PRESIDENT REPUBLIC OF INDONESIA LAW OF THE REPUBLIC OF INDONESIA NUMBER 74 OF 2001 REGARDING HAZARDOUS AND TOXIC WASTE MANAGEMENT PRESIDENT REPUBLIC OF INDONESIA Considering : a. that to increase the development activities in many sectors mainly trade and industry sector, there are tendency getting to increase the usage of hazardous and toxic waste; b. that to the present, there are some ‘laws which regulate the hazardous and toxic waste management, but it is not sufficient yet mainly to prevent the pollution and or the damage of environmental; that the prevention of impact which can damage the environment, human health, and others living creature required the integrated hazardous and toxic waste management according to the development of science and technology; d. that based on consideration is as mentioned in letter a, b, and c and to conduct the stipulation of article 17 subsection (3) law number 23 of 1997 Regarding environment management, it is necessary to stipulate 1 In view of the government regulation regarding the hazardous and toxic waste management; Articte subsection (2) constitution 1945 has been changed with the third changing of constitution 1945; law Number 1 of 1979 Regarding Job safety (State Gazette of 1970 Number 1); Law Number 14 of 1992 regarding traffic and road transportation (State Gazette of 1992 Number 49, Addendum of State Gazette Number 3480); Law Number 21 of 1992 regarding navigation (state gazette of 1992 Number 98, Addendum of State Gazette Number 3493); law Number 23 of 1992 regarding the health (State Gazette of 1992 Number 100, Addendum of State Gazette Number 3495); Law Number 10 of 1995 regarding the custom (State Gazette of 1992 Number 75,Addendum of State Gazette Number 3612); Law Number 23 of 1997 regarding environmental management (State Gazette of 1997 Number 68, ‘Addendum of State Gazette Number 3699); Law Number 22 of 1999 regarding local government (State Gazette of 1999 Number 60, Addendum of State Gazette Number 3839); Government regutation Number 7 of 1973 regarding supervision on circulation, storage and usage of pesticide (State Gazette of 1973 number 12); . Government regulation number 18 of 1999 regarding hazardous and toxic waste management (State Gazette of 1999 Number 31, Addendum of State Gazette number 3815); has been changed with Government regulation Number 85 of 1999 regarding the change of government regulation number 18 of 1999 regarding Hazardous waste and toxic waste management (State Gazette of 1999 Number 190, Addendum of State Gazette Number 3910); DECIDES : To stipulate : GOVERNMENT REGULATION REGARDING THE HAZARDOUS AND TOXIC WASTE MANAGEMENT CHAPTER I GENERAL PROVISIONS Article 1 In this Government regulation what is meant by: L Hazardous and toxic waste then abbreviated by B3 is the material due to its nature and or concentration and or amount, both directly and indirectly, can pollute and or damage the environment, and os endanger the environment, health, the continuity of human life and other living creatures; The management of B3 is activity which produce, transport, circulate, store, consume, and or dump the B2; Registration of B3 is registering and Numbering of B3 in the area of Republic of Indonesia; Storage of B3 is technique of B3 placement activity to keep the quality and quantity of B3 and or to prevent the negative impact of B2 to the environment, human health, and other living creatures; Packaging of B3 is activity of packing, filling or putting B3 in the container and or package, covering and or sealing it; Symbol of B3 is the picture which showing the classification of B3; 10. 1 12. 13. 14. 15. 1 a 1 1 8 20. 8 Label is short description which showing the classification and kind of 83; Transportation of B3 is activity of transboundary 83 from one place to other by using the means of transport; Limited B3 used are B3 which is limited by its usage, import and or production; Forbidden B3 used are kind of B3 which is forbidden to use, produced, circulated and or imported; Import of B3 is the activity of entering B3 into the area of Indonesian custom; Export of B3 is the activity of releasing B3 out of are of Indonesian custom; Notification of export is announging first of exporter country authority to the receiver and transit country authority if it will be conducted border crossing transfer of limited B3 used; Notification of export is announcing first of exporter country authority if it will be border crossing transfer of limited B3 used and or imported first; People are personal people, and or group of people, and or corporate body; . Responsibility of institution is the institution which responsible in environment impact controlling sector; - Authority of institution is the institution which authorize giving the Permit, supervising and other this according the each other sectors; - Commission of B3 is independent body which has function to give 21. suggestion and or consideration to the government in managing B3 in Indonesia; Governor is head of provin Mayor/regent is head of municipality/district; Minister is minister who has been given the task of managing the environment; Article 2 The arrangement of B3 management purposes to prevent and or decrease the risk of B3 impact to the environment, human health and other tiving creature. Article 