourtsAct1984,Article105(a)says:
105(a)TheMagistrateoftheCourtoftheSupremeCourt,theDistrict
Court,andtheMagistrateCourtshallserveinanyauthoritythatwas
vestedintheChiefClerkoftherespectivecourt,andperformanyduty
assignedtotheChiefClerk.
Therefore,incasethereisnolawfullyappointedChiefClerkintheTelAviv
DistrictCourt,thePostitDecisionrecordsmaybedulycertifiedbythe

5.
Forgeryofcertificationbylawfullyunauthorizedpersons:
TheCourtisexplicitlyrequestedthatthecertificationnotbesignedbyan
unauthorizedperson,suchasTheJudgessecretary.Inacompetentcourt,the
certificationofcourtrecordsbylawfullyunauthorizedpersonswouldbedeemed
forgery.

Certificationlanguage:
(a)Thecertificationlanguageshouldbethat,whichisexplicitlyprovidedinthe

JudgeEliyahuBacharincollusionwiththeCityofTelAvivinordertodeprive
streetdwellersandprotestersfundamentalrightsunderthefalseappearanceof
courtaction.
