Commission: -X Promulgated: August 18, 2015 RESOLUTION NO: 9983 y= WHEREAS, subparagraph 9.2, Section 9 of R.A. 9189 provides that the names of overseas absentee voters may be ordered removed by the Commission from the National Registry of Absentee Voters for their failure to exercise their rights to vote under the Overseas Absentee Voting Act of 2003 for two (2) consecutive national elections; WHEREAS, on May 27, 2013, Congress passed R.A. 10590 amending R.A. 9189; WHEREAS, Section 13 of R.A. 10590 provides the deactivation of registration records of registered overseas voters who failed to vote in two (2) consecutive national elections; WHEREAS, as of June 30, 2015, the total number of registered overseas voters has already breached the One Million mark and is already at One Million ‘Two Hundred ‘Twenty Thousand Five Hundred Thirteen (1,220,513). This figure represents the active, inactive and newly registered overseas voters; WHEREAS, in the May 13, 2013 National Elections, there were Two Hundred ‘Thirty-Kight Thousand Five Hundred Fifty-Seven (238,557) registered voters who failed to vote in the 2007-2010 National Elections whose registration records were not removed from the National Registry of Overseas Voters (NROV) and Certified List of Overseas Voters (CLOV) due to the passage of COMELEC Resolution Nos. Resolution No. 9567 and 9578 allowing these overseas voters to file their manifestation of intention tovote; _¢ * Resolution No. 9843 “ Implementing Rules and Regulations of Republic Act No, 10590, Otherwise known as An Act amending Republic Act No. 9189, Entitled: « An Act Providing for a System of Overseas Absentee Voting for ‘Qualified Citizens of the Philippines Abroad, Appropriating Funds Therefore and For Other Purposes.” WHEREAS, for purposes of the May 9, 2016 Elections, after updating the voting history of each and every registered overseas voters, there are One Hundred Sixty-Three ‘Thousand Nineteen (163,019) who failed to vote in the 2010 and 2013 election; WHEREAS, deactivation of registration records of overseas voters who failed to vote in Two (2) successive elections is mandated under Section 13 of R.A. 10590; WHEREAS, maintaining the registration records of those who failed to vote in two successive elections in the National Registry of Overseas Voter (NROV) and in the Certified List of Overseas Voters (CLOV) would have an adverse impact in our election preparation, budgetary estimation, and voter turn-out. It would also affect the accuracy of having real numbers in the registration count for purposes of data collection for future reference. NOW THEREFORE, pursuant to the powers vested in it by the Constitution, the Omnibus Election Code, Republie Act Nos. 9189 and 10590, the Commission on Elections RESOLVED, as it hereby RESOLVES, to implement Art. 51° COMELEC Resolution No. 9843 promulgated on January 15, 2014, as follows: 1. Not later than August 31, 2015, the OFOV shall provide the Resident Election Registration Boards (RERBs) with the lists of voters whose registration records are due for deactivation. 2. On the 3" Monday of September 2015, the RERBs of the Posts shall conduct a hearing to consider the lists of those who failed in two consecutive national elections. After due deliberation, the RERB shall issue an Order of Deactivation which shall contain the names of those whose registration records have been deactivated. 3. The RERBs shall remove the deactivated registration records from the corresponding book of voters and place the same, properly marked and dated, in an inactive file. 4. Within five (5) days from issuance of the Order of Deactivation, the RERBs shall submit the lists to the OFOV which shall in turn direct the ITD to mark the fact of deactivation on the names of the registered overseas voters in the NROV and ROY. 5. The RERBs and the OFOV shall post the lists of those whose registration records have been deactivated, at the bulletin board and website of the Post and in the websites of the Commission and the DFA. 6. The RERBs shall notify the overseas voters, through their e-mail accounts, or through the social media networks, or through the websites of the Posts, DFA and the Commission, that their registration records have been deactivated, the reasons for deactivation and the period within which to contest the deactivation, which shall be not later than September 30, 2015 ‘The OFOY shall furnish copies of this Resolution to the Department of Foreign Affairs and various Posts and sive it the widest diccominatian naccihln Reso. 9983 Resolution shall take effect on the seventh (78) day after its publication in two (2) daily newspapers of general circulation.