3 The management of B3 Excludes in the scope of government regulation which are management of radioactive material, explosive material, the result of mining, Petroleum, gas and its processed production, food and beverage and other food additive material, supplies of cosmetics and household health, pharmacy stock material, drugs, psychotropic. Its precursor and other additive solution, chemical and biology weapon. Article 4 Every person who conduct the management activity of B3 obligation to prevent the pollution and or the damage of environment. CHAPTER II CLASSIFICATION OF B; Article 5 (1) 83 can be classified as follows: a. Explosive; Oxidizing: b. Extremely flammable; d. Highly flammable; fe. Flammable; f. Extremely toxic: g. Highly toxic; h. Moderately toxic; i. Harmful; Corrosive; Irritant; Dangerous to the environment; . Carcinoginec; Teratogen ©. Mutagenic; (2) Classification of B3 is meant in subsection (1) consist of: a. B3 can be used; a b. BB is forbidden to use; and © Limited B3 is used. (3) 83 is meant in subsection (2) inserted in the attachment of this government regulation. PacrS CHAPTER III IMPLEMENTATION AND MANAGEMENT OF B3 Article 6 (1) Every B3 obligation to be registered by producer and or importer. (2) Obligation to B3 registration as mentioned in subsection (1) conduct 1 (once) of 83 which produced and or imported for the first. (3) B3 registration as mentioned in subsection (1) which: a. Include in the provision of Article 3, proposed to the authorized institution according to the existing regulation provision; b. Exclude in the provision of article 3, proposed to the responsibility of institution. (4) The institution which authorized to give the registration rumber of B as mentioned in subsection (3) letter a sending its copy to the responsibility of institution. (5) The institution which responsible to give the registration number of B3 as mentioned in subsection (3) letter b sending its copy to the authority of institution. (6) Registration manners as mentioned in subsection (5) and national registration system of 83 is stipulated by the decision of the responsibility of head institution. Article 7 (1) Every person who conduct the export activity of limited 83 used, obligation to send notification to the authority of country of export destination, the authority of transit country and the responsibility of institution. (2) Export B3 as mentioned in subsection (1) only can be conducted after approving of country authority of export destination, country authority of transit and the responsibility of institution. (3) Approval of the responsibility of institution as mentioned in subsection (2) is the basic of publishing or refusing the permit export of authorized institution in trade sector. Article 8 (1) Every person who conducts the activity of import the limited B3 used and or imported for first time, obligation to foltow the notification procedure. (2) Notification as mentioned in subsection (1), obligation to be sent by country authority of exporter to the responsibility of institution. (3) The institution responsible for obtigation to answer the notification as mentioned in subsection (2) at least 30 (thirty) days of working since the date of receiving this notification application. Article 9 (1) Every person who conducts the import activity of the New B3 to exclude in the list as mentioned in article 5 subsection (3), obligation to follow the notification procedure. (2) Notification as mentioned in subsection (1) obligation to be sent by the authority country if exporter to the responsibility of institution (3) The institution which responsibility for as mentioned in subsection (2) to announce immediately to commission of B3 asking for suggestion and or consideration of commission of B3. (4) Commission B3 gives the suggestion and or consideration to institution which responsible for 83 as mentioned in subsection (1). (5) Based on suggestion and or consideration which is given by commission 83 to the responsibility of institution, so that institution responsible for: a. Proposing the change of'attachment of this government regulation; and b. Giving the approval to the authorized institution in trade sector as basic of publishing or refusing import permit. Article 10 Notification manners as mentioned in Article 7 subsection (1), Article 8 subsection (1) and Article 9 subsection (1) are stipulated by decision of the responsibility of head institution . Article 11 Every person who produce B3 obligation to make the material safety data sheet. Article 12 Every party responsible for transporting, storing, and circulating B3 obligation to enclose material safety data sheet as mentioned in Article 11. Article 13 (1) Transportation of B3 obligation to use the means of properly transportation of its operation and implementation according to transportation manners which is arranged in the existing regulation. (2) The means requirement of transportation and its manners as mentioned in subsection (1) is stipulated by the authorized institution in transportation sector. Article 14 Every B3 which is produced, transported, circulated, stored obligation to pack according to its classification. Article 15 (1) Every package of 83 obligation to be given the symbol and label and completed by material safety data sheet. (2) The manners of packaging, giving the symbol and label are as mentioned in subsection (1) stipulated by the decision of the responsibility of head institution. Article 16 (2) In the case of package B3 break down for: ‘a. 83 which be repack, its package obligation to be conducted by the dealer; b. B3 which can not be repack, and can cause pollution and or damage of environment and or human health, so that the dealer obligation to conduct the prevention. (2) B3 as mentioned in subsection (1) letter a and b, are stipulated deeply by the decision of the responsibility of head institution. (3) In the case of decision of head institution responsible for as mentioned in subsection (2) not available yet, so that manners of handling B3 as mentioned in subsection (1) refers to the existing science norm. Article 17 (1) In the case of symbol and label is damage. It is obligation to be given new symbol and label. (2) The responsibility of giving symbol and label is as mentioned in subsection (1) to the damage in steps: The production, its responsibility is on the producer; b. The transportation, its responsibility is on the person who responsible for the activity of transportation; c. The storage, its responsibility is on the person who responsible for the activity of storage; (3) Manners of giving symbol and label as mentioned in subsection (1) is stipulated by the decision of the responsibility of head institution. Article 18 (1) Evety place of B3 storage obligation to be given symbol and label. (2) Place of B3 storage as mentioned in subsection (1) obligation to fulfilt the requirement for the: a. Location; b. Building Construction. © *: (3) Requirement Criteria of storage place of B3 as mentioned in subsection (2) is stipulated more by the decision of responsibility of head institution. Article 19 The management of storage place of B3 is as mentioned in article 18 subsection (2) obligations to be completed by the system of emergency responsive and the procedure of B3 Handling. Article 20 The expired B3 and or not fulfill the specification and or ex sachet, obligation to be managed in the relation of the regulation in management sector of Hazardous and toxic waste. 10 CHAPTER IV THE COMMISSION OF B3 Article 21 (1) In the scheme of management 83 formed commission of B3 which has the task of giving the suggestion and or the consideration to the government. (2) The commission of B3 as mentioned in subsection (1) can consist of some sub commission of B3. (3) The membership arrangement of B3 commission as mentioned in subsection (1) consists of deputy of authorized institution, deputy of responsibility institution, deputy of the related institution, deputy of university, environment, organization, and association. (4) The arrangement of membership, task, function, and organization of B3 commission as mentioned in subsection (3) stipulated by the decision of President. CHAPTER V JOB SAFETY AND HEALTH Article 22 (1) Every person who conducts the activity of B3 management obligation to keep the job safety and health. (2) Obligation as mentioned in subsection (1) is conducted according to the existing regulation. (3) In implementation the obligation is as mentioned in subsection (1) the person responsible for the activity of 83 management obligation to participate his employees role. (4) The role according to the manual stipulated by the authorized institution in employment sector. 11 a. The production, its responsibility is on the producer; b. The transportation, its responsibility is on the person who responsible for the activity of transportation; c._ The storage, its responsibility is on the person who responsible for the activity of storage; (3) Manners of giving symbol and label as mentioned in subsection (1) is stipulated by the decision of the responsibility of head institution. Article 18 (1) Every place of 83 storage obligation to be given symbol and label. (2) Place of B3 storage as mentioned in subsection (1) obligation to fulfill the requirement for the: a. Location; b. CHAPTER V JOB SAFETY AND HEALTH Article 22 (1) Every person who conducts the activity of B3 management obligation to keep the job safety and heatth. (2) Obligation as mentioned in subsection (1) is conducted according to the existing regulation. (3) In implementation the obligation is as mentioned in subsection (1) the person responsible for the activity of B3 management obligation to participate his employees role. (4) The role according to the manual stipulated by the authorized institution in employment sector. i Article 23 (1) To keep the safety and health of worker and the supervisor of B3 obligation to test the health gradually. (2) Heath test as mentioned in subsection (1) is held by every institution according to the existing regulation. CHAPTER VI PREVENTION OF ACCIDENT AND EMERGENCY Article 24 Every person who conducts the activity of B3 management obligation to prevent the accident and or emergéncy due to B3. Article 25 In the case of accident and or emergency which is caused by 83, so that every person who conducts the activity of B3 management as mentioned in article 24 obligations to take the steps: a. Securing (isolating) the place of accident; b. Preventing the accident according to fixed procedure of accident prevention; c. Reporting the accident and or emergency to the government agency of the local district/town; and d. Giving information, aid, and conducting the evacuation to the people around the location of accident. Article 26 Government agency of the local district/town, after receiving the report of accident and or emergency due to B3 as mentioned in article 25 letter C, obligation to take immediately required prevention steps. 12 Article 27 Obligation as mentioned in article 26, it doesn’t eliminate the obligation to every person who conducts the activity of B3 management to: a. Replace the loss of accident and or emergency; and b. Recover the condition of pollutant or damage environment; Which is resulted by B3. CHAPTER VII SUPERVISION AND REPORT Article 28 (1) The authority of supervision management 83 activity is conducted by responsibility of institution and by authority of institution according to its task sector. (2) In the certain case, the authority of supervision to the activity of B3 management as mentioned in subsection (1) can be delivered to become the interest of province/district/town area. (3) The delivery of supervision authority as mentioned in subsection (2) is stipulated by responsibility of institution and or by authority of institution in its own task sector. Article 29 Supervision, in conducting the supervision to management activity of B3 as mentioned in article 28 subsection (1), obligation to be completed by identification cacd-and assignment letter which is released by the responsibility and by the authority of institution according to its own task sector. Article 30 Every person who conducts the activity of B3 management obligation to: 13 a. Allow the supervisor entering the job location and helping the implementation of supervision task; b. Allow the supervisor taking the sample of B3; Give well explanation both written and spoken; d. Allow the supervisor taking the picture in job location and or taking the photograph. Article 34 Every person who conducts the activity of B3 management obligation to present the written report of B3 management gradually at least every 6 (six) months to the responsibility and the authority of institution in its own task sector by the copy to the governor/Mayor/Head district of level II area. e CHAPTER VIIL PEOPLE AWARENESS IMPROVEMENT Article 32 Governor/Mayor/Head of level II area/Head institution who responsible for and head institution of the authority, can increase the people awareness to the impact potential which cause to the environment, human health and other living creature due to the activity of B3 management. Article 33 Every person who conducts B3 management, obligation to increase the people awareness to the impact potential of B3 which cause to the environment, human health and other living creature due to the activity of B3 management. Article 34 Increasing of people awareness as mentioned in article 32 and 33 can be conducted by spreading the B3 understanding. 14 CHAPTER IX THE TRANPARANCY OF INFORMATION AND THE ROLE OF PEOPLE Article 35 (1) People has the right to get information regarding the effort of environment impact control because of management activity of B3. (2) Information as mentioned in subsection (1), obligation to be served by the party who responsible for the activity of B3 management. (3) The service of information as mentioned in subsection (2) can be delivered through mass media, electronic media and or announcement billboard. Article 36 Every person has the right to take part in the scheme of managing B3 according to the existing regulation. CHAPTER X FUNDING Article 37 Fund is for conducting the activity as mentioned in : a. Article 6 subsection (6), article 10, 13 subsection (2), article 15 subsection (2), article 16 subsection (2), article 17 subsection (3), article 18 subsection (3), article 21 subsection (4), article 22 subsection (4), article 23 subsection (2), article 28 subsection (1) and article 32, are burdened to National Budget (APBN) and or other fund resource according to the existing regulation; b. Article 26, article 28 subsection (2) and article 32 are burdened to local budget (APBD) and or other fund resource according to the existing regulation. 15 CHAPTER XI ADMINISTRATION SANCTION Article 38 (1) Violation to provision of article 4, article 6 subsection (1), article 7 subsection (1), article 8 subsection (1) article 9 subsection (1), article 11, article 12, article 13 subsection (1) article 14, article 15 subsection (1) article 16 subsection (1), article 17 subsection (1) and subsection (2) article 18 subsection (1) arid, article 19, article 20, 22, 23, 24, 25, 30, 31, 33 and 35 are taken administration sanction. (2) Administration sanction aS mentioned in subsection (1) is conducted base on the heavy and light kind of violation according to the existing regulation. : CHAPTER XIE COMPENSATION Article 39 (2) The party responsible for a business and or an activity to cause huge and important impact to the environment which uses the hazardous and toxic waste and produce the waste of it, responsible for the resulted damage absolutely, by the obligation to pay the compensation directly and instantly in happening the pollution and or damage of environment. (2) The party responsible for a business and or an activity can be set force of obligation to pay compensation as mentioned in subsection (1) if the related person can prove that the pollution and or the damage of environment caused by one of the reason below: a. There is natural disaster or war; or b. There is forced condition beyond human ability; or There is the third party who causes the pollution and or the damage of environment. 16 (3) In the case of loss is caused by the third party as mentioned in subsection (2) letter C, the third party responsible for paying compensation. CHAPTER XIII CRIMINAL PROVISION Article 40 Every person who violates the provision of article 4, article 6 subsection (1), article 11, article 12, article 13 subsection (1), article 24, article 15 subsection (1) article 16 subsection (1) article 17 subsection (1), article 18 subsection (1) and (2), article 19, article 20, article 22, and article 24 cause the pollution and or the damage of environment, threatened by the criminal as mentioned in article 41, 42, 43, 44, 45, 46, and 47 Law Numper 23, 1997 regarding the environmental management. CHAPTER XIV TRANSITION PROVISION Article 41 If it is regulated this government regulation = a. There of B3 is forbidden to use in Indonesia, so that B3 can be exported to the country which require it according to the existing export mechanism; b, There of B3 which has circulated but not be registered so that obligation to be registered by the saver, dealer, and or user according to the provision as mentioned in article 6 subsection (3). Article 42 When this government regulation applies alt regulations that are connected to existing B3 management has been declared to keep in effective as long as it is not contradictory with and not be changed yet based on this government regulation. CHAPTER XV CLOSING PROVISION Article 43 This government regulation comes into force 6 (six) on the date stipulated. In order every person recognize it, orders this government regulation by placing in state gazette Republic of Indonesia. NAHATTANDS 18 ELUCIDATION GOVERNMENT REGULATION OF THE REPUBLIC INDONESIA NUMBER 74 OF 2001 REGARDING HAZARDOUS AND TOXIC WASTE MANAGEMENT GENERAL The acceleration of development activity in Indonesia can boost the usage in crease of hazardous and toxic waste (B3) in many sectors such as industry, mining, agriculture and health. The B3 can come from home or abroad (import). B3 is produced from home (inside country), also exported to a certain country. The process of this import and export are getting easy conducted by entering globalization era. During the last three decade, the usage and the amount of B3 in Indonesia are getting increased. The usage of B3 keep increasing and spreading broadly all over the sector, when its management is not conducted well, so that can cause the loss of human health, other living creature and environment such as air pollution, land pollution, water and sea pollution. In order B3 management doesn’t pollution the environment and to reach high security degree, based on continuous development principles and increasing the human life quality, so that needs acceleration of its management effort better and integrated. The policy of B3 management lately still is ccnducted partially by many related institution, so that its implementation still find out many obstacles. Therefore, it is getting realized the need of government regulation regarding integrated B3 management which covers the activities of production, storage, package, symbol and label, transportation, usage, import, export and its waste. The need of this government regulation arrangement strictly is called in agenda 21 of Indonesia, National strategy to continuous development and as the implementation of article 17 subsection (3). From the tests result will be acquired the heat temperature value. If the heat temperature value of material is bigger that the reference compound, so that the material is classified as explosive. Oxidizing Solid material test include in oxidizing 83 criteria can be conducted by burning test method using ammonium persutphat as standard compound. Whereas the liquid material, standard compound which used is.nitrate acid. By the test, a material is declared as oxidizing B3 if the time of material burning is as same as or shorter the time of standard compound burning. Extremely flammable is B3 whether solid or liquid which has the flame point under 0°C and boil point are lower than or as same as 35°C. Highly flammable is B3 whether solid or liquid which has the flame point 0% - 21°C. Flammable has one of nature as follows: 1. Liquid Liquid material which contains alcohol less than 26% of volume and or flash point hot more than 60°C (140°F), will flash if contact to the fire, sprinkling of fire or other flash resource in air pressure 760 mm Hg. Its test can be conducted by closed-up test method. 2. Solid Non liquid B3, in standard pressure and temperature (250°C, 760 mmHg) easily causes happening the fire through friction, water vapor reservation or spontaneously chemical change and if burns, it can cause continuously burning in 10 seconds. Besides, a solid material is classified of B3 of flammable if in the test by closed-cup flash point test method required flash point tess than 40°C. f. Sufficiently clear 9. Sufficiently clear h. Practically non-toxic 5,001 ~ 15,000 6.
